Karen Irby was driving 70 mph

Will explain this one later. The Wolf is on this mf.

Update: Going to write about this one in a while. What I will say at this time is that Christopher Barhnardt, yes, that guy, conducted the first accident reconstruction. Turned out he had used the wrong mark to calculate speed. When the D.A. went back to recalculate the speed, the error was discovered. JJ has also learned that Officer Barnhardt had flunked a portion of the state test for becoming certified in accident reconstruction although he was certified elsewhere.

Several sources have also informed JJ that Officer Barnhardt tried to charge the plaintiff's $2,500 for his deposition in the civil lawsuit. Mr. Barnhardt eventually testified for free.

I just wish I knew what it was that made her agree to a plea. Was she convinced that the evidence against her was that damning? Does she believe that she has been able to buy a short sentence? I really, really want to know.

And those kids -- mom going to prison, they get left with Stuart. The State needs to station someone from CPS in the Irby driveway.

What made her agree to a plea likely was the reality that her trial on a depraved heart murder charge was going to start next week and there was a good chance a she would have been found guilty, which would have resulted in a much longer prison sentence than she likely will receive now.

70 or 100mph. What difference does it make? Both are over the speed limit and very, very fast for that section of Old Canton Road She literally had no defense. She was legally drunk and driving too fast and killed two people. The evidence against her was too much to overcome even if she had a really good defense lawyer. And is anyone surprised Stuart didn't show up? I am sure not. He is probably celebrating that he isn't going to prison with her like he should be.

What is the speed limit on that section of Old Canton? About 35? Just guessing here (because I'm too lazy to look it up), but is there statute or case law stating that driving MORE than double the speed limit is presumed reckless/depraved/etc. whereas double or less is merely negligent? Just a thought...

I'd say 7-10 yrs for each count served concurrently is what she gets.

I've recently heard of another culpable negligent manslaughter in Rankin county that got 7 yrs.

The question isn't why would Karen seek a plea. She's obviously guilty of the original charges. The question is why would the DA go for it?

I'm betting there's footage of ccj of Stuart getting behind the wheel and several eye witnesses of them getting pulled over by JPD north of the crash site.

JPD/DA/City of Jackson has as much to lose by this coming to trial as the Irby's.

Now, the real questions are, how much money will change hands between now and sentencing. And, how will this affect the civil trial.

And yeah, I think the 7-mph isn't factual, it's 'stipulated' as a basis for her plea. It's too 'convenient' that it's *exactly* twice, but not more than the posted speed limit. Are they sure it wasn't 72mph? 73mph? No, exactly 70mph. Fishy, very.

Good Old Boy Network wins again. Everyone else loses. As usual.

I figure she'll get off with 'time served'.

Regardless of JPD investigation questions...

1. I bet the civil suit has a deal in place, not public or filed yet.
2. Family of Dr.'s agreeing to sentence possibilities (most likely, I've heard, 20 years concurrently - Serves 12/8 suspended).
3. Guilty plea allows private information about that night that shines light on Stuart now stays out of media.
4. Bet your ass Karen and Stuart have an agreement in place for when he divorces her, that lets her be a wealthy woman when she gets out - oh and a non-disclosure agreement to prevent any discussion of what really happened that night.

What she said in open court is the minimum she had to say to meet legal requirements...wonder if the written plea has more? I saw her look to Holloman for guidance twice.

The second indictment is still a mystery to me . It is the third indictment already filed of assault against Stuart that was dismissed. The mystery indictment was filed YESTERDAY and this plea was already done.

I wonder if she's turned on Stuart and will say he grabbed the wheel or something?

If she can't have Stuart, I can't imagine her letting anyone else have him.

she took the plea for the same reason criminals take pleas every day in every city and state in America: to have a chance to avoid the maximum sentence and plead for mercy rather than gamble, go to trial, and perhaps get convicted of murder for which there is an automatice life sentence [ with slim chance of release at age 65 if at least 10 years has been served at that age ].

its just too easy to make accusations on these forums that could be libel elsewhere.

if any of you idiots have proof of corruption, bring it to JJ pesonally and I'll bet he will pursue it. Come on. I dare you.

12:08. As I said, if you'd bother to read the *entire* post, WE KNOW why SHE took the plea.

WHY did the DA take part. DA's don't *have* to take part in plea deals. Ask any number of criminals behind bars right now that did NOT get plea deals offered to them.

Would a poor black have gotten a plea offer for a similar crime? Only if you're as crazy as Karen Irby would you believe that one...

If Sheriff Campaign Contribution wanted to eliminate cries of injustice and corruption he'd have returned the campaign contributions....

JPD threw themselves under the bus. I wouldn't call them to investigate one of my missing bar stools because some other stuff would probably come up missing. JPD fubar'ed this investigation then they used expired tubes to take her blood at the scene. The medics told them to go get new one's, but the almighty Lt. at the scene (who probably only has a GED) declared the scene sealed and ordered samples taken with the expired tubes which absolutely KILLED the state's case for a DUI manslaughter conviction. Ever wonder why she was never charged with DUI? There you have it!!!

No, a regular everyday citizen would have been charged under the appropriate statute, intended by the legislature, Mississippi's aggravated DUI law.

Just listened again to WJTV reporter's comments after this morning's hearing. Karen Irby's BAC was .09 five hours after she arrived at the hospital but .134 fifteen minutes after arriving at the hospital.

Also, the reporter went on to say after the DA's office investigated the wreck, the speed Karen Irby was driving on Old Canton Road was reduced from over 100 MPH to around70 MPH, because the JPD had no pictures of the skid marks made by the car. Supposely the skid marks help determine the exact speed.

Is the 'investigation' that Judge Green is mentioning must be some sort of pre-sentence investigation that she will have conducted to be used for her sentencing decision. Specific investigation regarding Karen Irby life,prior history, etc.

Since the DA didnt offer sentence recommendation.

District Attorney Robert Shuler Smith said he agreed to the deal partly because the crash investigation by the Jackson Police Department was incomplete.


"The investigators went out five days after the accident. We were surprised that the calculations (of how fast the car was traveling) and the photographs were not there," Smith said. "We asked for a second investigation."


JPD investigators, during the course of the second investigation, changed their estimate of how fast Karen Irby was driving from 110 miles per hour to a minimum of 70 miles per hour.

Irby is 39 years old. If you take the case to trial, the jury will have these options: murder, manslaughter, or acquital. JPD bungled the accident scene reconstruction the first time; JPD used expired blood kits to collect her BAC sample; Hollomon challenged the blood evidence; Judge Green refused to make pretrial rulings on evidence which is rare; and jury trials always have at least some element of litigation risk. The defendant steps up and agrees to plead to manslaughter on both death counts and expose herself to 40 years in prison. the case ends in a conviction with no appeals possible and you get to argue aggravating circumstances and urge the maximum sentence. An experienced and seasoned prosecutor doesn't lightly turn this down under these factors. Hollomon, an experienced criminal defense lawyer and a former federal prosecutor, could have field day with the JPD accident scene investigator; who knows what whacky evidentiary rulings Green comes down with after the trial starts; and then you have the element of the jurors of Hinds County District One who have rendered strange verdicts through the years. To those of us who have actually worked felony criminal courts, this was an obvious deal from day one and a just one.

One need only to look at the pictures of that Mercedes after the crash. It was way worse that the catastophic accident involving Princess Diana. It's surprising that they both survived. 70 mph my foot!

1208 - very much to the point and accurate. As is 1:42. Time for people to quit their speculating and seeing some sinister motives for everything. Cases like this should be dealt with via facts and not wild speculation and jealous/hatred. Its not racial. Its not money. Karen Irby has pled guilty to a lesser charge than was originally charged, just as some 80-90% of the criminal defendants (of any race or social status) in Hinds County has done.

I heard about Peters YEARS before and having been hearing about " money being spread around".

Proof?, not when it's done in cash and over time in increments less than $10000 at a time. And, you can look for extremely fortunate " investments".

Sell your " helper" a share of property at a " bargain" and then get " lucky" with the " sale" and your helper can double or triple his " investment".


There's more money in safety deposit boxes and home safes than there is in bank accounts.

Or how about a nice gift of jewelry or art that the person can either sell or use on their financial statement as an asset to borrow ?

Send your illegal to their house to do the yard and cleaning and repairs.

The closest you'll get to "proof" is to look at the life style and see if it matches up to the known salary of your public officials.

We've had an elected official in Jackson,no longer in office, that never made a 6 figure income in his life, didn't inherit wealth but lived in an expensive neighborhood and had a condo on the Gulf and took GREAT trips every year...something we couldn't do with frugal management on THREE times the salary in a far less expensive abode.

It won't be obvious but look for designer clothes, jewelry, full time help, and vacations among other things. The ladies can sport some $1000 shoes and purses without anyone but another woman ever having a chance to notice.

I've been hearing on the grapevine for two weeks now that lots of money was being spread around.

Let's see if that's true by watching for a LONG time what fun new " toys" turn up for those in a position to be helpful in ways that can be blamed on " incompetence".

And, let's see if the jackass who ok'd the dated blood vials gets demoted or reprimanded or fired. If things are honest in the real world, you get overkill effort in high profile cases, not sloppy.

BS on dated blood vials is great proof as well if a blood test at the hospital is viable.

The facts of this are: Karen Irby has made some terrible choices in her life. Stuart Irby has made terrible choices in his. We all have. It is the consequences of these choices that are sometimes difficult, if not tragic, to deal with. The families of the victims have shown incredible compassion and class by being extremely private in their grief. Karen Irby probably is very remorseful. Her terrible choice will affect many, many lives, forever. I don't care about the Irby's past. That is over. Two wonderful human beings are gone because of Mrs. Irby and somehow, some way, she must deal with this in the years to come. As hard as it is, she must be forgiven. This is a tragic situation for all involved.

It seems Mrs. Irby thinks Judge Green is stupid to think that she had a BAC of .13 or higher after dinner and drinks along with being a hour or so after dinner when the BAC was first taken. It is always best to tell the truth to a Judge.

No one believed Karen when she said she drank two glasses of wine. Two glasses of wine does not give you a BAC of .13 to .14 a hour after drinking. Honestly you have to wonder why her lawyer didn't tell her to say she drank too much and let it go at that. What Karen meant to say was she started her second bottle of wine! Now as to her sentence, my thinking is she deserves at least 20 years behind bars for the violence of the deaths. She literally caused those two young doctors to burn to death. If she gets any less, I am going to know money/property passed hands and so is everyone else, too. You have to wonder now if Karen really thinks marrying drunkard Stuart for his money was worth the beatings she and her child took and now this. It's too bad Stuart can't be locked up, too.

Stuart wasn't driving even though he has the money and paid for her drinks at CCJ. Karen had it well planned on how to get Stuart to marry her. She told people she was going to marry him. Maybe she should have been careful for what she wished for. But, she wanted the money and name. Don't think he is jumping for joy that he married her and didn't just support the baby under different roofs. Wonder if all of his friends who made him feel guilty for getting her pregnant out of wedlock feel good for suggesting it would be best if he married her. For the baby's sake?? Wonder if the baby is better off today? God wants us to honor Him and not put forth evil plots to get money and fame. Look where it got Karen and the baby. The baby is innocent but Karen isn't. She wanted his money so badly that it didn't matter who or what got in her way or what she had to do to get it. Everyone knew her motives and his stupidity.

6:40 You really need to rethink your idea of forgiveness.
If you are " forgiving" people who repeat their bad behavior over and over without regard to the way their behavior affects others, those people are not deserving of your forgiveness. You are setting yourself up to be harmed again and again.
Owning up is the first step, atoning is the second but most importantly, the person must demonstrate they've learned from their mistake and " go and sin no more".
Saying " oops"and " sorry" and showing up at church doesn't do it. It takes changing behavior.

I don't have to forgive Karen. She didn't DO anything to me personally. It's not my forgiveness she should be seeking. It's God's and the people she has harmed.
My responsibility is NOT to accept her back into the community of Christians until she has demonstrated a sincere desire and an effort to change , not through words but by her BEHAVIOR.
If I condone bad behavior, I am as guilty of bad behavior as she is. I am helping it continue.

I believe I heard Karen's lawyer, Mr. Holloman, say on the news last night that Karen had met with the victims' families and tried to explain to them what happened the night of the deaths of their loved ones. He further said something like she hoped her plea would put some closure to this tragic event. If I heard this right, and I think I did, isn't this a good indiction that the civil suit has been settled. Otherwise, she would not be talking to the families.

11:33. We all know drunkard Stuart wasn't behind the wheel that night, but we all know, too, he wasn't entirely innocent in what happened either. First of all he is not man enough to step up and say he was too drunk to drive himself and say he and his wife were physically fighting in the car is why she lost control of the car. No one believes he is that sick considering we have seen him around town driving, know about his travels out of state and attends social functions, and still even goes to the CCJ. Further more, he was asking the President of Belhaven how the enrollment was going and about the baseball team before he even got out of the hospital. If he remembers about the baseball team at Belhaven he still remembers what happened the night before the wreck, too. As to him having to marry Karen, he didn't. If he wasn't going to try to be a good husband and Father, he should not have married her. So as the saying goes, he did it to himself, and she did it to herself, too, thinking his money would be worth the beatings she and her child have had to endure by him. In some ways they deserve the heartache and misery they give each other. However, their children don't. I feel for his adult children. They must be so, so embarassed by their Father's behavior. Still I say, he is as quilty as she is for the deaths of those two young doctors. His money might buy stuff for him, but it will never buy back his reputation. It's shot forever.

Anon, you had a very good and thoughtful comment but there was one sentence I removed but took the liberty of reposting your comment again. The unsubstantiated stuff I took out. I have to be careful. Sometimes I leave what appears to be rumor up when I actually know that commentor is telling the truth so I leave it up.

This is my theory.

God is a forgiving God. He gives us chance after chance to come to Him and repent. If we don't listen, then he pulls his protection and grace from us. Karen Collins Irby is that person that God pulled his protection and grace from. She had no regard for anyone but herself in this whole Stuart Irby relationship.

So what happened here is just God's will. The doctors, who now are with God and at peace, were in the wrong place but now in the right place. Karen will live her life of hell on earth which is God's plan. Maybe it will bring her back to Him in the right way when all is said and done.

He tells us to forgive but we don't forget. True repentance is the only way to win his protections again.

Stuart has been playing with fire for many years. A Deacon in his church while his other life wasn't worthy of that position. God also showed Stuart His will and has turned his life upside down. Effecting his older children and now the young son. Will he learn from this? I guess time will only tell. Again, true repentance is the only way.

I pray that they both grow toward God and change their ways. Karen will most likely get jailhouse religion. Stuart will be at church on Wednesdays and Sundays but will his life change for all of us to see?

God knows and let's hope the community see's also.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Jackson Jambalaya is the home of Trollfest '07. Catch this great event which promises to leave NE Jackson & Fondren in flames. Sonjay Poontang and his band headline the night with a special steel cage, no time limit "loser must leave town" bout between Alan Lange and "Big Cat"Donna Ladd following afterwards. Kamikaze will perform his new song F*** Bush, he's still a _____. Did I mention there was no referee? Dr. Heddy Matthias and Lori Gregory will face off in the undercard dueling with dangling participles and other um, devices. Robbie Bell will perform Her two latest songs: My Best Friends are in the Media and Mama's, Don't Let Your Babies Grow up to be George Bell. Sid Salter of The Clarion-Ledger will host "Pin the Tail on the Trial Lawyer", sponsored by State Farm.

There will be a hugging booth where in exchange for your young son, Frank Melton will give you a loooong hug. Trollfest will have a dunking booth where Muhammed the terrorist will curse you to Allah as you try to hit a target that will drop him into a vat of pig grease. However, in the true spirit of Separate But Equal, Don Imus and someone from NE Jackson will also sit in the dunking booth for an equal amount of time. Tom Head will give a reading for two hours on why he can't figure out who the hell he is. Cliff Cargill will give lessons with his .80 caliber desert eagle, using Frank Melton photos as targets. Tackleberry will be on hand for an autograph session. KIM Waaaaaade will be passing out free titles and deeds to crackhouses formerly owned by The Wood Street Players.
