Judge Kidd will hear arguments today on the temporary restraining ordered he issued June 28 against enactment of the new "open carry" law. HB2 author Andy Gipson (R-The Wild West) sent these thoughts about the legal scrum to JJ and gave permission to use them:
1) "Unconstitutionally vague." House Bill 2 defined concealed as: "hidden or obscured from common observation." Moreover, examples are given as to what is not concealed such as carried in a holster open to common observation. HOW IS THIS VAGUE TO ANY COMMON SENSE PERSON???
2) "Overbroad." House Bill 2 narrowly defined the word "concealed" to ascribe to it a meaning that can be understood by most people. If you can seesomeon has a gun, it's not "concealed." If you can't see a gun, it is "concealed." IF ANYTHING THE LEGISLATURE GAVE THE TERM "CONCEALED" A NARROW DEFINITION, NOT A BROAD DEFINITION. HOW CAN THIS BE UNCONSTITUTIONAL???
3) "Arbitrary and Capricious." This is where it gets most interesting. The complaint alleges that the definition "is arbitrary and capricious in excusing persons who wish to openly-carry firearms from the license requirements imposed on persons who wish to carry concealed firearms." TRANSLATION: HINDS COUNTY OFFICIALS WANT TO REQUIRE GUN LICENSING AND REGISTRATION OF ALL GUNS BEING CARRIED BY MISSISSIPPIANS. THIS IS THE SAME LINE OF THINKING BEING PUSHED IN WASHINGTON D.C. AND NEW YORK CITY, RIGHT HERE IN OUR OWN BACKYARD."
Saw this sign suddenly posted at a local business today. Feel free to send me pics and names of businesses that started posting signs in the last week.

What business posted the sign?
This macho open carry red meat crap is silly ....
11:47am
It's all crap. 50% of Jackson/Hinds County will still be carrying regardless of the law. Laws don't stop criminals.
Gun folks brought this on themselves. It was already legal, but the politicos wanted to score some points by passing some unnecessary clarifications. Now there will be "no firearms" signs all over town, regardless of what the judge rules.
Hops and Habanas in madison posted a sign. They've lost my business until it comes down.
Gun folks brought this on themselves.
Your ignorance as to what triggered the HB2 response is duly noted.
(1) I don't feel safe in Hinds County without a gun.
(2) There are already too many guns in Hinds County, carried illegally by lawbreakers.
(3) Without a gun, I won't be doing any business inside the boundaries of Hinds County.
(4) Businesses that post these "Guns prohibited" signs in Hinds County is creating a further deterrent from doing business with the citizens of the surrounding counties.
(5) I'm not for or against the open carry law (I see both sides of it), but I am tired of people believing that they can choose to violate my constitutional rights that too many people died for.
(6) The open carry law will not help or hurt the problems plaguing Hinds County (Jackson in particular). The law will not create the Wild Wild West. . .the wannabe thugs in Jackson with their guns created the Wild Wild West in Jackson several years ago. Until the wannabe thugs have their guns removed, Jackson will continue to be a problem.
12:53....who else can you blame all of these new "no guns allowed" signs on? A lot of licensed concealed carriers will now have to decide between trespassing or taking off their gun or going somewhere else. Should have left well enough alone. And by the way, not sure where 12:33 is going to buy his beer now, I bet by the end of summer every retail store in the area will have the same sign.
"Hops and Habanas in madison posted a sign. They've lost my business until it comes down."
See, the sign is already having good effects. What business do *you* operate, Gun Boy, where you want people walking in with firearms?
(Tho the sign seems a bit contradictory: how about my shotgun?)
You don't have the right to carry your gun into my home or office if I don't want you to. Its my home or office. Quit sermonizing to us ignorant masses. We can do without your business and your spit cup. I'm all for defending my home with my gun and will defend your right to do so also, but quit getting Ernest T so stirred up
Why would anyone serious about carrying a firearm want to open carry?
I'm not gonna be shopping in any store that allows its patrons to carry guns inside.
I can think of few businesses that want people that are carrying a gun on their hip. I can think of a couple that wouldn't care: biker bar and rough juke joints. For those that say they won't patronize businesses with a "no guns" sign, you'll be eating at home or out of a paper bag a lot; having cocktails on your own patio, and buying your clothes out of the trunk of a car on a parking lot. Stupid bravado statements without a lot of substance.
Typical liberal BS from 11:47. Gays can get married, but if I want to marry my gun and take her around in public with me, I have to get a permit. Welcome to Obama's America.

Life as usual for them!
Stupid bravado statements without a lot of substance.
Seems to sum up the hyperbole in your own statement quite well.
As per my understanding we have Jim Hood to thank for this fiasco. He's the one who said the concealed arty law was vague and asked the legislature for a definition.
Methinks Dante that sometimes it is better to leave the challenged like 1:18 PM in the dark.
They do less harm with their uninformed opinions that way.
What business posted the sign Kingfish?
Please don't randomly refer and then duck away from disclosure.
our conservative "leaders" are to blame for all of the signs, not Hood. Blatant grab for votes from the hillbilly crowd backfired on them. That they never anticipated the backlash shows how incompetent they really are.
July 8, 2013 at 7:34 PM = clueless as to the facts
Hey clueless at 8:14. The FACTS are you hick ass my way or the highway BOZOS have stolen the party of Reagan (who couldn't get elected today on a bet) and assured our party is toast for a long long tie, if not forever. Congratulations right wingnuts.
The FACTS are you hick ass
8:30 go back to school, and learn some grammar.
If the party of Reagan has been stolen then the it is only because the RINOs turned it to shit.
Reagan fits today's definition of RINO perfectly. You short sighted tin hat ultra right wingers turned the party to shit. You will never admit it, but you did. Thank you. We moderate Democrats are grateful.
Keep up the good work, suckers.
Andy Gibson is a PERFECT example of your collective stupidity.
"moderate Democrats" = oxymoron
Hey 7:23 Reagan was a moderate.
2013 "moderate Republicans" = oxymoron
Yeah 9:06, and also why we can't win on a national level, but WTF.
We still elect candidates whose mantra is "I am a bigger Bubba than he is", while the whistles by the graveyard get louder and louder.
Looks like the trolls have arrived for their daily squat.
Sorry 9:44 trolls equal truth. What have the trolls said that is not the painful truth?
Sorry 9:44 trolls equal truth.
Trolls equal trolls. Get thee back to Fondren.
Gipson is a creepy weirdo. That is all.
Repeating: rubes like Andy Gibson and the rest of the red meat, tin foil hat wingnuts will continue to win the rule of the day here in Hicksville Mississippi, but are 100% WRONG on a national stage.
Revel in your small country battles you win, while the war is whipping your small minded asses.
Damn 2:47. You have beaten the bigots into submission....or lack thereof. Cat got their acid tongues.
Don't feed the trolls.
7:22. Trolls 7. Rednecks 0.
They are trolls because you have no answers to the troll's logic. Fess up redneck.
YAWN ... ZZZZZzzzzzzz
Hey liquored up11:01 PM. Answer the questions. You are stumped, not asleep. I win.
Looks like the playing field has been leveled here a bit lately....
Yes it has and I love it. Point out to the backwoods pinheads how shortsighted they are. Keep winning these local "Bubba Battles", and losing the prize.
Reagan's assurance that 80% of something is better than 100% of nothing is LOST on these wingnuts.
Well I can see on this thread the reason I will always carry, concealed or otherwise...
I love it. Crickets from the right wingnuts.
Sometimes it is better to remain silent and be thought a fool than speak and remove all doubt one is a liberal...
Moderate not liberal. Remember that term? Can you spell Reagan?
Please read above saga of Mr. Fowler.
I would be for open carry if a permit to do so required an IQ of 100,passing a hair folicle test for drug use and testing within the normal range on the MMPI. Passing an eye exam and hearing test would be nice , too.
I wish those requirements were also required to run for public office.
So, we are going to have people who barely made it out of high school, who abuse drugs or alcohol, who can't see or hear well, who are neurotic or crazy able to openly carry if they have yet to have a record at Whitfield or with their local police ( of course,( sealed juvenile records will mean the some policeman might know but can't do a thing about it).
And, of course, all those Haley pardoned can openly carry.
I expect those openly carrying will also have tiny feet.
