More trash spread online
The family if the late Nolan Wells took the first steps in what is undoubtedly a quest to file a wrongful death action. Wells body was found in the water by a sandbar on July 4.
Christine Wells Wonsley, the mother of Nolan Wells, filed a petition to open an estate for her late son in Jackson County Chancery Court on July 20.
The petition states Wells left no will. Wonsley asked the Chancellor to appoint her as Administratrix of Wells' estate so she could investigate and pursue claims on behalf of the estate.
Chancellor Neil Harris assented and appointed Wonsley as Administratix of the estate on July 23. Attorneys Gary Bufkin and Luke Whitaker represented Wonsley.
July 31 was a busy day in the case as Wonsley issued subpoenas to Meta, Life360, Snap, TikTok, and WhatsApp.
Wonsley decided to change pitchers and retained Jackson attorney A.R. Smith. Smith entered an appearance for his client yesterday. Gary Bufkin and his law firm filed a motion to withdraw from the case today.
Meanwhile, the smear artists are hard at work. Check out this trash that appeared on social media the last two days.
Obviously this crap is libelous and not true. It is posted for now (It will come down after awhile) to show what is being spread online. Unfortunately, there are more than a few people who believe this garbage.

A suit for wrongful death can be brought by any wrongful death beneficiary. No estate representative is needed.
The problem is, they don't have a defendant, so they can't file suit. But they need an active case number to get subpoenas issued.
Therefore, they are using the chancery court, which does not have jurisdiction over a wrongful death case, to conduct discovery for a wrongful death case.
It's improper, even though wacko Neil Harris allowed it. As I recall, he was featured recently on this blog.

The info from all the social media will be interesting to read.
There are plenty of defendants - all underage and with alcohol on boats. They are compiling a list of every viable defendant and they will start with a core group of defendants / boat owners/ alcohol salespeople and the list will grow. Discovery will ferret out what likely happened and one day one kid will tell the truth. It won’t bring the son back but it will expose the ugly underbelly of all of this. The simple truth is….the kid drowned BUT alcohol use brings criminal charges for all nearby….so everyone lawyered up instantly…All will come out in time.

So as another You tuber discussed, The funeral, autopsy etc have all been covered by donors like Tyler Perry, Colin K. Etc. Why would anyone with brains donate to Christine Wonsley or Nolan’s stepdad. Gary Bufkin is no longer representing them. Yet Christine has again raised the go fund me to $950k. This is race batting NP is not who I would want to take care of my health. PS MS used to have the biggest MH Hospital in the US with Whitfield, now I understand why. I support the boys being unjustly accused!

The fact that any family member CAN file a wrongful death suit is why there are cases holding that the "first to file" is the case that goes forward (and most of those cases are dealing with how the separate sets of attorneys are paid). Sometimes there is a race to the courthouse. What's weird about Christine's petition is that she claims to be the only beneficiary when the half-siblings would also be wrongful death beneficiaries. The fact that Elmore is not listed as the father would seem, to me, to end the debate over whether he is Nolan's bio dad.
Carlos is advertising his Atlanta office without being barred there.
Some luxury cars, a beach home and mountain cabin will go a long ways to ease their grief.
I don't think the judge is allowing the discovery to go forward. The only way that it gets brought to his attention is if one of the companies opposes the subpoena, files a motion to quash, and sets it for a hearing. Since there's no defendant in an estate, there's no opposing attorney.

When you allow(PAY) some people to act sorry, they always will go to great lengths to prove it.
I predict there will be more attempts to monetize this young man’s tragic death, something similar to NIL in college athletics. I hate to say this but Southwest MS CC, where the young man was on the football team, might need to proceed with caution as to how they honor his memory.

That's about 70 years and four generations ago, back when racial segregation was still legal. A lot's happened since then.

The "race to the courthouse" was addressed more than 20 years ago in Long v. McKinney, 897 So. 2d 160, ¶58 (Miss. 2004), when the Supreme Court ruled that any wrongful death beneficiary "as a matter of right, may join in the litigation and participate as fully as any other claimant."
Do attorneys still want to be the first to file? Absolutely. No good lawyer wants to be hamstrung by a know-it-all who actually doesn't know much, and won't learn because he doesn't even realize how little he knows. It happens.
