Johnson v. Johnson

A war has broken out between Hinds County Election Commissioner Toni Johnson and local radio talk show host Malcolm Johnson.  There are casualties in every war and this one is no exception as Ms. Johnson had to resign as Chairwoman of the Hinds County Election Commission last week while WOAD terminated Mr. Johnson's radio gig.

Mr. Johnson is also the assistant to Hinds County District 2 Supervisor David L. Archie.  Mr. Archie has been raising hell over Ms. Johnson's alleged spending as Chairwoman of the Election Commission.  Mr. Johnson has made some rather colorful statements about Ms. Johnson on his weekly WOAD radio show, Tell It Like It Is.

However, WOAD fired Mr. Johnson last week after Ms. Johnson's attorney, Warren Martin, notified the radio station his client intended to sue for defamation.  A June 28 Notice of Claims letter sent to WOAD states:

Mr. Archie appeared at a meeting of the Hinds County Election Commission last week and accused Ms. Johnson of spending thousands of dollars on lunches and training without Commission approval.

WOAD fired Johnson a few days later.

Mr. Johnson was not fazed by the letter.  He said his contract expires at the end of July.  He also said he could back up his statements with proof and could not wait to do so.

The tag team of Archie & Johnson may have the last laugh on the Election Commissioner from District 2.  Mr. Archie's allegations resulted in Ms. Johnson resigning her position as Chairwoman Friday.  Justin Vicory reported in the Clarion-Ledger

Hinds County Election Commissioner Toni Johnson resigned as the board's chair on Friday, calling accusations she improperly spent county funds a "witch hunt." ...

Johnson tendered her resignation before the commission could strip her of the chair,  fellow Commissioner Yvonne R. Horton said. Johnson will continue in her seat as election commissioner for District 2.

Horton said the commission announced Friday it would hold a special meeting at 2:30 p.m. to consider removing Johnson as leader of the board. Johnson announced she would step down prior to the meeting, Horton said. ...

Johnson's resignation follows accusations at a Thursday commission meeting that she misspent county money.

Supervisor David Archie pointed to lawn care and COVID-19 cleaning expenses totaling over $8,000 a month as one example of questionable expenses he says Johnson reported.

He also questioned training lunches reported by Johnson costing $4,216. When asked about the lunches during the meeting, none of the commissioners could recall attending.

A February receiving report from the county's purchasing department shows funds  spent for one election commission training seminar for 20 people that included labor, delivery and condiments.  .... Rest of article.

Stay tuned.  There will definitely be a tomorrow.

I thought a county's BOS had to approve and sign off on every expenditure of their Election Commissioner's requests??? I mean the election commissioners that I know have no direct access to funds to purchase, buy or pay for anything??? Also, if the Election Commissioners DONT spend their funds from time to time (new machines, PPE, etc.) wont most BOS's take our funds and move them over into the general fund???...

This is why Bridges out, road not paved and grass not cut. MisSpending Tax Payers Money! She and who ever participated this fraud against Tax Payers should be receiving a visit from State Auditor SHAD WHITE very soon..

Jackson and Hinds County officials had better learn an important lesson when dealing with David Archie: You can't trash a pig but he sure can trash you!

I imagine Mr. Shad White has big plans coming Hinds Countys way. And it will be welcomed ! Lol, you know there is much more misappropriation and all this finger pointing indicates guilt !

Continuing with the David Archie / pig metaphor - when you wrestle with a pig, you'll both get muddy, but the pig will love it.

I detest grammatical errors and the use of incorrect phrases in a legal document. Twice in the top portion of the document (above), you will find the phrase 'Counsel or record'. Misstating the proper description of plaintiff's attorney is bad enough, but repeating it and then no proof-reading is inexcusable.

At one time people took pride in their work.

@11:26am: “…then no proofreading…”

I'm not 11:26 but he/she did say Legal Docs, 11:39.
Not blog comments.

I used to see typos as annoyances but I am sure I make plenty, so I am hesitant to point them out in others now.

Actually, 11:39, there are three acceptable uses. Here, for your edification:

proof reader [open spelling as two words]
proof-reader [hyphenated compound noun]
proofreader [closed compound spelling as one word]

Ur Walcome...

Get your popcorn ready as there's a special Hind County board meeting Wednesday at 9:00am with the only items listed are removing Archie as Board VP and voting for a new VP.

EPIC FOOD FIGHT COMING!

Why are you so obsessed with David Archie?

Borderline creepy.

I don’t mind a typo here and there as much as I mind people in authority who lack the ability to correctly pronounce common english words like “ask”

Anonymous said...

This redneck is obsessed with Mr. Archie. Sheesh.

“Counsel seek”

Warren is her lawyer alone so I read it as singular.

“Counsel seeks”

?

And why in Madison county I wonder?

Venue is proper in Hinds as thats where the defamatory remarks were made and even heard……must be something more to that.

Where do you think WOAD is?

Malcomb is a "Special Projects Officer working for Archie, which means lapdog making $38,000 per year on the county payroll. Toni got slapped with an ethics complaint during her first term because the other commissioners accused her of having secret meetings. She later resigned as commissioner to run for supervisor (and word has it she didn't have any idea she would have to resign in order to run). She came in a distant third to Archie and McQuirters. So she ran for commissioner again and won, mainly nobody knows when election commissioners run for office or how to sign up. I don't think she'll be able to resist running for supervisor again.

And we used to think Earl Dean Rhodes and Rankin County were entertaining.

Do these people have any way to make a living other than as some kind of officer in local government? Or do they just continue to seek public office to settle old scores? It seems like they're carrying an awful lot of baggage from previous positions and past run-ins.

@12:58PM

I agree. I thought it was only me who noticed as much.

Toni Johnson attorney sound like he has something personal against David Archie & Malcome Johnson. He never said nothing about the TVs and Applainces, but keep talking about a radio program.
2.5 years in prison..

The point regarding grammatical and other glaring errors is that, especially in legal documents, that tend to survive and have meaning forever, should never include them. Otherwide, irregardless of what some think, they don't hardly make no different no way.

I'm 11:26 and 12:10

T. Johnson will sue M. Johnson and the M. Johnson will counter sue. Then Shad White will verify that M. Johnson was correct. Then Warren Martin will look crazy and Blame David Archie for T. Johnson being convicted.
Sources also say that T.Johnson owe Alpha Media monies from advertisement during her last campaign. She wrote station a bad check.

That's a lot of Johnsons. Insert joke about government sausage.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.

In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. Just bring the hate. Bring the family, Trollfest '09 is for EVERYONE!!!

This is definitely a Beaver production.
