A Hinds County Chancery Court ruled the Mississippi Public Service Commission must give Bigger Pie
Forum records related to the Kemper County clean coal plant after it failed to comply with an earlier order.
Read the judge's order here.
Bigger Pie Forum filed a
public records request with the Commission for records containing
Mississippi Power Company's 2009 natural gas price forecasts
used justify the construction of the company's $3-billion clean coal plant
under construction in Kemper County in July 2012. The case was heard in September.
Miss. Public Service Commission fails to comply with court order
Mississippi Power Company asked
the Commission on April 18 to delay giving the records to Bigger Pie Forum. The company stated it was unaware of the judge's order and wanted to
file an appeal.
Commission attorney Shawn Shurden said
the Commission would comply with the order and give Bigger Pie the
records by 3 p.m. At 3:01 p.m. Shurden said the Commission would not be
complying with the order.
Mississippi Power filed a motion for protective order. The court dismissed the motion.
Bigger Pie Forum is filing a motion for contempt of court. The matter will be heard before Judge Thomas on Tuesday.

Kudos Bigger Pie. Go kick their ass.
Let me get this right. Dewayne Thomas is all gung-ho to get Mississippi Power to cough up public records but ol' Dewayne did everything he could to sandbag Kingfish's request for public records before recusing and still hassles Kingfish in his courtroom to this day.
Par for the course for a judge who is a rabid partisan Donkeycrat first and an objective judge a distant second.
You see Mississippi Power -- Btw, I don't support Kemper -- is a favorite target of Donkeys statewide while Precious Martin and Lt. Robert Graham of the Jackson Police Department are darlings of Donkey Dewayne here in Hinds County.
Dewayne Thomas is a hack.
