Hinds County Circuit Judge Tomie Green sentenced a violent thug who shot two small children by UMMC in 2018 to serve ten years in prison. JJ reported on November 29, 2018:
There was a shooting at Woodrow Wilson and North State Street. Mother with baby fled into garage. Baby was apparently hit. Witness said it was between 10 and 12 shots. Lady came to ER at UMMC. Her child was shot in chest. She was sitting at intersection. Black car was chased into the parking garage between Levels B and C.Alcantara Garner surrendered to police on December 10. JPD charged him with three counts of aggravated assault and one count of shooting into an occupied vehicle. A Hinds County grand jury indicted him on May 16, 2019 for three counts of aggravated assault. The indictments include a shooting of a Jonah Barton. The relationship of Barton to the victims is not known.
There were apparently two children shot. One child was shot in arm, one was shot in abdomen. They are in STABLE condition. Children are a 15 month old female and three-year old male. Mother told police a car pulled up next to her's and someone shot into the car.
Garner pleaded guilty on November 5, 2019. Judge Green sentenced him to serve 20 years in prison but suspended 10 years of the sentence. He must serve a probation term of three years upon release. Attorney Leslie Brown represented Garner. Assistant District Attorney Jennifer Malik prosecuted the case.
Kingfish note: So does the 50% rule apply to this guy? Does that mean he gets out of prison after five years? Actually four if one counts the year already served in the county jail.
Dear Jackson voters: Take your vigils and stop crime rallies and shove them up your collective asses. These sentences are what you want because you keep putting the same people who allow this to happen back in office. Shoot two kids and a mama, get out in five. Who said crime doesn't pay?

This kind of BS has more to do with why droves of productive people are fleeing our state than anything our Republican leaders (as ignorant and incompetent as they may be) are doing or failing to do.
Life doesn't mean anything to thugs
Tomie Green need a spanking herselve!!! She dummer than me
You are wrong. Aggravated assault is a "day for day" sentence so the 50% rule does not apply. He will serve 10 years.
I am not wrong. I asked an honest question.
1:23. You win. It’s dumber...
Life in prison is better than these thugs can provide for themselves. She got the job because of her skin color and gender. Those features are good, but should never automatically mean she is competent. More crime and repeat offenders under her watch. Time to open a practice Greeney.
Don't give a free pass to the incompetent prosecutors at the DA's office.
Just more judicial terrorism plaguing the city of Jackson.
Where's Fat Melvin now?
Aggravated assault is absolutely not a day for day crime. That only applies to armed robbery, sex crimes and capitol murder. (Unless Defendant was convicted as habitual, which he was not.)
The only conclusion I can draw from this ongoing issue is that a majority of Jackson residents want to live in a big ghetto. I don't, so I moved out. As far as I'm concerned, it really is that simple.
Call the people out who contribute to their campaigns. Make that bunch uncomfortable. Dennis Sweet, Dorsey Carson, Mike Morgan, Merrida Coxwell, Brent Hazzard & Jody Owens with Richard Swartz, Fred Banks and a host of other attorneys making campaign contributions that contribute to the continual downfall of our capital city.
Problem is, at election time no one remembers these sentences. And Green's opponent, if she has one, never brings them up. Green runs on an "I was the first black judge" platform, not on her record.
Give us someone to vote for against Green, and they have to actually campaign.
Absolutely don't give a pass to the Assistant D.A. who prosecuted this case. She recommended this sentence, and the judge went right along with the recommendation. There were kids involved. This thug should be serving 60 years (20 years x 3 counts consecutively). So much for having a new D.A. in town who wants to fight crime.
I came to the same conclusion, 2:22 p.m. The majority are resigned to the belief that they can't control the small percentage of hardcore urban terrorists that roam the city 24/7 like wild animals, and for various reasons they dislike law enforcement more than they dislike the criminals. Nor do they really hold their elected officials accountable for rampant crime. So they have settled into letting Jackson continue to spiral downward into a gangster's paradise.
This is very hard to stomach at first blush, but playing devil's advocate, maybe he pleaded out in return for 10 years. Maybe Judge Green agreed to it to get his ass out of Hinds County's detention center and hand him over to MDOC. Maybe the whole thing got pleaded out because we had a crooked DA and incompetent assistant DAs and we have a US Department of Justice demanding to get the mail population down. Maybe getting idiots like this out of the detention center will help cut down on the riots, fights, beatings and contraband.
Or maybe they didn't have a great case to prosecute.
I agree, the crime calls for more time. But I'm glad this guy is going to the state pen.
Look for it! The same tired-assed old liberal can always be counted on to jump in and comment on 'everybody leaving the state' and 'the evils of republicans'.
No doubt a fry cook in training down to Hamburger Heaven.
The D.A.'s office makes open pleas in Judge Green's court for a simple reason: She will cut any recommendation they make. If the D.A. had recommended ten years, she would have cut it to five.
I fee the same way KF does about the stop crime marches and damn vigils! Stupid silly crap just to get on television and give certain community leaders face time so their constituents think they are actually doing something productive. Praying doesn’t get this solved. There has to be repercussions to actions such as this.
Look into the JPS AD who post coaching openings on the MHSAA website for two days and then takes them down...been doing it for years...half his picks have definitely been nepotism too.
Was 10 years the stiffest penalty allowed by law or did Judge Green give minimum sentence?
Kingfish, I have been practicing criminal defense in front of Judge Green 17 years and she has never once cut a sentence recommendation to my knowledge. Based on the recommendation it appears the State didn’t have a strong case so they would rather him get some time rather than lose and he walks.
Interesting to me that WLBT reports he got 30 years.... https://www.wlbt.com/2020/01/11/alcantara-garner-will-serve-years-shooting-two-children-jackson/
Mike Hurst needs to make another public statement, specificly naming the Judge who let the thug off light.
Should have been 20-25 years.
IF TRUE - This surely bears seeing again. I love it when scoundrels are bright-lighted! Light 'em up. Maybe they'll post to defend their contributions. I'm surprised and disappointed to see a couple of these names.
"Call the people out who contribute to their campaigns. Make that bunch uncomfortable. And Jackson wonders why the Feds take over and prosecute on the Federal level. Dumb Asses like Judge Green who keep letting everyone go. Jackson y’all elected her so stop whining. It’s a crap hole and nothing but THUGVILLE.
Judge Green is a biased, vindictive judge ... probably for as long as she cares to stay on the bench.
Too bad he wasn’t charged on a federal level. Maybe next time.
What about the guy who had 3 DUIs and prior meth charges killing that unborn baby? He bonded out!
8:54 - Whose courtroom? Name it and claim it!
Judge Green has done more to harm Jackson (and Hinds County) than any other single person.
Don’t like it?
Become a lawyer and run for judge.
Maybe be a part of the solution rather than a squabbling whiner all the time?
A question KF...isn't this a plea agreement? And, if so, how often do judges reject a plea agreement? Is this her fault or the DAs?
And, is the cost and time of trial, and the state of our prisons a factor?
I just saw a piece on Parchman and the photos of crumbling conditions looked as bad as the worst 3rd world prisons. It also said our legislature cut the budget by $130 million years ago so that maintenance has been non-existent and many cells have no electricity or running water.
I think she appears to be too lax, but she should have the opportunity to explain her rationale. Does she refuse interviews?
@6:42, it is true. I posted it after I looked it up on the sec of state’s campaign finance reports. The “woke” left wants to call out people who may be even loosely connected to something that they don’t agree with and try and have people shun them. It’s high time those of us who are tired of putting up with this shit do the same thing. You support these social justice warrior judges, you’re going to get called out from here on out.
No one left in Jackson to hear any of this. All the people that carec are now gone.
How much time was Judge Green allowed under Mandatory sentencing guidelines?
So he shot 10-12 times, and did not know who he was wounding or killing and a judge gives him 3-10 yes. Why would this happen? Why would anyone ever trust this judge? Why would anyone ever vote for this judge? If you were shot, your children, your nieces or nephews or grandparents? If this judges family was shot randomly, would this be the verdict? What the hell is wrong with Jackson and why this city will NEVER SUCCEED OR BECOME BETTER is this judges verdict and sentence.
Judge Green, "Black Lines Don't Matter!
I am sure those two children deserved it. A 1 year old and a 3 year old deserved to be shot and put in a situation where the mother had to drive and hide in a parking lot. The judge is only punishing the children and mother. Apparently they were very bad and they deserved all the trauma from running from a person shooting at them, into a garage to hide and hey, they got pudding at the hospital after the surgeries. Judge Green, great advocate for the black children of Jackson.
The 6:42 comment refers to Mike Morgan the lawyer,, not the former supervisor.
in order to slow the crime down the system must get tough on it.
Judges wanting to 'slow down crime' is like us assuming oncologists are hoping for a cancer cure. Or the notion that race-baiters are hoping racial division will end. Think about it.
The more white people who hate Jackson and talk about " good people" ( code for white) leaving and attack Tommie Green or any other African American who is elected, the more support they get. African Americans are far more worried about those of you who appear to miss the days of the KKK than they are about lenient judges and potholes. And, that's for good reason. Bad justice is better for them than no justice.
Until some of you are able to accept and embrace the fact that there are decent humans and indecent humans and ban together against the indecent humans, we are doomed as a species.
10:28 Embracing "bad justice" confirms why we're wanting to distance ourselves.
10:28 makes an interesting argument, that the black people of Jackson are justifiably more afraid of white people than they are concerned with violent crime and crumbling infrastructure in their own communities.
Personally, I refuse to accept this extremely jaded and cynical rationalization for the current state of affairs in Jackson. I do acknowledge that some of the leaders/influencers in Jackson have a vested interest in promoting this narrative, as it gives them power over those they wish to lead and influence.
As long as the racist leadership in Jackson and other democrat controlled large cities can convince their people that the white man is the boogie-man and is out to get them, they win. But, the definition of 'win' is disaster for those who are following these pipers.
It was a plea deal, and the judge followed the ADA's recommendation. The ADA, Jennifer Malik, who prosecuted this case does not even live in Hinds County, so what does she have to lose? Just give the defendants a free pass because it doesn't matter to her.
Don’t family members of the murdered children have to agree to plea deal first before the offer is made? This is appalling but Godwill issue the final judgement if he makes it out of prison.
