Vance: There was no lead detective.

Hinds County District Attorney Robert Shuler Smith blamed JPD for the reason why Nicholas Coats was not indicted in the murder of Chelsie Kirschten.  Coats was arrested and charged with murder and shooting into an occupied vehicle in her death but he was released from jail on January 10.  Judge Bill Skinner's  October bond order stated that he should be released after January 2 if he had not been indicted.  WLBT reported:


Hinds County DA Robert Shuler Smith said one reason for the delay in the Coats case stemmed from a JPD issue.

"The lead detective [on the case] has recently returned from suspension over a personnel matter," Smith said. "Our office needs to meet with the detective to determine if these issues have been resolved and discuss going forward. We certainly need his testimony."

It's unclear when the DA's office will be able to move forward with Coats' indictment.

Smith said his office objects to the practice of setting deadlines for indictments.

"In these cases, they should not summarily dismiss someone or let them out of jail," Smith said. Rest of article.



Kingsnake note: Not so fast, Mr. D.A.  The Kingsnake spoke to former JPD Chief Lee Vance Wednesday night after the District Attorney made his comments.  Chief Vance said there was no lead detective on the case.  Several detectives worked the case.  Any of them could have testified to the grand jury. 

In other words, the D.A. once again tried to create a smoke screen.

Does anybody know the constitutional provision the learned district attorney relies upon? It seems to me that the suspect went before a Court of competent jurisdiction and denied bond with the condition that he be indicted within a 90 day period. If that order was unconstitutional, shouldn't the district attorney have challenged the constitutional basis of that order in October when the Court entered it?

The best lawyers in the Hinds County Courthouse are housed at the Office of the Public Defender. That's the bottom line.

Replacing all of Shamsiddeen, Green, Kidd, and RSS with people of reasonable competence and fairness would do more for Jackson than any economic development or anything else for that matter.

The only entity that can convene a grand jury and ask for an indictment is the prosecuting attorney. Believe it or not, police officers cannot get their wet paper bag indictments on their own. This is 100% the fault of Robert S. Smith who is too busy readying himself for January 29 than working in his own office.

That said, JPD is at fault for not appointing someone in charge of those cases dealt with by the suspended detective.

As I wrote, there was NO lead detective on this case. There were several of them and all they would do anyway is go before the grand jury and read a report.

There are so many people to blame for this that it is very hard to list them all.
The result is that a dangerous man has been released to prey on innocent people.
The only hope people have is some innocent victim will have to use deadly force to protect themselves from this scum. Then there is a good chance they will be behind bars.
Maybe some other scum will take care of this before he does any more harm.
Sad when the people have to look for some other scum to protect them from the scum who are being released to commit even more crimes.

Hinds County needs a DA. Robert Smith is barely functioning as a human being much less as an attorney - whether because of mental problems or drugs I do not know. But Hinds deserves much better than this.

I think we all forgot to thank George Soros' Open Society Foundation for making this joke DA. RSS is just doing what his money master told him to do...to set off the powder keg that is MS. Every DA placed in their office by Soros is only there to create more racial strife and division to ultimately cause a breakdown of the country. George Soros is playing a real life game of Risk with our world and we're letting him get away with it.

This probably is the DA's fault, however Vance needs to admit that since a retirement a few years ago and a detective murdered a few years ago, there are no competent robbery/homicide detectives because they lack the necessary experience. Every ID case is assigned to a "lead" detective in almost every police organization. Plenty of blame to spread around.

Also, Senior Circuit Judge schedules and orders the grand juries...

If this guy was arrested and then held, then JPD did their job. The ball was in the DA's office and the DA denies any responsibility. Keep publishing these facts. Maybe, somehow, the low-information voter will hear about their bad choice. Elections have consequences. Murderers running free and people like Mr. Percy are dead.

Jackson, get a grip and elect some honorable people.

Here is the funny part of Smith's comment to me. In the case against Wayne Parish, the DA's office apparently never discussed the case with the JPD. The JPD ruled it a justifiable shooting and had the the signed statement of one of the two eye witnesses, a signed statement of the JPD officer who interviewed the other eye witness and a security video to support it. However, instead of going to the grand jury with a JPD detective, they took a Hinds County Deputy detective, even though JPD had jurisdiction. At Parish's arraignment, Smith himself stood there and stated that he had just learned that there was a security video. So why is that now he needs a "lead detective". Did not need it in Parish's case. But then again, I guess Carlos Smith need the indictment to support his law suit.
This not speculation by the way. I have copies of all the police reports, Tox report and depositions.

Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear.
