And the "bombshell" drops

JJ is very suspect of so-called bombshells that suddenly appear right before a big election.  It is no secret Kimberly Bracey is suing Jackson Mayor Tony Yarber for sexual harassment. JJ broke the original story about the lawsuit last year.  Speculation ran rampant during the last few weeks that something would be filed right before the election and guess what? Something was. JJ was not going to report this new development in the lawsuit until May 3.  However, the news media is covering it and the Mayor issued a statement so here is the coverage.

Ms. Bracey is the former executive assistant of Mayor Yarber.  She filed a motion to compel last week.  Ms. Bracey asked the court to order the Mayor to submit a DNA sample to a local laboratory.  Her motion to compel also asked for other documents such as cellphone records.   The plaintiff claims Mayor Yarber did not respond to these requests.  Her attorney, Nick Norris, made these charges in his affidavit attached to the motion (p.9 posted below).

Right before an election.  It is a rather sensational claim and one guaranteed to be covered by the media.  This is the kind of bomb opponents fantasize about during an election.  The Mayor is screwed either way.  If he doesn't answer, he is hiding something.  If the samples match, he is toast.  If it doesn't match, it doesn't matter because the election is over anyway.  Mayor Yarber did issue a statement this afternoon: 

Mayor Yarber was responsible for responding to a set of interrogatories in conjunction with the Bracey case. Although delayed, Mayor Yarber’s responses have been submitted. Included in this were requests that ranged from submission of cell phone records to insurance policies and other documents. Also, a request for a DNA sample was made; but contingent upon a mutual agreement between both parties for a specific date and time.  That time has not yet been agreed upon.   
Mayor Yarber has and will continue to cooperate in an effort to prove that Mrs. Bracey’s constitutional nor civil rights were violated.  “It is unfortunate, but not surprising, that as our campaign builds momentum and gains more support that political gamesmanship would rear its ugly, divisive head. This less than two weeks before Jackson voters go to the polls. Although the timing is unfortunate and highly questionable, I am confident that Jackson won’t be distracted by the same petty political games we saw in the recent presidential election.”

Yes, the Yarbers are still married. I really wonder what kind of person would save DNA evidence; it makes me sick to think she was plotting from the get-go IF her story is true. That has become a big "IF" now. Is Ms. Bracey still married?

If you read the pleadings you will see they have tried getting the DNA since last year and had to file a Motion to Compel-meaning they had to MAKE HIM respond to discovery. She didn't hold onto the evdience, Yarber tried to ignore evrything until after the election-PERIOD! This could have not gone public-ONCE AGAIN- if he had complied! He should just be accountable!!!

I hate to say it, but you are quite correct. I had high hopes for Yarber, but all one needs to do is look at the sewer situation and the lack of permanent action. That North Street post from a few days ago is a perfect picture of the state of urban decay in this city. He inherited a mess, but has not made it any better.

7:29, You are forgetting The former Lumumba who was elected almost 4 years ago. Yarber has only been in 3 years. I know Monica L. saved the blue dress, but she was 19 and unmarried. Linda T. was raped. That is different from consensual sex. When two married persons commit adultery, I in no way connect it to rape. BUT, who says it wasn't consensual, IF it happened?

Take a look at the field running for mayor. Which one are you certain for sure, has not committed adultery? I would say "only one" and he is not ready to be mayor. None of these men can give Jackson experience. None have even been on the City Council. One was associated with JPD. Ask a current officer of the law if that is who they want. Elect him if you want to see the crime rate go back up. (We are down in crime considerably.)

One wants to follow in his father's footsteps. Ask any Jackson voter, except his father's followers, if that is who they want. One serves our citizens already in another capacity and is reaching retirement age. Can he furnish any longivity?

Jackson needs to keep someone in office long enough know how to accomplish and Yarber has learned how. The Governor just signed into being the Capitol Improvement District, The 1% commission is just now finishing a turf war, Briarwood and Mill Street are going under construction. Unemployment in Jackson is 4.3% -- This is lower than the State's unemployment rate.

I really don't care what the full story of Bracey vs. Yarber is as long as it doesn't involve force. I do care how the budget is balanced (mandated by law) and how we proceed on leveraging the 1% infrastructure dollars.

What in the world is the "sewer situation"? Do you mean the six year old consent decree? Do you mean the West Rankin pull out? I know of no new sewer problems -- some have even been eliminated. West Rankin Utility District has been pushing for 20 years to build their own plant. Don't you remember the ten year ago cry of "Stokes will control our development" if we keep letting them process our sewage? We have a Rankin County Governor who received major donations from the people involved in the West Rankin Utility District -- look for a reason there.

We have far worse problems with Siemen's Fiasco which was way before the Yarber Administration.

The newspaper and Mrs. Pittman and at least one major Mayoral candidate have obviously never been able to distinguish between wastewater and water, LOL.

The only thing that can save the City of Jackson is GENTRIFICATION!!!!!!!! The city needs money for infrastructure, transportation, housing, and etc. Unlike the majority of its residents, the city cannot depend on HUD or any federal government agencies for the rest of its life!!!! Jackson needs homeowners not renters, upper middle class and upper class residents not poor, low/moderate income residents!!! Jackson needs private investors and developers not the public, government-dependent type "developers" you have in Jackson today. Until Jackson gets a shit load of monies from increased property/ land values and businesses via gentrification, the poor city is screwed!!! It doesn't matter who the damn mayor is.

Hipsters and homosexuals, both of whom are drawn to communities that they can frequent and help to grow. Fondren is the closest thing either of these groups have to latch onto.

Nowhere else offers anything - not even fertile ground for those who wish to start the process.

Can't blame it on racism anymore. Lots of blacks have moved into the suburbs and bedroom communities. They don't want to deal with "the sewer situation" (you KNOW what that is, dumbass) anymore than whites do, and if you ask black residents of wards other than 3 about Kenny, they roll their eyes. They don't like him either.

So what's left? An opportunist who promises to build a "human rights city". Get ready for Baby Chok.

Keep someone in office long enough to "know how to accomplish"?? Surely you jest. Mayor of this City is not for an on-the-job training. Yarber proved himself incapable early on, and despite your giving him credit for everything that you cite, factual or not, is ridiculous.

Yarber had little, if anything, toward the signing f the CCID. It would have been signed last year if not for Yarber's temper tantrum toward the end of the session. But Yarber, along with the Council, have shown the state government enough that they made sure they could not get their sticky fingers on this state money. They wanted results, not drawn out contracting processes designed to help the Mayor's contributors.

Obviously you know nothing about the 1% Commission. Your calling it a 'turf war' unmasks your true identity. Great news about Briarwood,but you have a problem with your claim about Mill. Yarber tried to waste $3 million on North Mill, but thanks to the County and the state, the city's money is now being spent on the real problem. Yarber's lack of leadership just made sure that it is three years later than it should be.

And if you believe the real unemployment rate in Jackson is as you claim then your understanding of the world is really disjointed. But whatever it is, any jobs that have been created other than by direct employment at City Hall or in the private strip clubs is not the result of Yarber. Disagree? Cite anything that Yarber has done in the way of economic development within the city that would have contributed to lowering the unemployment rate.

4:07 could not be any more wrong - nobody will sink a dime into Jackson unless they are assured that there will be mature, stable and experienced leadership at the helm. The roads are like goat trails, crime is rampant, the education enterprise is a joke and every elected official has his hand out whenever it looks like a developer shows interest. Doing business with the city is like doing business with Venezuela.

I appreciate your enthusiasm (so many exclamation points!), however misguided it is...

Tell ya what - you go first, convince a group of investors that Jackson is a good risk, buy some property downtown and "gentrify" away!!!!!!

So, 8:03, are you calling Ted Duckworth a nobody? How about Cathead? Not saying Yarber did these, but they certainly have invested in Jackson. What about the investors in the Westin? All foolish? Jackson is improving in spite of our naysayers and the damage done by the Siemens's rape. Jackson is recovering in spite of some really bad past leadership. Jackson is recovering in spite of crumbling infrastructure. It didn't crumble overnight and it won't get repaired overnight No mayor can make that happen. Of the field running, it will either be Yarber or Lumumba. So, I suggest you wake up and smell the coffee.

9:59, Jackson cannot succeed if there isn't rational, predictable and responsible leadership in the Mayor's office. The infrastructure issue should have been addressed long ago with a strategic, preventative maintenance program - instead of chasing geysers - the city should have been prioritizing projects by age, usage and risk. I notice you never addressed the crime and corruption issues, Jackson is known in economic development circles as a pay-to-play proposition and a high risk investment due to the unchecked criminal element.

One developer and one vodka distillery cannot fix the entire city and I'm sure Capital Hotel Associates, LLC will spread the risk from its Jackson venture across its other interests. Jackson creates unreasonable, and arguably illegal, barriers (Read: Equal Business Opportunity requirements) to entering an already risky environment.

"Shoulds" don't matter now except for learning. EBO has a time to expire and perhaps its time for that to happen. The Feds basically do the same thing. I don't assume the "white" firms are any better or less likely to "pay to play".

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time.
