The Desoto Shuffle

 File this under things that make you go hmmm.  James "Jimbo" Fischer is supposed to have a hearing this morning in Desoto County Justice Court on his June arrest for alleged careless driving and disorderly conduct.   The word "supposed" is used because prosecutors jerked Fischer back and forth over the hearing.  

Fischer posted yesterday on the "Trooper Jason Young Watchdog Group" Facebook page: 

I just got home from a meeting with my lawyer.
Both prosecutors have recused themselves from my case and they are looking to bring in a special prosecutor.
No court Friday. I repeat.
No court Friday.
Stay tuned!

However, the Coldwater resident posted this morning: 

I got a last minute text last night and was informed to be in court in the morning. I don't know what's going on but I'll be there at 8:30. I've also been told that the sheriff's department is on high alert for today and they are expecting a lot of arrest. I do not expect that will happen because my friends aren't pucking stupid. I will update later today. Thanks yall.

Update (10:15 AM): The case was continued.  The Court is seeking a special prosecutor and special judge. 

Synopsis

A little feud between MHP Trooper Jason Young and Fischer began on March 5 when Fischer turned around on Highway 301 before passing through a roadblock in Desoto County.  A woman notified the troopers of his u-turn so Young took off in hot pursuit.  It is not known if he was eating a Diablo sammich.  Young administered a preliminary PBT test three times but the results did not show Fischer was legally drunk.  Young cited him for improper lane usage and careless driving while impounding his vehicle.  Earlier, more thorough post with court file and complete video.


Fischer submitted a complaint to MHP.  Captain Gerald Cooper replied his trooper followed the guidelines and was within his rights to ticket Fischer and impound his vehicle.  

To say Fischer was not pleased with his treatment is an understatement.  The aggrieved defendant created a Facebook page dedicated to Trooper Young and posted his gripes about his experience at the roadblock.  

The posts apparently got under the trooper's skin because Young went out looking for Fischer on one bright day in June.  Young's dashcam video recording him speaking on his cellphone to a woman about Fischer as he cruised Highway 301.  

The trooper said "I'm going to see this motherfucker today because he posted something on his Facebook and I saw the damn truck with a little bullbar in the front.  As he spoke those final words, none other than James Fischer approached from the opposite direction.  Young promptly executed a u-turn and took off in hot pursuit.  Both stops took place when Fischer was driving home from work. 

Young quickly tracked down his quarry and pulled him over. He asked for Fischer's driver's license and insurance.  He said he was driving 55 mph in a 45 mph zone.

An outraged Fischer said "I'll see you in a few weeks, punk" and flipped off Trooper Young as he drove off.  Trooper Young couldn't have none of  that so he turned on his siren and took off after Fischer yet again.   



Trooper Young ordered Fischer to get out of the vehicle.  Fischer complied. Trooper Young handcuffed Fischer and arrested him for disorderly conduct and careless driving.  The trooper said Fischer's taking his hand off the wheel justified the careless driving charge.  Trooper Young impounded Fischer's truck again.

So Fisher and his attorney had to show up in court, just so the judge and prosecutors could recuse themselves and continue the case?

What a complete waste of their time/money for Fisher and his counsel. I think that says a lot about the nature of that particular court.

Reminder that the MHP can literally execute you on the side of the road of any empty, rural highway. They can proceed make up whatever excuses/case they want against you. And your survivors could waste thousands of dollars in fees and never clear your name!

This particular situation only proves what I, and many others, say. The supposed giving of citations system is about revenue collection, not safety.

If it was about safety, there would be no need for anyone to recluse themselves. No one in that greedy bloodsucking little circle wants to offend their roadside revenue collector.

All the good tough Troopers quit after the hazing incident a few years ago. Many of the current guys on the road got the golden ticket and think they’re untouchable.

12:32 - glad to hear the law has been rewritten in the last few days. Didn't know that until I read your insightful analysis.

Prior to this week, the 'revenue' from MHP citations went to the county, not to MHP or to the State. But based on what I've learned from your comment, I guess now we should be expecting to be cited more often if MHP or the State would receive the fines.

Thanks for informing us so we will be more careful in our driving.

What in the world are they afraid of?

And by the way, you folks at the Highway Patrol better get rid of this asshole trooper if you want this to go away.

It remains a fact that an MHP officer cannot ticket you for that which he does not witness. Somebody said he turned around, it was impossible for the officer to witness that due to terraine and distance. That will come out in court testimony from a third party expert.

If some fat ass jurdge finds that this young man is guilty, I'd take that sombatch all the way up the line. Embarrass them all.

Where the hell is Reeves' appointee that heads this agency who should have fired this officer and shit-canned this whole bag of charges with an apology.

"Did you witness my client turning around in order to avoid a road block?"

"I sho did!"

"What would you say if I told you I am prepared to present expert witness testimony that proves you could not have witnessed that from your physical location?"

"I reckon I might could be wrong, but I'm pretty sho that's what he did".

Here, let me help you understand. Who do the judges, and the prosecutors work for? The correct answer is the county. That little circle of greed, the judges, the prosecutors, the clerks all work for the county, and are the recipients of the revenue collected by the trooper.

The actual fine may be $50, with the cost of court being $200, with the cost of court, helping to pay the county employees salaries. The last thing the county employees want is to piss off their roadside revenue collector, he may quit collecting that revenue in their county.

That's why you are having the supposed arbitrators of justice, hahaha I can't type that with a straight face, recluse themselves. It's amazing that when you go into a courtroom, the judge, the prosecutor, the law enforcement officer, and your lawyer all work for the court. But, it's fair.

1) Only in tenth-grade driver-education in the sixties was 'both hands on the wheel at 10 and 2' required.

2) Most of us know the Constitution's first amendment protects our free speech against the heavy hand of government. Most of us know law enforcement is a division of government. Most of us know shooting the bird at a policeman is protected free speech.

3) ALL of us know that when this farce is dismissed in court and the Agency Head sweeps it under the rug, saying 'it's been dismissed', and this officer is not fired...the new director, appointed by Reeves is not any better than the last one. He only uses more Grecian Formula.

ThAt letter clearing the trooper referred to the first ticket, not the second and third ones. He testified in Court he saw him turn around in the middle of the road and undoubtedly told his superiors that as well.

This is a loser for the MHP. This state is very pro-blue line. The MHP should guard that credibility. Once lost, credibility is very difficult to regain.

Dismiss the charges. Suspend the patrolman. If any such matter occurs again in the next five years, sack the patrolman.

What difference does it make what he said in court or told his supervisor? He lied. And the court bought it.

Apparently, the boy had nobody there with enough sense to challenge that testimony. Clearly, as has been stated in the page created by the boy and others, there is no way in hell the officer could have seen that from a distance of over half a mile with a hill blocking his vision. Absence of reasonable cause is always an appropriate defense.

And the officer made no effort to hop in his car and engage pursuit until a third party told the officer somebody had turned around back there in the road half a mile or more away.

Had he seen what he claims he saw, he would not have been standing there in the road for the third party to tell him that. I don't think you can support your contention, Kingfish.

The problem with this whole situation, the Trooper can make up what ever he wants to ticket individuals for whatever he feels like and then the individual has to spend several thousand dollars to fight the ticket or pay a fine. Driving to close to the center line, speeding, reckless driving. Follow someone long enough and they can find a reason because we all make mistakes driving. Because it is "Guilty until proven innocent" in traffic court you will spend thousands fighting to prove your innocent. A guy like this needs to be fired with prejudice because what is to stop him from making even worse charges against someone that he takes a disliking to such as planting evidence AKA Zachary Wester of florida. This Trooper decided to use his position to target someone and the MHP and MDPS appears to not give a (Censored).

I cant imagine choosing this as the case that you want to stand on, but I hope it this hill is worth dying on for the rest of the troopers.

Any shred of respect that scantly remained for your profession is almost gone.

If you watch the video on the FB page or YouTube you'll see that this trooper stalked this man hunted for him found him and then in the end arrested him for exercising his first amendment right bc his pride was hurt bc Jimbo was mean to him. This is disgusting for a civil servant to treat a citizen like this and then to go to court and lie about it while making up charges to scare Jimbo into taking down his page. If this was a legit stop made by the trooper and he's in the right. Then why on earth have two judges and two prosecutors recused themselves. Disgusting.
