Is it the end for Moe's Southwest Grill in Jackson?
The owner of Maywood Mart, Maywood Mart TEI Equities LLC, sued to evict JJB Tacos LLC from the shopping center on May 27. JJB Taco's owns Moe's Southwest Grill.
Stewart Compton LLC d/b/a Moe's Southwest Grill entered into a ten year lease with Maywood Mart in 2015. JJB Tacos purchased the restaurant in 2020 and Maywood Mart reassigned the lease.
JJB Tacos' rent is $7,210 per month. The restaurant must also pay a monthly capital area maintenance charge of $681. Maywood Mart notified the tenant it was in default on April 28. JJB Tacos owed $61,004 in rent and other fees. The plaintiff demanded JJB Tacos pay up or move out within five days.
The restaurant did nothing so Maywood Mart filed the complaint for eviction a month later. The landlord seeks eviction and all unpaid rent.

It is a CAM also known as Common Area Maintenance charge. It is set up to cover all the costs of maintaining the property, outdoor lighting, cleaning the premises, etc. Most all retail leases call for payment of CAM. Sometimes referred to as triple net (NNN) leases require the tenant to pay it percentage share of taxes, utilities and insurance.
Nobody rides for free.
When the tenant agrees to pay their property taxes-rated share of maintenance fees.
