The Jackson City Council refused to pay Richard's Disposal today at its regular meeting. Mayor Chokwe Antar Lumumba submitted a $808,000 claim to pay the New Orleans company today.
The City Council rejected the claim on a 5-2 vote (Start at 22:20 in the video posted below.). Council members Foote, Stokes, Banks, Hartley, and Lindsay voted down the claim.
Banks said it was illegal to pay Ricahrd's Disposal when there was no contract. City attorney Terry Williamson said the company collected garbage for April. The Council rejected the contract on April 1 but the Mayor "vetoed" the rejection. The "veto" was not overridden.
The Council warned Richard's Disposal on March 31 the company would not be paid since the Council did not approve a contract nor the emergency order.
Kingfish note: It finally happened. Back to court. The number of votes are sufficient to override the Mayor's "veto."

Common sense would dictate all council members would vote against this if they truly could be held liable for payment. Common sense? Nah.

This is a new thing that my wife and I are starting to see and that is you better check your expiration dates on everything you buy/ purchase from toothpaste to sausage links. These stores are stocked up on crap that is outdated. Yes I agree we all are in a death spiral thanks to these democratic led local and federal units of government.

Any good lawyer would tell you to vote against payment on a contract that the council did not approve. Just ain’t worth the risk. Too many eyes watching this one. It’s going to take a court order before payment goes out. Richard’s may be bankrupt before it ever gets sorted out.

Jackson is a great town unless,
1. You want garbage picked up.
2. You want navigable streets.
3. You don’t mind get robbed at gunpoint every now and then.
4. You don’t mind having to lock everything up to prevent theft, and this includes pets.
5. You desire to have running, potable water.
6. You aren’t bothered by raw sewage in the yards and streets.
7. You don’t mind paying some of the highest taxes in the state for services you often do without.
8. You don’t have any idea if you will get a water bill, and you have no idea how much that bill will be.
9. You don’t want to live in the US city with the highest murder rate in the country.
10. You can’t drive on the interstate late because you might be in the middle of a drag race (I was late one night after flying into the airport .
I living Jackson and I pay a fee for my garbage to be pick up. I will be drop my garbage at Arron Banks front door. The could have what until the court had make a decision.
Why does Fake Drake believe he can veto "no action" by the city council? Where in ANY state or federal constitution, law, regulation, or common practice is the executive branch allowed to veto "nothing," by the legislative branch and create law himself through a veto?

(1) Make certain that they are legal contracts; further, it is the responsibility of each entity contracting with the city, not the responsibility of the city itself, to ensure that the substantive provisions of the contract are properly recorded on the minutes of the city.
(2) Make certain that provisions the entity deems "substantive" are brought to the attention of the governing authorities prior to the related agenda order being voted upon by the city council. The city will not be bound by such provisions if they are not approved and entered upon the city council minutes.

The anchors then noted that the legal fees spent so far on the garbage debacle would have paid for 15 or 16 Fireworks displays.
But Choke's massive fanbase would argue it was just the mean old State not paying for Jackson fireworks (not caring that other cities manage just fine within budget constraints).

The City Attorney says Richards should get paid because they did the work. Under that logic anyone can do anything for the city and expect to get paid whether you have a contract or not. Can I fix potholes with a contract and expect to get paid? As to get paid for "good faith," did the Council not tell Richards they would not pay them without a legitimate contract? Apparently the Mayor told Richards that "Do what you want, we'll pay you..."
Why don't all you lawyers that live in Jackson create lawsuit that puts Jackson into receivership?

Lee and Grizell are conflating the employees and the company. Richards Disposal is required to be paying the employees, whether or not the City pays Richards. To talk about the 'poor employees' who have families to feed has not a damn thing to do with this payment.
Richards hired people to work for the Company. Richards made the arrangement, or lack of arrangement with the City. Lee and Grizell are trying to pull on heartstrings to complete their illegal activities.
Terry Williamson flat out lied to the council with his "legal advice" when he talked about the pending case in court. He said that this contract has not been found to be illegal - he is ignoring what Justice Dickinson said in his order - that a contract to be legal it must be approved by the Council.
Hang in there Terry - you carry the Mayor's water all the time paying no attention to the amount you spill along the way.

I'm headed to Jackson to collect trash. If one can just do work without authorization and a contract and get paid, this is a win win. 800K!! And I'll just dump it at Hawkins Field. Ka Ching!
I live in south Jackson, in Aaron Bank's district. Richard's Disposal KNEW they didn't have a contract with COJ when they started collecting garbage. Despite that, they occasionally (but not reliably) chose to pick up my trash, for whatever reason.
If the mayor was an honest man, he would have accepted the council's refusal to accept a bid that was, after all, NOT the lowest & best for twice a week pickup (without the ridiculous carts).
Instead, the mayor dug his childish heels in the ground and refused to confirm Waste Management's LOWEST AND BEST bid to continue the same 2x week good service we've all enjoyed for years.
I don't know why the mayor is "SO" indebted to Richard's Disposal from New Orleans... but he seems EXTREMELY indebted indeed, based on his incredible actions.
The council cannot set a precedent of paying any two-bit actor without a contract. Just because some idiot jumps out and cleans my windshield at an intersection, doesn't mean I'm obligated to pay him. We have processes and approvals for a REASON -- mainly, to prevent corruption. I smell corruption ALL AROUND this mayor's actions. The truth will come out, just like it is with the pandemic "election" spending.

I assume Virgie has read "state auditor's agents presented a demand letter..." in the news too many times to even consider the possibility of being on the hook for the cost of work done without a valid contract.

Council should have voted to rent police-spike-strips from Brandon and had Pearl deploy them in front of rolling Richards' trucks. Court will rule the city did not go far enough in its efforts to stop garbage pickup so they, in effect, allowed and encouraged it.
Ruling: Payment plus interest plus penalty plus new uniforms due and payable by 10 June.
Where is our State Auditor in all of this? The Council made the correct decision by not paying RD without a contract in place. If the Council had approved the bill then it would create a potential torrent of fake invoices for fake services performed with contracts. As you can see, it happened in Hinds County recently.
Crazy fuckin idea: get government completely out of trash pickup and let companies fight for individual accounts.

What happened to the concept of the lowest bidder gets the contract? This is a proven practice in the procurement process. We are not talking about rocket scientist here in choosing a trash collector.
