Justice won yesterday in Desoto County as a MHP trooper's vendetta against a citizen came to naught. Special Justice Court Judge dismissed speeding, careless driving, and of course, disorderly conduct charges against James "Jimbo" Fischer in Desoto County Justice Court yesterday.
Young ticketed Fischer and impounded his vehicle at a previous traffic stop. Fischer created a Facebook page dedicated to the um, dedicated trooper. Trooper Young didn't take too kindly to the attention and said he was going out looking for poor Jimbo. He found him and proceeded to arrest him for the charges mentioned above (See the synopsis and video of arrest posted below).
The Justice Court Judge and Desoto County prosecutor recused themselves from the case. Lee County Justice Court Judge Chuck Hopkins presided over the hearing yesterday. Fischer announced on Facebook:
Just got out of court. Not guilty on careless driving. Not guilty on disorderly conduct and dismissed the speeding ticket. Judge Hopkins from Lee County did the right thing. He saw through all the bull shit.
Fischer said he learned in court yesterday Trooper Young cited him for the felony version of disorderly conduct. Apparently such a felony exists. See Section 3 of the statute linked.
Oddly enough, there is no arrest report for Fischer's arrest. Yours truly filed a public records request with the Mississippi Highway Patrol for the arrest report but MHP said no such report was on file.
Synopsis
A little feud between MHP Trooper Jason Young and Fischer began on March 5 when Fischer turned around on Highway 301 before passing through a roadblock in Desoto County. A woman notified the troopers of his u-turn so Young took off in hot pursuit. It is not known if he was eating a Diablo sammich. Young administered a preliminary PBT test three times but the results did not show Fischer was legally drunk. Young cited him for improper lane usage and careless driving while impounding his vehicle. Earlier, more thorough post with court file and complete video.
Fischer submitted a complaint to MHP. Captain Gerald Cooper replied his trooper followed the guidelines and was within his rights to ticket Fischer and impound his vehicle.
To say Fischer was not pleased with his treatment is an understatement. The aggrieved defendant created a Facebook page dedicated to Trooper Young and posted his gripes about his experience at the roadblock.
The posts apparently got under the trooper's skin because Young went out looking for Fischer on one bright day in June. Young's dashcam video recording him speaking on his cellphone to a woman about Fischer as he cruised Highway 301.
The trooper said "I'm going to see this motherfucker today because he posted something on his Facebook and I saw the damn truck with a little bullbar in the front. As he spoke those final words, none other than James Fischer approached from the opposite direction. Young promptly executed a u-turn and took off in hot pursuit. Both stops took place when Fischer was driving home from work.
Young quickly tracked down his quarry and pulled him over. He asked for Fischer's driver's license and insurance. He said he was driving 55 mph in a 45 mph zone.
An outraged Fischer said "I'll see you in a few weeks, punk" and flipped off Trooper Young as he drove off. Trooper Young couldn't have none of that so he turned on his siren and took off after Fischer yet again.
Trooper Young ordered Fischer to get out of the vehicle. Fischer complied. Trooper Young handcuffed Fischer and arrested him for disorderly conduct and careless driving. The trooper said Fischer's taking his hand off the wheel justified the careless driving charge. Trooper Young impounded Fischer's truck again.

I'm conflicted here.....if you do a u'y before a roadblock, you're drunk or have a warrant out AND if you are disrespectful to the LEO, I file that under f'ing around and finding out. That being said, the officer should not have been out looking for him.

The trooper has since been transferred from E Troop to C Troop. That’s how MHP disciplines Troopers… just move them to a different district where they will have the same issues.

1. The driver made a u-turn because he got a call from a family member who needed help.
2. He was not drunk, nor had warrants.
3. “Disrespect” is protected by the first amendment, most especially when directed at authorities (redress of grievances).
Cop here was a sensitive snowflake who abused his authority.
Jimbo is due any court costs and fines, plus impound-related expenses (rental car, lost wages, etc.); as well as the trooper's badge.
Isn't Troop C who patrols Hinds, Madison, Rankin, and Yazoo Counties? Maybe a few more? Look for more trouble from him locally if so. He's going to give that little young one in Yazoo county a run for his money.

Cooper? He said it was all OK, which means legal. What happens to him? Guess what? Nothing of course. Just like Trooper Young.

Kingfish: I've followed this for months, since its inception. What you leave out is the fact that the trooper said he 'saw Jimbo turn around in the road and head the other way to avoid the roadblock'. However, it was proven that the trooper could NOT have seen him since a hill was between them. The trooper later said a woman told him 'somebody had done a uturn in the road' so the trooper took off in pursuit.
The trooper is obviously an arrogant, unfit SOB who has no business on our roadways in a police vehicle harassing the public he is sworn to protect.
Although this trooper has been suspended for months, it will be a stain on the department and our state if he is allowed to continue to pull duty in this or any other LEO job.
The more you know about any branch of DPS the less respect you have for them. They are all arrogant people who think that they are above the law. None gets punishment unless they piss their leadership off.

the other day I told a Trooper thank you for your service, and the response I got was very cold look.
Meanwhile, over the weekend a cop (now an ex cop) in Clarksdale shot (in the back) and killed a young man who the cop said had broken into his house and had run out the front door when the cop came home. Turns out the cop's daughter had a romantic relationship with the (once alive) yoot and let him in the house.
What percentage of these dickwads thinks they are above the law and are not to be questioned?
This is really stupid of the MHP not to fire this guy. In times when LEOs are unfairly attacked, such "protections" only turn people who support LEOs against them.
For example, I used to be impressed if someone worked for the FBI. These days someone who works for the FBI is viewed with great suspicion if not distain.
How many other people are sitting in jail right now for various charges because this trooper lied? What about them? They didn’t have the resources to fight back so they are rotting in jail. Usually this site is a bunch of folks who don’t believe cops lie or that they cheat etc. Just because someone’s picture is in the news doesn’t mean they are guilty.

Granted, this trooper was not one of the 'finest'. Probably should not be a trooper.
But your hero in this story is also not one I would want to claim as my 'hero' as you have done for months now.
A roadstop is up ahead, so what does your 'hero' do but turn around and avoid it. Hmmmm. I would have to ask why, but of course (due to the over zealous trooper, you don't bother to do) and ask why he didn't just go through, show his DL, etc and go home.
Not defending LEOs that want to show their badge and their bravado, but I'm not about to say this was justice either without a little more info on the facts. At this point, nothing on JJ has bothered to present those.
10:31, if you did ask why this guy turned around (if he did), you got your answer — both in this post and in just about every other post about this story. And further, the trooper in question got his answer that it wasn’t about a warrant or driving under the influence. There are a sufficient number of facts here for someone willing to read what KF has written. Moreover, there are a lot of LE that don’t want this guy around. One of the problems with state employment is this trooper can’t just be fired quickly and without ceremony. Private employers are free to minimize the risk to their company by firing someone. Public employers have to minimize the risk of firing someone “unjustly” rather than looking out for the agency.

Whether the young man turned around within sight of the road block or without knowing it was ahead, is irrelevant.
Law enforcement is (apparently) within its rights to take out after someone it assumes is avoiding the roadblock. However, as is posted above, there is no 'avoidance' law in this state.
If I choose to pull over, turn around or take the next left, that's my right. Pursue me if you wish. I am under no obligation to proceed to the point of the checkpoint - only to stop and follow directions once I arrive.

This small man with a badge has soured my feelings toward the MHP. The MHP Super Duper Trooper used his badge to target an individual all because he took a disliking to him over a facebook post and his bosses did nothing other than transfer him when the heat started to climb. This does not give me warm fuzzies about the MHP. I'm not one of the Defund the police never have been and never will be. I want accountability, but I am beginning to wonder if we will ever have any accountability. Jimbo's redress appears to be that the taxpayer gets hosed and the Super Duper Trooper et al to go about their merry way. We have a problem with some in law enforcement, take the tasing until death in the article above. We also have a new Super Duper Trooper named Bell that appears to have arrested a man because the man threw a ticket in his glove box in front of him. Roid Rage anyone????? We have a Super duper trooper that killed a neighbor’s dog, another that allegedly beat his wife. Sean Tindell needs to use this event to do a lot of house cleaning. How many people are currently in jail because of small men like Super Duper Trooper Young. I want to think this is the exception to the rule, but I wonder.

This agency is as corrupt as it gets. Colonel Ginn and Colonel Sanders both have done many corrupt things but hide behind religion and their appointed status. They promote those who can’t pass test and ignore their own general orders and deny those who have passed if they are not yes men that do what THEY want. If you are a yes man in the agency you get what you want. If you are not a yes man you are plague and pushed to the side. It does not matter if you can be an effective leader or a great leader. Bottom line the politics of the patrol trump everything. They claim they are the “Best of the Best” what a joke. You will never be the best when you have absolutely no hiring standard. E31 brandished a gun on an individual before he was hired but charges were dropped so he’s good to hire. Background investigations are ignored because prospects are buddies of upper brass of MHP and senators that want them hired. Gerald Cooper has ignored many warnings about Bell, Young and Lee. However they are part of his crew and are protected. I mean why is anyone surprised this agency is absolutely out of control with no standards. Constitutional rights are not an option. You will be held to do what they tell you to do or face the wrath of the agency.

However, evidence presented at trial included the roadblock incident which contributed, in great part, to the trooper's attitude and vindictive approach to his job.
I'm looking forward to a civil trial. This whole matter is much, much larger than simply dismissing a traffic ticket. This victim should be compensated.

I heard Ginn on the radio yesterday talking about a trooper class. He talked about how many applicants they'd have for a class, how many would be selected, how many would enroll and how many would not pass.
Are they this damned hard up for troopers that this guy is the best of the best? Is his attitude, racism and psychological misfiring not apparent during training class?
