The Ridgeland Police Department issued the following statement.
Wednesday, February 22, 2023, at approximately 7:06pm, while patrolling, a Ridgeland officer observed a vehicle driving west on East County Line Road with one headlight out. The officer stopped the vehicle, approached and smelled the odor of marijuana emitting from the vehicle. One handgun, open containers of alcohol and marijuana were found in the glove box. A Jackson Police Department badge was also located in the vehicle. Kenya McCarty was arrested and charged with Possession of Marijuana 1st Offense, Possession of a Firearm while in Possession of a Controlled Substance, and Open Container. McCarty was released on a $2,500.00 bond.

Well, Officer Dope got herself in trouble yet again. Jackson Mayor Chokwe Antar Lumumba announced two weeks ago that he fired McCarty due to her involvement in the death of 41-year-old Keith Murriel, who died in police custody at a private home on 572 E. Beasley Road.

Am I interpreting this correctly? A person cannot have a legal prescription for a controlled substance and a legally purchased firearm in their vehicle at the same time. How can citizens keep up with all of these laws? I understand the pot and the opened container of alcohol charges.
She and her companions should have been fired after the first pot incident. I guess they received internal blessings, the Jackistan way.

You can not be in possession of a firearm regardless of having a Mississippi medical Prescription. Just wait till folks start getting locked up for lying on the ATF forms when they purchase a firearm.

Actually, yes you can. Having legally prescribed medical cannabis and a firearm, both in your possession is not a criminal offense in this state.
Nor is having an open container and a firearm in the same vehicle at the same time a criminal offense. The open container violation stands alone. No law against having a firearm in the vehicle unless you're committing a crime or are a convicted felon.
Never give LEO permission to search your vehicle, or, in this case, your glove box.
I'm not defending this hoochie-coochie gal, but it is what it is.

Have you ever purchased a firearm through an ffl? Did you lie on Form 4473 question 11 part e? If so that's a felony.

5:54 is talking about answering question 21:e on form 4473, which is the ATF form that is required to be filled out when buying a new or used firearm from a licensed dealer, which states:
"Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance? WARNING: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside."
I believe (actually I know) that submitting the form with false statements on it is a violation of Federal law with a possible penalty of up to ten years in prison and a $250,000 fine. Will they enforce it? I do not know if they ever will, but technically it's pretty clear that if you filled out the form and didn't disclose the marijuana use you certainly could have a problem if they did, as it explicitly states you're a prohibited person.
ATF Form 4473 was revised December, 2022. The new form, at section 21(g) asks the following question:
"Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance? Warning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside."

So, even if you are a lawful using of marijuana under state law, you remain an unlawful user under federal law. If you lie to the ATF to purchase a firearm . . .

Nobody in Mississippi will be arrested or cited for having a loaded firearm in his vehicle and while possessing properly purchased and controlled cannabis, while producing his state issued Medical Cannabis card.

8:11, I don't know about policing those in possession of firearms, but there are already plenty of feds to police those who lie on the ATF form to purchase firearms. They are call ATF Agents.
Many agencies hire unarmed CSOs (Community Service Officers) who take reports. This wouldn't work well in Jackistan because they would get robbed and their JPD vehicle jacked.

I have personal knowledge of an instance a few years ago where an FFL friend of mine got a personal visit from an ATF agent over a "lie-and-try" gun buyer. I was in his shop at the time. It happens. Not a lot, but it does happen.
