Precious and Moore try to seal case & accuse Sweet of "unethical and illegal conduct"

Attorney Precious Martin and Ricky McClinton filed a motion to seal the case in the complaint filed against them in U.S. District Court last week. The motion also accuses attorney Dennis Sweet of possible "unethical and illegal conduct." Precious Martin, Ricky McClinton, attorney James Bobo, and Hinds County Constable Jerry Moore are defendants in the lawsuit. Attorney Chuck McRae represents the defendants. Attorney Dennis Sweet filed the complaint on July 2 on behalf of Renetta Vance Howard and Veionisia Vance. Renetta is the mother of Kyuena Vance. Kyuena Vance was killed in May. She and Shyeuna Vance stopped to help a disabled motorist on Highway 80. A vehicle slammed into the disabled vehicle, killing Kyuena. She left behind three children that had three different fathers. Ms. Howard filed a petition for guardianship of the three children on behalf of the grandmother and three fathers.

The plaintiffs alleged in the complaint Attorneys Precious Martin and James Bobo repeatedly contacted Ricky McClinton in an effort to represent his daughter in the wrongful death action. Mr. McClinton then filed a petition for guardianship in Hinds County Chancery Court. He was represented by Precious Martin and James Bobo. The complaint states Mr. Martin filed another petition for guardianship for Mr. McClinton. The child was living with Ms. Howard.

The complaint states Chancellor Dewayne Thomas signed an order granting guardianship to Mr. McClinton. The plaintiff alleges Mr. McClinton, Constable Moore, and a John Doe went to Ms. Howard's home in Bolton to get the child after meeting with Mr. Martin. Ms. Howard refused to let them in the home. Mr. Moore called the Hinds County Sheriff's office for back-up (JJ confirmed this but was told they were responding to a back-up call. They had no idea what was the reason for the call.). They allege the constable kicked open the door, took the child, and handed her to Ricky McClinton who then left with her. Mr. Sweet argues there was no valid warrant nor a valid court order awarding custody as the court order issued by Judge Thomas only established a guardianship.

The complaint states Mr. Moore searched the home and Veionisia was arrested and charged with marijuana possession. The complaint states Mr. McClinton has been arrested at various times and that giving him custody is not "in the best interest of the child." Some of the alleged charges are domestic violence, gun possession, and drug possession. Mr. Martin asked the court to seal an exhibit filed by the plaintiffs. The exhibit contains various arrest reports and affidavits made against Mr. McClinton. The exhibit does not contain any convictions and it is important to note no convictions are mentioned in the complaint. The defendants point out there are no convictions in their memorandum in support of the motion to strike mentioned later in this post.

The defendants filed a motion to seal. They call the complaint "vexatious and slanderous". The motion states the mentioning of the various charges and affidavits is made for the purpose of harassing and slandering the defendants and have no relevancy to the case. The motion states the defendants will show "unethical and illegal conduct by plaintiffs and their counsel." Copy of motion to seal. They also filed a motion to strike asking the court to strike the offending paragraphs if the motion to seal was denied. Motion to strike. Memo in support of motion to strike. The plaintiffs reply the charges are relevant to "the best interest of the child" and it was the custody action that formed the basis of this incident taking place.

This is all a show. It would not suprise me if Sweet and Martin were best friends outside of the courtroom. It's amazing how wrongful death money brings lawyers out if the cracks.

Anon at 1:51. It isn't about a show. This is a high stakes pissing match resulting from client poaching.

With these allegations of unethical and illegal conduct I wonder if anyone has filed a bar complaint?

I’m thinking the bigger story is why in the hell would Chancellor Dewayne Thomas grant custody to someone with a laundry list of felonies and allegations of child molestation???

How in bloody hell is that considered “best interest” of a child?

The chancellors in Hinds County know absolutely no boundaries in regards to their grandiose wisdom as they continually engage in what often seems like outright fraudulent rulings.

I wonder if Thomas had lunch with Martin’s mama-in-law prior to all of this and knew beforehand that he would have a deadbeat dad covered in dollar signs appearing before him?

I know that’s just pure speculation on my part, but cronyism in Hinds County is the norm rather than the exception.

Martin doesn’t even practice family law but jumps in and becomes a champion for father’s rights ONLY because a wrongful death suit is at hand that could line his pockets with millions of dollars.

That’s the Black Legal Mafia in action down here in Hinds County and someone needs to stop them.

I hope the feds destroy these crooks.

jim is a good, honest guy. dad was dr. bobo, jim went to millsaps then ole miss law. i've worked with him on a couple of things, he is extremely smart, wry sense of humor, and eithical beyond question.

So I doubt seriously if this is a joint effort. It appear to be only one culprit here and that is Precious Martin. It should not be about the wrongful death lawsuit but the welfare of the child.

Precious has been getting away with all kinds of corrupt activities for a few years now - with wife for the board attorney and mother-in-law on the bench, poor little precious Precious has made millions in ill-gotten gains. Don't think he practices outside of Hinds County - ever wonder why?

Where else could he pull off a stunt like this - taking a drug dealer constable to kick in a door and pick up a child to hand over to a felon 'guardian'? Where? Only in Hinds County and the corrupt courthouse.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox.
