Court, JPD returns gun used in kidnapping to Robbie Bell

Update: Called Chancery Clerk's office. No power of attorney for George Bell, III or Robbie Bell is on file.

One sickening feature of the Heather Spencer murder is found near the end of the police report for the murder of Heather Spencer posted earlier this week on this website. JPD returned the gun George Bell, III used to kidnap Heather's roommate to his mother, Robbie Bell. Ms. Bell showed up at JPD with a cute little court order decreed on April 9, 2008 "the personal property taken into evidence from the home of Robbie Bell, the holder of the durable power of attorney of George Bell, III, shall be released and returned to Robbie Bell." Copy of court order and police report on return of firearms. Ms. Bell wasted no time in getting the guns back as JPD released them to her on the same day.

The fact that Ms. Bell was able to get the gun used to kidnap and threaten others returned to her is an outrage. If a gun is used in the commission of a felony, it should be forfeited unless the owner charges the person using the gun with theft. There is no way JPD should be able to legally return the .38 special used to kidnap Heather's roommate to Ms. Bell and is yet one more example of how justice continues to be abused in this case.

From everything you've provided for review JPD was certainly less than thorough in their investigation AND it appears their reputation for being less than precise was leveraged by Robbie Bell's attorneys.

For instance, Robbie Bell released almost immediately after being taken into custody. No indication that any phone records were reviewed. Robbie Bell allowed to avoid providing any statements.

Harvey Johnson did the right think by nixing the First 48 gig. From what we can see from this murder I'm not seeing much in the way of excellence from JPD.

That;s exactly what I was thinking about the First 48 TV series being canceled here - the JPD, the DA, and the AG are all disgraces. National humiliation would be wasted on those incapable of being embarrassed by their pathetic job performance though.

Actually KF, the gun used to do the kidnapping was the same one used during the standoff, correct me if I'm wrong.

That means, that that gun was not found or entered into evidence from her residence and was not part of the court order.

That gun was from the car at the B.P. gas station.

If this is all true and correct based on the legal wording of the Court Order, then how legal would it be for her to have obtained it that way and to still have it?

Less than thorough? You are being generous. From my reading I've got some serious concerns about the ability of JPD to critically think in addition to what you note -- especially about the phone records.

For instance they didn't "recover" Heather's car until the 14th and only after Royals called to give them "permission". WTF? Meaning the car that George used to drive to Heather's house post-murder and the car he used to conduct the kidnapping sat in Robbie Bell's driveway unsecured for 3 days after the murder. And who the hell is Royals to convey permission? Who put the keys under the mat and who put Heather's purse in the trunk?

JPD didn't return to Heather's home, an integral location in the investigation, until the 15th and once they arrive discover that there is evidence there. Anybody see a problem with that? I mean, they waited 4 days to re-interview Heather's roommate the kidnap victim?

JPD bumbles along asking to interview Robbie Bell on the 20th only to get blown off by her attorneys. But wait a minute? Robbie was arrested on charges. How was she allowed to refuse and interview? Then on the 25th they still don't get the interview despite, as they related to Robbie Bell's attorneys, having more insight into the timeline and the fact that Robbie Bell was there a long, long time with Heather, ALIVE AND DECEASED, both in the presence of George and while he was out conducting the kidnapping after asking the kidnap victim for oral sex.

I also think it is important to understand how extensively JPD initially interviewed Heather's roommate outside of the immediate presence of James Bell because, from the police report and assuming JPD is capable of thinking critically, she (Heather's roommate) provided the police with enough information to question Robbie Bell's actions at least sufficiently to either not immediately release her and/or not to allow 14 plus days to elapse without demanding that she (Robbie Bell) provide them with an interview/statement. Did JPD interview the roommate and kidnap victim right there in front of George's attorney (James Bell) who DID NOT CLAIM PRIVILEGE AS ROBBIE BELL'S ATTORNEY? If so there is something seriously wrong there.

From all appearances JPD bought the story line from the outset that Robbie Bell was a hostage. They released her and when they figured out there was more to the story they let Robbie Bell's attorneys fudge and stall. JPD NEVER got a interview/statement from Robbie Bell. Anybody see a problem there? From the record it appears they stopped trying.

Isn't it obvious what was happening? The wheels were moving quickly behind the scenes to get George to plead guilty in order to whitewash and take any critical investigation away from Robbie Bell's own actions those fateful hours. Presto, change-o George is going away for life and the charges against Robbie are dropped.

One other question, did Heather's roommate file kidnapping or assault charges against George III? If not, why not?

We don't know if it was the same gun. The gun used to kidnap the roommate was a .38 special.

Check out the WLBT story of this week that KF linked below. @ 1:43 is a picture of Robbie Bell and Royals talking alongside, and with, a JPD officer. Now who called Royals to the scene at the BP station?

The standoff was four hours long. She had plenty of time to call him and get him there.

There is also the fact that Melton got involved in this case. He tried to lean on those he knew in the media to leave the story alone and he also leaned hard on JPD to make this case go away. Melton told the police not to let him turn himself in until he got there. Frank couldn't resist. Sources have also told me Danks was involved. It makes Steffey's comments laughable last night.

KF, the .38 SPL and 4 live cartridges was processed at 3:19 p.m. along with the suspects wallet and cell phone.

According to police report: "At approximately 3:15 p.m. George Bell III put down the revolver and was taken into custody..."

The other evidence taken from the home was from 12:19 though 1:30 p.m.

Could it be possible then, KF? ;)

The above post assumes the gun was taken from Robbie Bell's home and that JPD didn't make yet ANOTHER clerical error on this case.

So Conway Twitty says there is no law in Mississippi not to report a felony. Are there any laws that require citizens to come to the aid of a dying person?

While she has done an outstanding reporting job I sure wish Monica had asked Conway why he claimed that Heather was strangled.

I emailed a link to your blog along with a short history of the Spencer murder and the Bell conspiracy to Chris Hansen at Dateline -- there's a place on the Dateline website where you can submit story ideas.

I know Chris Hansen is the guy who does the creepy stories for Dateline -- "To Catch a Predator" and the like -- but I figured that more people would see it if it were on Dateline, which actually gets pretty good ratings.

The court order specifically stated from the residence, correct?

The PD Statement or whatever from April 9, 2008 stated a Hinds County Circuit Order granting the release of the firearms recovered under the above case number.

Was there another court order specifically relating to he case number?

Might be dumb questions.

And the court order for the return of personal property was granted prior to the AG and DA making a public statement of dismissing the criminal charges against Robbie Bell on or around March 25, 2008.

Based on dates etc. Does this happen all the time?

There is no POA on file, she showed up with the paperwork apparently. The Chancery Clerk's office and a couple of attorneys told me they had to be filed in order to be valid. That is why I just posted none were filed and didn't mention the validity issue.

I didn't discover this site until after the guilty plea and I'm one of those who had had social contact with Robbie and felt sorry for a mother with a drug crazed child who might have been in shock and fear of her son. I found it hard to reconcile the person I knew with the charges brought. I was willing to give her the benefit of the doubt while feeling the demands of Heather's family for an accounting of Robbie's action reasonable and just.

I am now disabused of doubt and terribly upset that a community that claims Christian morality, lacks appropriate outrage and empathy, and seems to find ways both officially and socially to protect or excuse the perpetrators of such egregious behavior. The truth is being sacrificed by a community that proclaims truth each Sunday.

3:05 That's not the way it's always been everywhere in this Nation, but agree it seems so now. Once upon a time, money could not buy social acceptance. That's why the Kennedys and Lodges didn't run in the same circles.

Once upon a time women who had behaved immorally weren't accepted into the company or homes of reputable women. As a girl, I was not allowed to have social contact ( unfairly in many cases) even with the children of those with poor character.

There use to be a social price for such terrible conduct. And, in the South, family and character were once everything as no one had money after the Civil War save the carpetbaggers and traitors to the Cause.

The thinking was" how could one trust or feel secure with a person who would go to such lengths for self-interest or personal gain?"

What has happened to the notion that one should try to make amends and demonstrate a committment to change before one can be accepted back into the fold? The Bible is quite clear on this as well. There is no " instant" forgiveness without a change of heart...God can know that change is real but we can't save by seeing proof.

8:40 thanks for the kind words,as save for this site, I feel I've fallen into the Looking Glass . I'm sorry to say I only hear excuses or a deafening silence on this or the Irby case so your post and this site are reassuring.

If Robbie got home at 8pm and the time of death was 3am,even if Heather couldn't have been saved, her family could have held her warm hand and she could have died in loving arms and with comfort.

KF, "sickening" is the only word I can conjure up as well but this is beyond sickening.

Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time.
