JJ obtained copies of invoices submitted by Madison County Board Attorney Eric Hamer for the last twelve months. JJ examined Mr. Hamer's contracts in an earlier post and determined Madison County paid him over $655,000 since July 2008 and the average monthly invoice is over $24,000.
Mr. Hamer billed the county in great detail for his services. The September invoice is typical of the fees claimed by Mr. Hamer. The invoice is for $30,364. No matter was too great or too small to escape Mr. Hamer's time sheets. Talking to supervisors, emailing the chancery clerk, going on three-day trips to nice resorts, researching executive sessions laws, all of it was fodder for his billing machine. Some of the services claimed are:

It should be noted no authorization to pay Mr. Hamer for his billable time while attending actual sessions on said trips is mentioned in the minutes although his travel and registration expenses were authorized. Mr. Hamer fully supported his average monthly $24,000 fee in his invoices and the Board of Supervisors paid them without question. The Attorney General stated in the 2002 Wolfeopinion:
"In the event that the Board of Supervisors finds that there are special cases or circumstances which are not within the scope of the duties of the regular board attorney; that additional legal services are reasonable and necessary for conducting the county's business; and spreads such findings on its minutes, the board has the discretion to hire either the board attorney or another attorney on an hourly fee contract to attend to those additional legal needs."
The question is then whether the Board properly authorized the work claimed as the basis for these fees. JJ reviewed the minutes and stated its findings below. In contrast to the substantial fees billed to Madison County by Eric Hamer, the Hinds County Board Attorney works part-time for a supervisor's salary and has no invoices or billable time sheets to produce.
Note: The law does allow the board to authorize "special" work for the board attorney under either another contract or at the direction of the board as specified in the minutes. The Board minutes over the last twelve months authorized the following actions:

Trollfest '09
Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.
Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).
Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.
Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".
In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.
In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.
Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. Jackson Jambalaya is the home of Trollfest '07. Catch this great event which promises to leave NE Jackson & Fondren in flames. Sid Salter of The Clarion-Ledger will host "Pin the Tail on the Trial Lawyer", sponsored by State Farm.
There will be a hugging booth where in exchange for your young son, Frank Melton will give you a loooong hug. Trollfest will have a dunking booth where Muhammed the terrorist will curse you to Allah as you try to hit a target that will drop him into a vat of pig grease. However, in the true spirit of Separate But Equal, Don Imus and someone from NE Jackson will also sit in the dunking booth for an equal amount of time. Legal bills cannot tell you much without looking at the value of the service provided and the work product.

In this case you are wrong. First of all, there is no contract for 2009 and 2010. Period. The law limits the contract to a one year term. Second of all, if it is indeed outside the scope of his duties, the board has to authorize the special work and then spread it on the minutes.
You can't get around the fact the minutes don't show an authorization for the hours and hours he billed to the county for time spent at these conventions. The law says HE IS AN EMPLOYEE. Last time I checked, when I went to a trade show or sales meeting, my employer didn't pay me extra outside of travel expenses as I was on the damn clock.
I could be wrong but I believe there are similar (attorney) problems in Clinton.

At this point it appears that Madison County and their contracted professionals are grabbing a straws to keep their antics under wrap.
It sucks that the taxpayers not only get ripped off from the County's decisions, but the taxpayers will also have to pay for the County's legal fees and such to defend their poor decisions and mismanagement of funds.

Sorry, if Eric Hamer did the work, he should get paid for it. That's fair.
First of all, Mr. Hamer is a lawyer. He knows what the law is. He can't claim not to know what it is while cashing the checks. I have no problem making him pay back money for trips taken where his fees were not authorized.
If he is not responsible for repaying the fees for two years when he had no contract, then the Board, yes, the Board, should have to repay that. If that means Karl Banks loses that land next to Calhoun Station so precious to him and his family, tough luck.
The issue is not whether Mr. Hamer worked hard or did the work, the issue is whether he was validly employed in the first place and if these fees are legal or should have been paid by the county. If they should not have been paid at all, then the Board is culpable.
Ignorance of the law is no defense; especially when an attorney is involved!
These executive politicians are just laughing all the way to the bank and making fools out of the taxpayers!!!!! Just think Elvis tried to blame Brunini for the bad contracts and Hamer is perfectly working on his next invoice. Question here how did the Brunini firm invoice?

The reporting here on issues that affect us daily is some of the finest I've ever seen.
There are days that we all sit back and just accept the lot in life we were dealt, then there is the reality that we do have the ability to change the many insidious (search that) activities that we would never realize without the light that is shined here.
While we criticize through our comments; laws and amendments and proclamations are passed to rationalize the very insidious behavior they are called out.
Unfortunately, we do not have the ability to pass the laws to govern those that live in the grey areas for personal gain.
I guess the good taxpayers of Madison County are just going to keep accepting this type of mis-management with their tax dollars. Wake up folks you are being robbed and no, not legally!

Eric Hamer is just the lastest scammer in Madison County. He has been doing it with the blessing of 4 of our MC BOS. The BOS do not have the brains to be running their own business let alone the county's business. Look at your current tax bill compared to last year.
