Just had a thought about the Irby case.

She is under house arrest.

Could that be used as credit for time served? I can see it now, drag the trial out for two years, then get credit. Can it happen?

The number of days spent by a prisoner in incarceration in any municipal or county jail while awaiting trial on a criminal charge, or awaiting an appeal to a higher court upon conviction, shall be applied on any sentence rendered by a court of law or on any sentence finally set after all avenues of appeal are exhausted.

so would that apply to house arrest? Is house arrest considered incarceration?

Not unless her "house" is a municipal or county jail. From what I know about the Irby's house, not likely.

Did you see her driving? My understanding is she still can't walk without assistance, still in therapy, etc. Are you REALLY sure?(!)

OK. Clue me in on something. What's going with the case right now? What will happen next? Does she have to plead guilty to a lessor offense or go to trial within a certain time? Are we talking years not months?

Generally, defendants try to string things out as long as possible. The exception is when you think the prosecutors have a weak case and you want to try it quickly before they have the chance to make the case stronger. The idea behind taking it slow being that the more time that has elapsed since the offense was committed, the less likely that the public, prosecutor, and victims are out for blood.

There's a 270 day rule (and a similar right to a speedy trial) requiring trial within 270 days of indictment but its honored more in the breach.

People don't care if Karen Irby is driving or turning cart wheels on her driveway. It really doesn't matter. What matters is she killed two young doctors drinking and driving. People are waiting for justice for these two people who were just innocently driving down Old Canton Road until Karen Irby crossed two lanes speeding and killed them. She needs to be put in prison for a long time for what she did.

I want to know if she's driving too. And, if so, what is she driving. Or should I just keep a lookout for vehicles traveling 2.5 times the speed limit?

Questions? Do we even know if she still has her driver's license? Could it has been taken away from her since she has not been convicted of a crime yet or charged with DUI? I just wonder considering what she did if she would want to get behind the wheel of a car? I know I would not. Also, could her passport also be taken away? Was it?

Thank you for letting us know she is not driving. It certainly is a relief to many in this area who don't want to share the road with her. The family and their lawyers may be thinking the longer they prolong this the better for her, but I have a news flash for them. It is not going to work. People know what she did and why. She is not going to get out of killing two innocent young doctors who had they not been killed would have spent their lives helping others. No, she is going to jail for a very long time and should.

It appears that the discussion of Mrs. Irby has once again reared it's head. Good for you KF for keeping it topical. The fact is, look to find news archived on CL. It is gone. Look to see the outrage that ensued, it has been quelled by the hands of time. I have watched the news and seen several instances of contradiction with respect to prosecution for similar, or less heinous crimes. The day that Mrs. Irby faces justice will certainly be an interesting one.

A tragedy indeed; may none of us know the depths of tragedy that have and will transpire.

I think that it is terrible that she killed 2 people, but I don't really think that the fact that they were doctors is of any significance. My father, grandfather, husband and brother are all doctors, so I value the medical profession, BUT I think the lives should be regarded with value regardless of their profession. She is guilty, but too much is being made of the profession of the victims. It should be irrelevant. They were victims regardless of their profession. If she had killed two Walmart employees would it be less horrific? I don't think so!! They would also be someone's parent, child, etc. Having said all of those things - and as guilty as I think she is - she ended up here as the result of a string of bad choices - and for that you can feel pity for her children.

People, stop the damn bickering, no one wins here. It is a very sad and unfortunate for all involved especially the children. As far as the articles being gone from the CL site, they are not gone, you simply have to pay for them now if you want them that much. They are archived for purchase after a certain amount of time. Really hated to see all the speculating start again---BY THE WAY SHE IS NOT DRIVING! Really don't think life is as good for her as some of you think it is!

I mentioned in my earlier post that the two individuals Karen Irby killed were doctors. I do think it is an important fact. By drinking and driving she killed two people who would have spent their lives helping others have better health, and therefore, better lives. To me it makes what she did that much more tragic.

I don't think she considered her children when she made any of those choices. I don't think we should rationalize it because of the children. We should just feel pity for the children - not her! It is very sad for the children.

Just the mention of the Irby case, and people just get mad all over again thinking about this woman drinking and driving like Old Canton Road was a race track and killing two people. The family may think with their money and time they are going to be able to get her out of what she did, but it isn't going to happen. The facts are the facts, and she going to prison for a long time.

Oh yes she's driving - to her doctor's appointments. She thinks no one knows, but as neightbors, we know because we've seen it.

Yes, but it's the left side that was injured so she can drive with her right leg and foot. She does use the wheelchair, though, to get around.

KF, IF Karen is driving to and from the doctor( I, too, have heard this from neighbors) and IF , as you described here, her monitoring system is limited to 200 yards, then she isn't under " house arrest" and I want to know how the details of this " monitoring" for which, I , as a taxpayer, am paying. Does she have to provide the court a schedule and time frame for appointments? What is the penalty if she doesn't check in on time? Does she get to go to other things as well...like meet with her attorneys?
Did the court take her passport? Does she still have her driver's license? Was she granted permission to remove her ankle " bracelet" because of physical therapy and so has the means to do so?
IF her monitoring is loosey goosey,the opportunities for abuse are great.
The lack of media curiosity about the details of the conditions of her arrest is shocking to me! IF our judges aren't taking such measures routinely to protect the community in Karen's case OR any others where death has occurred, citizens need to know and demand better protection for the community!
I certainly do not want her on the road!!!!
Just like the day before the tragedy, she is in my opinion still likely to be an " accident" waiting to happen . I hope one of the doctors she's seeing is a SHRINK!
And, I would be equally shocked to learn she is wheelchair bound. KF, ask an ortho to opine on common practice in injuries LIKE this one...not this one...just similar ones. I have reason to suspect the wheelchair is more a sympathy prop than a necessity and her injuries have been exaggerated on advice from counsel. The idea is to present an image of someone already being Divinely punished!

KF, keep hearing that Karen isn't under house arrest at all but " out on bond". Heard she just has to " report in" to whomever is assigned her case.But, generally can come and go as she and her attorneys and whomever is in charge of her feel acceptable. Who told you she had a monitoring system?

If she thinks people feel sorry for her because of her injuries and wheelchair use, she better think again. This is one of those "you did it to yourself all by yourself" situations.

I was in a horrible wreck about ten years ago. It was not my fault thank goodness, but I had serious injuries and didn't work for six months. Afterwards I had to will myself to just get in a car to go to the doctor and didn't want to even think about driving myself for months. I just could not. With her serious injuries plus being totally responsible for killing two innocent people, I am very surprised she would even want to drive. I know she certainly doesn't have to drive herself to appointments, etc. either so that makes her driving that much more puzzling to me.

I'm just amazed by all the people in MS who feel so sorry for her.

Cruel and inhumane treatment, an indictment of depraved heart, I think I would be long gone.

There's something terribly wrong with this ENTIRE story in my opinion.

8:07 you've nailed it! It's the appalling misdirected sympathy that has people so upset ( as well as the obvious " special treatment"). For some of us, our social and religious values would have caused us to expect the sympathy to be directed to the victims and their families rather than the perpetrator.

If all of her injuries are true as you stated above, why are people saying that she's been seen out having dinner with Stuart and another couple, driving to her own Dr appts and vacationing in Fl.

How can she get around to all those places if she's in such bad shape? You say, "that she can barely move her arm or leg."

She can obviously move her arm and leg well enough to do what she wants to do...and if bloggers are seeing her do these things as they have stated in the above blogs and blogs on other sites and they are telling the truth, she appears to be getting around just fine.

As far as you saying how she's in such bad shape, it doesn't appear that way to many of us.

She may have to have a driver due to insurance issues, but she is physically much better off than that of Mark and Lisa.

Most religions believe that it is not our place to judge. Most religions would have sympathy for all involved.

Am I the only person who's SICK of the Irby gossip crap? Until she goes to jail I could give a big flaming rat's ass about all the commenting. But I've finally got to point this out. If I was one of the people who swears up and down they saw her driving, out and about, gets around fine, not being monitored etc.. I would snap a pic of it with my cell and link it here to prove. But that's just how my brain works, if I'm saying something, I'd back it up. Put up or shut up.

Maybe that would finally end all the speculation and gossip and everybody would take a freggin break from 'the Irby show' and turn off the computers. its nice out.

If she was out to dinner with her husband, it was before the monitoring. And, she wouldn't have walked in like the rest of us. Furthermore, it may not have been Karen. It could have been his daughter, his sister-in-law, etc. As far as going to Florida, if she has the resources to go one last time before going through a long, drawn out period and, most likely, jail, what is it your business? If you want to believe everything you read on the internet, especially something written by a blogger, that's your stupidity.
Yes, two people died and that's incredibly sad. But, I'd much rather be in their shoes now than Karen's. For those of you who believe in God and that everything that happens has a purpose (which most people in Jackson seem to do), why does he/she/it allow things like this to happen? It certainly makes me question life.

I saw Karen driving around at the Reservoir this afternoon in a fire engine red convertible. With Elvis riding shotgun. And she didn't have her seat belt on either. But he did.

The sympathy and tolerance for those who commit sins and Scripture quoting seems rather selective these days. Not happening so much for criminals, homosexuals,those with whom we politically disagree,etc., etc., but plenty for Karen. Interesting but confusing.
Why do I think that if a Black homosexual with an Obama sticker on his car had killed Karen and Stuart under the same circumstances, Karen's defenders would be screaming for blood? Oh wait, they wouldn't have to...he'd be UNDER the jail by now.

Are you equating with Obama with black homosexuals? Plenty of white, straight people, including me are Obama supporters. I would have hoped we would be beyond racism and homophobia in this country but I guess I'm wrong. I can think of a few incidences where prominent people in this town were killed by black people-some of whom were never convicted-and I never saw this type of outrage. I don't even remember this level of outrage in the Bell case.

Ok. We have to have a few lawyers who comment here. How does a her defense lawyers defend her or get the charges reduced? She was seen drinking at the CCJ. Her blood test showed was was legally drunk. Witness say she was driving at a high rate of speed on Old Canton Road, and it's a fact she crossed two lanes of traffic and hit a truck on the other side of the road head-on which caused two people to literally burn to death. So, what does her lawyer say really happened on Old Canton Road to explain these two people's tragic deaths that will convince the DA to reduce her charges or convince a jury it was really not her fault?

It was the hypocrisy as those I know personally who are sympathetic to Karen are very judgmental about Jackson crime and criminals, Obama, homosexuals, liberals,but quote " judge not..." when it comes to Karen or her " sins". I'm pointing out ethical inconsistency as well. They seem to have different standards that depend on social status and yes, race. It's way past time to look in a mirror for a change...
I'm still STUNNED you'd prefer death to a future that Karen will have of seeing her children grow up,a chance to atone and be a better person and to start anew. She has an opportunity to turn her life around and be a better person. If it's the physical pain, well I know personally you can live a rich life anyway and think of our wounded soldiers who for centuries have done just that.
I don't understand this attitude at all!

When I made my comment about prefering death, I wasn't thinking about her children as I don't have children. It was obviously a remark made too hastily. I wasn't talking about the physical pain. That's manageable. I, personally, could not spend the rest of my life in jail. I don't have that much to read and I'm not willing to be anyone's bitch. What good are you to your children if you're behind bars? And, everyone forgets about you. If jail wasn't in the future, I would choose life. And, I would spend the rest of my life helping others.

I wonder also, if she is really under house arrest, as she has not had a trial as of yet (if ever with this system)or if she is just checking in every week or whenever?
This is so frustrating and can go on for what is it 270 days!!
Good ole system of innocence until proven quilty, this makes me sick for the two families and I just hope and pray justice is done! I do not believe these 2 families will let this slip by, I surely hope they won't.

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox.
