Fitch Certifies Trigger Law

 Attorney General Lynn Fitch issued the following statement. 

This morning, in accordance with the provisions governing Section 41-41-45 of the Mississippi Code, Attorney General Lynn Fitch published the required certification to Mississippi’s Administrative Bulletin for what is known as the State’s trigger law.

“Mississippi’s laws to promote life are solid and thanks to the Court’s clear and strong opinion in Dobbs v. Jackson Women’s Health Organization, they can now go into effect,” said Attorney General Lynn Fitch. “As we have said throughout this case, Roe v. Wade presented a false choice between a woman’s future and her child’s life. As we proceed in this post-Roe world, the people of Mississippi and of all the states will be able to fully engage in the work of both empowering women and promoting life. I am grateful that the Court has given us this opportunity.”

Under Mississippi’s trigger law, Attorney General Lynn Fitch is required to publish her determination (1) that the United States Supreme Court has overruled the decision of Roe v. Wade and (2) that it is reasonably probable that Mississippi’s trigger law would be upheld by the Court as constitutional.

“The Supreme Court very clearly held in Dobbs that the appropriate standard for courts to use for challenges to state abortion laws is rational-basis review,” continued General Fitch. “And under that standard, Mississippi’s regulations for the protection of life would be upheld. We argued before the Court in December that it was time to end special rules for abortion cases, and we are pleased that the Court did just that, returning this important issue to the people to decide through the political process.”

Specifically, the Court stated the following:

“Under our precedents, rational-basis review is the appropriate standard for … challenges [to state abortion regulations]. … It follows that the States may regulate abortion for legitimate reasons, and when such regulations are challenged under the Constitution, courts cannot ‘substitute their social and economic beliefs for the judgment of legislative bodies.’ … A law regulating abortion, like other health and welfare laws, is entitled to a ‘strong presumption of validity.’ ... It must be sustained if there is a rational basis on which the legislature could have thought that it would serve legitimate state interests. … These legitimate interests include respect for and preservation of prenatal life at all stages of development … ; the protection of maternal health and safety; the elimination of particularly gruesome or barbaric medical procedures; the preservation of the integrity of the medical profession; the mitigation of fetal pain; and the prevention of discrimination on the basis of race, sex, or disability.” (Pages 77-78 of the opinion of the Supreme Court)

Kingfish note: Apparently our Speaker of the House opposes any exceptions for incest. Mississippi's abortion law does not have such an exception and thanks to the Speaker, it will not be created any time soon.  Good job, Mr. Gunn (sarcasm).

Start with Pro-Choice Miss. v. Fordice, 716 So. 2d 645 (Miss. 1998) and work your way forward.

Since life now begins at fertilization, which DA or other law enforcement body will be the first to investigate doctors and their nurses for a "miscarriage"? Will the findings of the local cop's interpretation of medical records suffice enough for an indictment, or will another layer of bureaucracy be needed to review a woman's medical records after being discharged from the hospital?

If, as Mississippi law now states, a baby in the womb is a human life, then that life should be protected. Doesn’t matter the circumstances of conception – horrific or otherwise. Obviously everyone is against rape and incest, but if those horrific acts result in a human life, we must protect life.

To any resident of Mississippi that is under 25 years old

make plans to leave this place as soon as possible, and never look back. There are greener pastures elsewhere.

This state is one complete shit show.

I came here when I was 19 years old, 31 years later it's only gotten worse.

The citizens elect terrible people from the local level to the state legislature, all the way up to state-wide office, and they do the dumbest shit year in and year out.

He won't forgive you for the motherless children that aren't lucky enough to find a grandmother or stepmother who has a big enough heart.

So who will be paying for all of this? Assuming the majority of abortions are among the uninsured...we had 3600 abortions in 2020 in this state. The average cost of a delivery is about $20K + dr visits, etc.....The state prepared to drop a cool $100M into their budget? I'm guessing not.

Who is "We"? Which lawyer(s) actually made the oral argument before the US Sup Ct on behalf of the State of MS? Who wrote the appellate briefs for State of MS? Who did the legal work on this case in the trial court?
What role(s) did AG Fitch personally perform in this case?

Our nation was founded on, amongst other things, the principal that church and state should be kept separate. Defining when a fertilized egg, embryo, fetus, or whatever becomes a person is perhaps one of the hardest issues to unravel from religious beliefs. The judicial system is not the venue for making this determination. This is an issue that must be resolved by Congress. Either our nation recognizes that we separate church and state and therefore follow what the scientific majority agree is an acceptable period for an abortion, and specifically codify or amend the constitution to state when a potential child becomes a human and is granted the right to life under our Constitution, or we let the states or judicial system handle it and continually fight about the issue as they cannot separate abortion from church and state. Congress must either codify specific abortion rights or amend the constitution to define when a our nations rights attach to a mass of growing cells. Instead they will most likely revert to tinkering with interstate commerce law and Medicaid requirements, while the Supreme Court reviews prior case law on which Roe was built, which is a waste of time as the decisions are sound and Roe is the anomaly, and blue and red states will continue to argue because they are both collectively ignorant. That’s my inflated 50 cents, God bless America or stay the hell out of it whatever floats your boat.

Of course, it is science driving the positions on things like COVID vaccines and climate change. If science classifies that cytoplasm contained in a drop of water on Mars is life, then certainly, a human fetus should be treated the same.

Oh I forgot, you avoid children of color by hiding in your gated country club neighborhoods, send your kids to 99% white private schools and preach to them to not date or marry black people. These unwanted black babies will now populate your white communities, burden your tax sytems since YOU will not take care of them and possibly impregnate your innocent offspring. Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox.
