If at first you get caught making things up, make them up again. Such is how Carlos the Clown practices law. Grenada attorney Carlos Moore got caught fabricating again in a wrongful death lawsuit against the Oxford Police Department.
Oxford police officer Matthew Kinne murdered his mistress in May 2019. The married father of two pleaded guilty in July 2021 and is serving a life sentence in prison. The late Dominique Clayton's family filed a wrongful death action against Kinne, the city of Oxford, and Oxford Police Chief Jeff McCutchen in August 2021. Moore represented the plaintiffs.
The complaint alleged Kinne killed his first wife or she committed suicide :
Plaintiff is informed and believes, and Theron alleges that during Defendant Officer Kinne's employment with his former employer, Defendant Kinne's then-wife died of from suspicious circumstances.
12. Plaintiff is informed and believes, and thereon alleges that, initially Defendant Officer Kinne was identified as a person of interest in the death of his then-wife.
13. Plaintiff is informed and believes, and thereon alleges that, ultimately, it was determined that Defendant Officer Kinne's then-wife died of "suicide."
14. Plaintiff is informed and believes, and thereon alleges that, although Defendant Officer Kinne was not formally charged with the murder of his then-wife, the law enforcement agency who employed Defendant Officer Kinne conducted an internal investigation, and informed Kinnes that based upon their findings if he did not resign, his employment with this law enforcement agency would be terminated.
The complaint accuses Oxford of hiring Kinne despite knowing the "suspicious death" of Kinne's wife.
There is just one problem. The ex-wife is very much alive. Mr. Moore used one of his infamous rhetorical devices.* U.S. District Judge Glen Davidson had plenty to say about Carlos the Clown's fiction:
The Municipal Defendants showed that Defendant Kinne’s former wife, Amy Michelle Kinne, was alive on August 6, 2020, when she signed an Affidavit and Petition for Modification of Custody and Tax Deduction Status, over a year after Defendant Kinne murdered the Decedent [28-2; 28-3]. To the best of the Court’s knowledge, the said former wife is alive today. Regardless, since there was no suspicious death of Kinne’s former wife prior to the murder, there could not be any similarities between this fictional event and the real-world murder of the Decedent. Thus, since the “suspicious death” of Defendant Kinne’s former wife did not actually happen, the Municipal Defendants could not have been aware of it and therefore could not have had knowledge that Defendant Kinne would commit murder.
Moore and his Krewe of Clowns filed a response that "argued that there was an unspecified woman who died prior to the murder and with whose death Defendant Kinne had been involved." Um, Yeah. The Court was not persuaded by the new accusations.
Moore, make that the plaintiffs, also accused Chief McCutchen of hiring Kinne:
Defendants Chief McCutchen and the City authorized the hiring of Defendant Officer Kinne.
There is just one problem. The Chief was not the Chief when Oxford PD hired Kinne, a fact easily discoverable by Moore if he had actually made the least of all efforts. The plaintiffs eventually conceded Chief McCutchen did not hire Moore.
Judge Davidson dismissed Chief McCutchen and the city, leaving a $2 million verdict standing against the incarcerated Kinne.
Mr. Moore got his judgment, now he gets to collect it.
Kingfish note: Carlos the Clown gets caught yet again. Will Oxford ask for sanctions? Will the city file a bar complaint against Moore? See below as the list of fines and sanctions against the Clown is getting longer.
* The Mississippi Workers Comp Commission sanctioned him for $500 in 2017 for throwing a tantrum at a hearing. Earlier post.
* The Mississippi Court of Appeals ordered Carlos Moore to pay sanctions of $27,467 after he failed to appear in court for a trial because he had a "speaking engagement" in Texas. Earlier post.
* Mississippi Bar reprimanded him in 2020 for ignoring an assignment of a Client's funds and providing the funds to the client. Earlier post.
* Federal judge in North Mississippi sanctioned Moore for $3,000 in 2017 for fabricating statements, memos, and not responding to discovery.
* U.S. District Judge Carlton Reeves sanctioned Moore $500 in the Belhaven case after he found Moore's client destroyed evidence in 2017. Earlier post.
* The Tennessee Bar censured the Grenada attorney in 2019 after he placed a lien on a client because she rejected a settlement offer he recommended. Earlier post.
* The estate of Kendrick Murry sued him (pro se) in September 2020 in Forrest County Circuit Court for alleged legal malpractice of a case. Earlier post. However, the lawsuit has not been prosecuted since the initial filing of the complaint. Mr. Moore has not been served with the lawsuit.

The reality is that there simply isn’t enough racism by whites against blacks or anyone else to to justify the existence of racial special interests. Another reality is that whites suffer far more racist abuse from blacks and other racists that never gets reported by the MSM. This doesn’t fit any official MSM or political narrative so it is ignored. Possibly because whites have a negative history of banding together and TPTB never want whites to feel any sort of “defensive” ethnic unity. There are plenty of websites which track black violence and racism against whites. And there are plenty of websites that track racism and antisemitism hoaxes. Not all of them are run by white supremacists. They are quite informative and eye opening to what why this nation is really so divided. It’s like a mass delusional stockholm sybdrome.
The state bar is obviously constituted of bigger clowns that think this is tolerable. The legal profession in MS is a circus because of their inaction.
Evidently no one appreciates a “creative” attorney
I really don't blame him.
Its like a kid that keeps stealing cookies and Mom sees it, but does nothing.
Why stop if there are no consequences?
Mississippi Bar? Hello? Nope, seems like the lights are one and nobody's home.
Carlos understands that most people reading here and no judges sanctioning him put any bread on his table but there are plenty of desperate irrational malcontents in this state who want to make a buck. They couldn't care less about his record or tactics and he couldn't either. Just keep fishing and one day he'll hook the big one. Then he'll be rich and famous. Watch out Crump!
As far as the Mississippi Bar is concerned, the Clown is untouchable.
Better call Saul.
The Mississippi Bar is in effective by choice. Does anyone know if he paid the Appeals Court fine?
"As far as the Mississippi Bar is concerned, the Clown is untouchable." Which one is truly the clown act?
Isn't Carlos some kind of judge somewhere? I can't really believe that I asked that question.
The Bar and the Supreme Court apparently protect these guys. Dennis Sweet lost a $10million verdict on appeal because he perjured himself in front of the trial judge. Denis is apparently doing just fine practicing law.
No wonder the people don't trust lawyers.
Hey, 12:48, Sweetness is still kicking ass wherever he gets in front of a jury.
Moore added another "fact changer" to the firm lately: the law student (now lawyer) that tried to run for House but didn't actually live in the district, Keveon Taylor. I guess the law and facts don't matter to the Insane Clown Posse!
You don't have to look much further than a few posts below this one to find out how horrible the legal profession is in Mississippi. This is just a microcosm to the whole United States.
I would think that Carlos should be engaged as an independent mediator for the city of Jackson garbage dispute.
Carlos is absolutely spoiled by his ability to effectively blame his own incompetence on long standing systemic racism. It plays so well to the liberals outside Mississippi that he might even achieve hero status if he screws up enough. It even plays to some of his nitwit client victims here
in Mississippi until he makes a fool of himself.
Really.

There's an Aristocrats joke in there somewhere.
1:52, Bullshit. This guy is an extreme outlier, which is why he is newsworthy. His time is coming.
Spend some time living and criticizing the government in Russia, or China, Saudi Arabia . . . , then come back and tell us who terrible the U.S. is. You couldn't even publish the comment you wrote without going to prison.
There lived a crooked man, who made a crooked deal. He kept a crooked cane, and his catch in crooked creel. He stole a crooked child, who cried a crooked squeal. And that crooked little man was broken on the wheel.
"You couldn't even publish the comment you wrote without going to prison."
You should turn and face the future, neighbor, that's the road we are on, and it isn't far ahead.
What does it take to discipline him? It takes bar complaints and attorneys filing motions for sanctions against him. The Courts are starting to hammer him - when asked to do so. Let's see if Oxford does it. Nah, Tannehill is too weak.
