Trash Talk: Mayor Says Stay Put

There is not much to report about Jackson Mayor Chokwe Antar Lumumba's two lawsuits against the City Council today.  Attorney Samuel Begley filed a notice of appearance in the Hinds County Circuit Court lawsuit.  However, the Mayor opposed dismissing several City Council members from the Chancery Court lawsuit.  

City Council members Virgi Lindsey, Bryan Grizzell, and Angelique Lee asked the Chancellor to dismiss them from Lumumba v. Jackson City Council.  They have consistently voted to award a garbage contract (RFP or Emergency basis) to Richard's Disposal, thus they are in agreement with the Mayor.  

However, Mayor Lumumba filed a response to their motion to dismiss today.  He said he has not sued them individually nor did he name them as defendants.  The lawsuit was filed against the City Council as an entity because the City Council: 

Council can  not  take  any  action  through  its  individual  members,  and  its  authority  can only  be executed by a vote within a legally called meeting.  See Miss. Code Ann. §21-8-13(4).

5.    Therefore, since the Mayor did not file an action against members of the City Council in  their  personal  and  individual  capacities,  it  is  impossible  to  dismiss  non-existent individual defendants.

Okay, I have seen thirteen lawyers names associated with this stuff. They all inflate their egos buy charging at Least $200.00 an hour, some considerably more. I am assuming these Attys. are billing at least 50 hours each. Not that they worked that long, but that is what they billed. That is least $130,000.00 that our city has absolutely wasted, but made some lawyers happy. Has the sewer been fixed? Can we drink the water?

At one time, The mayor had a chance for a Biden position. But acting like a fool over garbage has certainly ended that dream.

@5:32 - is it your assumption that all the lawyers are being paid for by the City? I would think that at least the two with Richards, and the couple with WM are being paid for by those companies.

There is the Mayor's, the city attorney and all her staff, and the Council's --- two, one for each for the two suits.

But you are assuming that the Mayor gives a damn about spending our tax dollars - its not his money but it is his ego. And, he is a trial lawyer himself, believes in this kind of foolishness.

Ok, the simple legal issues. What’s the problem and what should have happened

First, the failure of the city council to prepare and approve its minutes is a BIG PROBLEM. The law is very clear council speaks only through its minutes and if there are no minutes since 9/21 they have not spoken!!! This is a serious issue not only for this contract but any action they took without minutes. This could mean personal liability and/or “other” cupability. I cannot imagine the City Attorney not jumping up and down about this.

Second, the Mayor presented a contract for approval (like it or not), city council should have approved or disapproved on its “minutes”, then the Mayor would have to veto if they disapproved if he wanted the contract as is, then city council would have to override the veto by super majority (2/3s) vote spread on the “minutes”. If city council did not override mayor veto, then the contract would have been approved. With no minutes mayor’s lawsuit to mandamus council to prepare minutes is valid action although serious question whether you can do so after the fact (in my opinion you can as long as action was actually taken).

If city council overrode the mayor’s veto then mayor had two options appeal that to circuit court as being arbitrary and capricious or contrary to law, OR he goes back to renegotiate contract to satisfy the city council’s objections or proceeds to the next bidder to negotiate a contract with them (Waste Management) until city council accepts or cannot override his veto.

This is not difficult law and makes common sense to boot!! Anyway my 2 cents with some experience in this area. Yes I am a lawyer, but not involved except as an observer of Hinds County and City of Jackson. Yall make our area look sane!!!

I would hazard the guess that if the Democrats get the butt-whuppin' they have earned in November there will be little appetite among the survivors to appoint this arrogant, Marxist fool to much of anything. The main thing to be concerned is whether this fool will replace Bennie Thompson. For reasons I do not understand, Chockwe II is not likely to be turned out of office and may well get "promoted". We can only hope that the longer this trash fight goes on the greater the possibility that Chockwe's real reasons will be disclosed. That is probably the only way to end this fool's political career.

Then why didnt Ladumbo just veto the council’s no vote, then see if they had the 5 votes to override his veto(they dont).
Could it be that the mayor-Ladumbo-can not veto a “No” vote by the council?

Because city council did not take action and spared on their minutes, therefore there is nothing to veto. The law is very clear the city council can only speak through its minutes. They can vote all day long but if no minutes are prepared of the vote or action spread on minutes its means nothing.

Mayor’s suit to mandamus or compel them to prepare minutes has merit, but the other suit has no merit.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.
