Mac fires Mason

"HINDS COUNTY, MS (WLBT) - Three On Your Side has learned Hinds County Sheriff Malcolm McMillin has fired 20-year law enforcement veteran Victor Mason.
Sources tell WLBT it happened during a Monday Captain's meeting Mason was asked to attend.
We're told the reason for Mason's dismissal was that he raised his hand when McMillin asked if anyone in the room has talked about or contemplated running for sheriff.
Mason allegedly was told to pack his belongings up and get out, although an expletive was used instead of the word belongings
."

I find this a bit hard to believe. If McMillin wanted someone to leave, aren't there a million other less obvious ways to go about accomplishing that?

Yea i don't really think this is true because McMillin would have to know he would find himself in federal court for firing a person because he wanted to run against him.... isn't this what the employment acts forbid? And besides, McMillin has enough people in his back pocket to not have to worry about anyone running against him... I mean seriously..... what's he worried about? His day is coming.... research Paul Barrett from Vicksburg... as corrupt a sherrif as anyone ever knew, and no one could touch him, until he lied in federal court. McMillin will screw himself...... eventually. And IF this story is true, this could very well be the nail in his coffin... but i'm sure McMillin fired him for some legitimate reason, now whether it was made up or not is to be determined........

Isn't that against federal law? Doesn't the sheriff's office or county receive some federal money and don't they fall under The Hatch Act?

If one is an at-will employee or is only under contract (and not an employee), then that person can be fired at any time for any reason, or for no reason. Since sheriff is an elected office, I would assume that Captain Mason is will and pleasure (i.e.at will) and thus, could be fired by Mac for whatever reason.

Anyone with any sense would resign before announcing he was running for sheriff. It's common for deputies around the state who have ambitions of running for sheriff to resign and work for another law enforcement agency. It sort of ruins the working relationship when you tell your boss your want to take his job.

A sheriff can fire any employee for any or no reason at all, and there is no recourse. That is settled in statute and case law.

Most sheriffs don't want people working for them that have adverse interests. I don't think that is unreasonable.

KF, that signifies to me that Mac plans to run again.

If there is going to be any year for a candidate like Robert Johnson to knock off Sheriff Campaign Contribution it will be 2011. But Johnson will have to get the job done in the primary which means running as a Donkeycrat. Crossover voting will be almost non-existent next year due to the contested campaigns for the real important jobs on the Republican side of the election.

Not exactly. This is well settled under *state* law. However, deputies who are fired in violation of their *federal* civil rights can file a lawsuit under Section 1983.

This type of situation has occurred in the past in other counties, and deputies have sued in federal court, for violation of their First Amendment rights.

As I recall, more than a couple of Sheriffs in Northeast Mississippi have been educated on this fact through the years.

Interesting Curt, thanks. Is there remedy to regain their job or monetary damages? I would think that might be hard to prove, in general. In the case above, though, it seems pretty clear-cut.

Malcolm McMillin is a fraud who is only in office because he's stoked the racial fears of whites citizens in Hinds County.

As has become the usual, This site has reported on only one side of a story. The Sheriff did not ask if anyone is planning on running for Sheriff. He asked if anyone was planning on running "whether he (McMillian) runs or not". It would not be possible to keep such a person on any type of payroll with a yes to that question. Your boss would never tolerate a yes to a question like that. You cannot serve two masters, as the Bible points out. Sheriff, we are proud of the work you do in protecting us from the bungling Jackson Police Department.

I stopped drinking KoolAid as a kid. I did too, it rots your teeth and contributes to obesity. But then, you are drinking KoolAid, you probably don't know that, yet.

I didn't report one side of anything.

I know in cases such as these there are two sides. I merely asked for thoughts because I wanted to know what everyone thought of it.

I thought it was pretty classless of Mac however, to do that in front of other people. Everyone knew Mason was thinking of running if Mac didn't run. In the military the saying is praise in public, punish in private. There is a reason for that.

The lack of class was shared by Mason. He circulated around the entire office bragging about running "Whether Mac runs or not." Such stupidity would not qualify him for the office of Sheriff. He announced his intentions in public, so Mac returned the favor.

The Sheriff is and will remain the best law enforcement officer to ever serve in Mississippi. If he decides not to run for reelection, we will be up the creek. The alternatives would be scary. The Sheriffs office would be a duplicate of the Jackson Police farce.

For those of you trying to defend Mason ask yourself this, "What was his job at the department?"

If you did your research you would quickly find out he had no office he reported to daily or regularly and only a title. People never saw him for months on end. I talked to several people at the department that have worked there for 10+ years and only met him twice in that time. He was nothing more than a vote getter that got a paycheck every month. There are several people like that still in the Hinds County Sheriff's Office.

If you all only knew about the corruption and the BS in Hinds SO you wouldn't place so much faith in the institution.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required.
