State Auditor Shadrick Blanc issued the following statement.
Today
State Auditor Shad White announced Special Agents from his office have
arrested Colleen Ladnier, a former deputy tax collector in Jackson
County, after she was indicted for embezzlement by a local grand
jury.
Ladnier is accused of intentionally overcharging Jackson County residents as they paid for vehicle license tags. She allegedly embezzled the extra money she collected. Ladnier purportedly used a permanent marker to obscure payment amounts on customer receipts and conceal her embezzlement scheme. Local officials called the Auditor’s office when security camera footage from the tax collector’s office showed Ladnier stuffing cash she had recently collected into her shirt.
Ladnier surrendered to Special Agents in Jackson County yesterday. Bond will be set by the court.
If
convicted, Ladnier faces up to 20 years in prison or $5,000 in fines.
All persons arrested by the Mississippi Office of the State Auditor are
presumed innocent until proven guilty in a court
of law. The case will be prosecuted by the office of District Angel
McIlrath.
“The
Office of the State Auditor is committed to investigating and stopping
this sort of theft,” said Auditor White. “Every local government office
needs to put into place internal controls or cameras
to make sure this kind of theft is detected and stopped quickly.”

Shad didn’t do anything but come in and do a press release. Kudos to the tax collector staff for blowing the whistle.
I think it is excellent that our State Auditor does not play when it comes to dirty public officials and employees. But this case may end up presenting an interesting issue for the ladies of the Attorney General's criminal appeals division, at least those not out on maternity leave, if the case is prosecuted as an embezzlement case and in the event the perp elects to go to trial and is convicted of embezzlement. The question is, did the perp commit embezzlement as the law defines embezzlement or some other crime? As I understand it, what this person did was knowingly overcharged people, gave them full and proper credit for their payment for what they actually owed, gave the government its due, and then kept for herself the rest. What the perp did not do, though, was keep any of the money that was paid to her for the tax due. The essence of embezzlement is the situation where a person comes into possession of personal property, including money, legitimately and then converts it for his own use. The obvious example is the bank teller who takes your ten dollars for deposit to your account and then puts your ten dollars into his pocket. The difference between theft and embezzlement is that in embezzlement the initial taking of possession of personal property is legal, whereas in theft the initial taking is against the rightful possessor's will or intent. But here, with this person, it would seem that she might have committed something more in the nature of a theft by fraud. The people who gave her the extra money did so because she defrauded them into believing that they owed it. They gave her the extra money fully intending to do so, but the perp obtained possession of it was by deception and fraud. Does it make a difference that the perp added to the amount actually owed, such that there would be no distinction between what was owed and what the perp charged?
Neither Shad nor any previous auditor investigates nor finds corruption. There is a professional staff that outlasts all of the politicians. They respond to whistleblowers who tell them where to look. The politicians, including Shad, only dirty their hands preparing press releases touting their personal accomplishments with a rare mention of the staff auditors/investigators that actually do the work. Bunch of dumbasses that buy the bull shit from the politicians (Dem and Rep alike).

Shad White sold out early on, especially on education where he campaigned about how his parents were lifelong educators, etc. but began to find out the enemies he would make. Just another ball-less Mississippi politician - who apparently wouldn't make it outside the state.
