Richard's Disposal Says it Spent More than $1 Million

 Richard's Disposal said it spent more than one million dollars preparing to take over Jackson's garbage collection on April 1.  

Richard's Disposal owner Alvin Richard, Jr. stated in an affidavit filed in Hinds County Chancery Court last night in Lumumba v. Jackson City Council

a.   Leased trucks to collect waste, photographs of which are attached as Exhibit 5 to this First Supplemental Affidavit.

b.   Employed workers to collect waste and said workers went on payroll beginning on March 14, 2022, for orientation, training, and performing preliminary work to start collecting waste on April 1, 2022.

c.   Purchased equipment to use in the collection of waste including, but not limited to, the
following:

1.          Collection Containers

11.         Fuel Tank And Fuel

iii.        Uniforms And Safety Equipment For Workers 

1v.        Radios For Trucks And Employees

v.         Office Facility

17. Richard's purchased all insurance coverages required by the Emergency Agreement with the City
of Jackson, Exhibit 5 to my Original Affidavit.

18. In addition to purchasing all of the above items, the Executive, Management, and Administrative  Level Employees of Richard's have spent more than One Thousand (1,000) hours to be prepared to begin waste collection on April 1, 2022.

19. To date, Richard's has spent at least One Million Dollars ($1,000,000.00) to b prepared to begin waste collection on April 1, 2022, pursuant to the Emergency Agreement with the City of Jackson, Exhibit 5 to my Original Affidavit. Further, Richard's is obligated for at least another Three Million Dollars ($3,000,000.00)  to carry out the Emergency  Agreement,


 

 While Mr. Richard extolled the amount of money he spent on the contract, Mayor Lumumba asked the Court to reconsider its approval of the motions to intervene filed by Waste Management and Richard's Disposal yesterday. The Mayor merely repeated the same arguments he made last week opposing intervention.  

Tonight should be interesting.  Stay tuned.

So, this company borrowed money, bought equipment, hired workers,etc. before they had a valid contract and it is the population of Jackson who are libel for these expenditures.

No, what they did is make up mobilization costs, brought some of their already existing trucks up here to make it look like they are actually incurring some costs. If I were a judge, I would verify the VIN#'s on the trucks brought up here vs the trucks in the alleged lease agreement first, before proceeding, to see if they were telling the truth. They are going to try and fleece the City of Jackson into paying for their mobilization if they don't get the contract or use the "we are already geared up" line as leverage to have the contract given to them.

I bet if you dig deep enough, the workers, the building lease, etc all have ties to friends or already in place. ie, workers already employed, and lease made up from a friend and not actually in place. Can anyone verify how many people from Jackson have been hired and been to training? I bet if you dig deep enough, none of this has taken place. Like stated above, there is no solid contract. No half assed decent business person would take that gamble with the uncertainty that has surrounded this debacle.

People keep harping on training. How much training does it take to hold on the side of a truck moving at 5 miles per hour, jump off, pick up and dump a trash can, throw the trash can down as loud and as hard as you can, and do it all again? It might help getting employed if you have an extensive criminal record.

According to record, financial responsibility by Jackson to RD for start up costs was in the unauthorized emergency proposal upon which 'authority' boy mayor signed a "Notice To Proceed" letter to RD.

When Jackson City Council refuses to pay, RD will have to sue and Lumumba should be held personally liable.

If Lil Choke says he can't make decisions without Council's minutes, why did he sign Notice To Proceed?

11:14 more than you think. It has to do with workplace safety. Traffic, driving, lifting without hurting your back, visibility, hydration, etc. Most workers comp companies make some form of safety training mandatory for this type of business and have it documented.

The law is very clear that a contract not approved and spread on the minutes is not a legally binding contract. Furthermore, it is the responsibility of the person/entity contracting with the governmental entity to make sure its contract is approved and spread on the minutes before proceeding.

There is no claim by Richard's here.

@12:20 PM is absolutely correct. It's called the board minutes rule, and if the agreement is not approved by the board and the material terms spread upon its minutes, there is no binding agreement. Richard's could make a claim or file a lawsuit but they will lose.

THe RFP and Emergency Contract are HAULING agreements ONLY. Jackson has a seperate disposal contract with WM (previously with Republic Services.) Whichever company is awarded the hauling contract must take the garbage to the WM landfill. Jackson pays 100% of the disposal fees.

It is shocking that WM is fighting the hauling contract in court. It is very hard for a company with HUGE amounts of overhead to make anything off a hauling only contract. Disposal contracts are where the REAL money is at.

Now, since WM owns the landfill or controls it, how long do you think the “equipment “ will operate without having a complete breakdown which will shut access off? I mean, the equipment CAN breakdown and therefore they can refuse any trucks to dump the cornbread and pig ears from last night. Jus sayin

I honestly don't think the city will survive another 3 years of him. Every basic city service is now failing and he is doing his damnedest to make sure it gets worse, and quickly.

Um, how does WM make money off its landfill? Why would it refuse to accept RD deliveries?

Is there anything to suggest RD is not qualified? Might have crappy service if based off Yelp reviews in New Orleans but not qualified?

Why WOULDN’t they make money off the landfill? Should they let them use it for free? Crappy service is the same as Not Qualified. If they aren’t doing their job correctly and not training personnel to perform the work properly then they are not qualified. Why should we give them a pass when the most qualified company was performing the work? I go through this constantly with low bidder crap on public work. No one cares about the most qualified all they want is cheap cheap cheap and cheap and it comes back to bite you every time! In this case the taxpayers will get the shaft.

Landfills are cash cows. There is a minimum fixed cost to operate. The landfill owner needs X amount of tons to cover all of the costs. Every ton over and above that about goes straight to the bottom line. There are no additional costs to take more tonnage. Disposal contracts are the best of the best for making money. The downside is massive upfront investments and permitting headaches. You don't need drivers, trucks, etc to operate a landfill. Trash companies use hauling contract (most have small margins) to feed the beast (aka the landfill.)

I lived in the area where this guy had the garage contract. All I’ll say is Jackson you are in for a mess. He had that contract in La taken away because of how bad the service was. I can’t believe Jackson would even be entertaining a contract with him.

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox.
