Jackon's New Abortion Abortion Protest Law Faces Court Fight

As expected, Jackson's new ordinance aimed at abortion protestors is going to court.  The Mississippi Institute for Justice announced yesterday it will sue the city of Jackson:


The Mississippi Justice Institute and members of Sidewalk Advocates for Life – Jackson, Mississippi announced a challenge to Jackson’s new prohibition on counseling and other free speech outside the state’s only abortion facility today.
The new ordinance bans individuals who are near health facilities from approaching within eight feet of any person without consent, for the purpose of engaging in various forms of speech such as counseling, education, or distributing leaflets; bans people from congregating or demonstrating within 15 feet of the abortion facility, and bans any amplified sound. Violations of the ordinance could result in fines of up to $1,000 and 90 days in jail. 

“Our clients are engaging in quintessential free speech, and they are doing so peacefully and respectfully,” said Aaron Rice, Director of the Mississippi Justice Institute. “They care deeply for the unborn and feel morally led to offer life-affirming alternatives to people entering an abortion facility. Jackson’s new ordinance is an attempt to silence our clients’ speech, and we are proud to stand with them and defend their rights.

“Regardless of what anyone thinks of our clients’ views, we should recognize that they have the right to hold those views. And just as importantly, they have the right to express those views, and to try to convince others to adopt their views. That is the very meaning of a free society.” 

In the past five years, Sidewalk Advocates for Life has trained thousands of volunteers to go to abortion facilities to simply offer loving, life-affirming alternatives to abortion. In that time, nearly 7,000 women and families have freely chosen the help provided and given life to their children.

“Women regularly accept our offer to help in the midst of an unexpected pregnancy, said Pam Miller, Co-Leader of Sidewalk Advocates for Life – Jackson, Mississippi. “In fact, in partnership with other peaceful community members, more women than ever – at least 30 this year alone – have opted to take advantage of the free, alternative resources the Jackson community provides. We are committed to connecting women with the loving, life-affirming assistance they deserve, and we will continue to serve the women of Mississippi in a peaceful and law-abiding way.” 

The lawsuit was filed in Hinds County Circuit Court.

Actually, the "lawsuit" is a notice of appeal.

The solution might be for the police to stop protecting the protestors. It is Jackson after all.

Btw I was in Fondren the other day and noticed that one of the protestors had their vehicle covered in that ridiculous anon conspiracy theory stuff. So they are obviously devoid of critical thinking skills.

Jackson has a noise ordinance, but no way to measure the noise level that will hold up in court. That would require the City to buy and use decibel meters and they aren't going to do that. Apparently, just testifying that something is "too loud" isn't enough for the courts.

BTW, that protester has every right to cover his vehicle in material of his choice. You may not know it, but that's none of your damned business. How did you come by this ability to determine possession of critical thinking skills by merely taking a look? You would be just as useless taking a leak.

But don't they still have the right to protest and to counsel the patients, if the patients want to be counseled? It simply sets a distance limit. I assume the argument must be that the distance is unreasonable. Is it?

What keeps getting missed in the discussion/reporting about noise at the abortion clinic is that the abortion clinic uses a loudspeaker to blare music that is frequently the loudest noise out there. The bullhorns from the pro-life side are in response to the abortion clinic's blatant disregard for the city's noise ordinance.

This should be so far down on the City's to do list as to be irrelevant. Crime out of control, crumbling infrastructure, a fleeing tax base, and the city wants to task legal funds and enforcement man hours towards this? Meanwhile half of Belhaven is not driveable, the jail is a playground for gangs, and Fondren had to weld bars on their benches to keep bums from sleeping on them.

Do you think your aborted fetus on a poster and bullhorn hatred will change my mind? The people inside the building take care of me and make me feel safe. Try offering kindness and a safe place and people wont ask you to stand across the street.
Honestly, teach your children the difference between what is right and wrong in your opinion and find a way to make a difference in this world...shouting hate from whatever the distance is will never be acceptable.

Prior to 2016 most of the Qanon believers were ignorant of Reddit, 4chan, or 8chan. They have no idea the lengths that those people will go for a prank or troll. They have all been duped and it is very, very sad.

The truth is that the lack of cognitive dissonance is stunning. Here you have a group of Americans that are nearly a religious cult in their belief in Q Anon. However, they will become apoplectic arguing that there is no way Russia (or anyone) can use social media and fake news to sway the electorate.

The abortion protesters run the gamut, like most such groups. What I see are mostly "holier than thou" types who crave attention. As a singer once sang, "Mostly say 'Hooray for my signs!'" While I'm quoting songs, "We don't need no education. We don't need no thought control." Hey, hypocrites and pharisees, leave those women alone!

You only have time to save one. Which do you save from the burning building? The newborn or the fertilized embryos?

Hermit King: A basic rule of debate is to not get suckered into a hypothetical. That sword cuts both ways.

Burke's post is simply a paper tiger. There are extremists on both sides of this argument. But I've noticed that the abortion side is very dismissive of the basic intelligence of their opponents. There are many extremely bright people on the pro-life side. To deny this assertion is to be ignorant or dishonest. I'm not Catholic but "First Things" is one of the very few beacons of clear thought in publishing today. Far too many publications are either chasing ad revenue or they are following their perception of the direction they perceive the wind to be blowing.

First, I hope the clinic closes and women would seek adoption over abortion. But, I don't understand why Fondren doesn't seek to have it relocated. It really needs to be in the medical corridor down Woodrow Wilson. I know most of the businesses there would just assume you grab a bite to eat and get an abortion during lunch. Maybe even grab a Chane T to commemorate the big day. But, with all the development, it makes more sense for both to move to a new location.

I'm not pro or anti anything, so I'm not trying to debate. I'm genuinely curious what the pro-life choice would be. The belief is that life begins at conception. So 100 fertilized embryos would be 100 lives. Seemed a good opportunity to ask"Pro-lifers" for an honest answer.

At church, I talked to a woman who volunteers clinic defense there, & she said the protestors were shoving and intimidating staff at Rooster’s.

Haven’t found any news reports. Apparently what happens there, stays there.

The claim that these protesters are " loving" in their approach or have any verifiable proof of having changed anyone's mind is ridiculous.

They are loud and obnoxious and are disturbing the peace. They are better likened to a bunch of drunks yelling and threatening others outside a bar.

Worse, some of them have brought their children with them on blisteringly hot days. Some of those children are young enough to run into the street during their mother's inattention.

They are unaware of how they frightened other children who are eating or shopping with their mothers.

At best, they aren't champions of free speech, they are a bunch of busy bodies who think they have the right to make decisions for people they don't even know.

For all they know, the woman they are badgering could have just been diagnosed with Stage 4 cancer or are carrying a fetus with a fatal genetic defect.

They are just puffed up and want to imagine they are superior beings who should be allowed to dictate to others.

You left out the possibility that some of the women entering the clinic are deluded, not really pregnant, mentally ill and they just think they're going in for an abortion. Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. Tom Head will give a reading for two hours on why he can't figure out who the hell he is. Cliff Cargill will give lessons with his .80 caliber desert eagle, using Frank Melton photos as targets.
