Jackson Kicks State out of Water System (Updated)

Governor slams Mayor, Mayor Fires back.

Governor Tate Reeves issued the following statement. 

We have been told by city officials that the Mayor of Jackson is planning to functionally end the city’s cooperation with the Unified Command Structure—the team that has been keeping Jackson water stable—by refusing to participate in the process of selecting a water operator alongside federal and state water experts as the Biden Administration repeatedly asked to be done. That would be a huge mistake by the city. They would be communicating through this action that they no longer desire state assistance and insist on going it alone.

President Joe Biden’s EPA pressed the state to prepare a request for a water operator and take the lead in the logistical process of procuring it. The Department of Health had the city review the technical components of the request. As spelled out in the published RFQ, the City of Jackson, Environmental Protection Agency, and Department of Health score the bids and ultimately select the operator. None of them report to the Governor’s office. The only role of MEMA is in the emergency procurement process of opening the price proposals and communicating the prices to the scoring team.

Throughout this emergency, we have had to procure chemicals, workers, and materials for the city routinely because they were incapable of doing so. This is a continuation of that process in an unbiased way—led by technical experts.

The state has poured millions of dollars from taxpayers of every county into this effort to rescue the city from a crisis of incompetence. If the politicians of the city of Jackson are determined to reject every helping hand and regulatory enforcement action, they will find themselves in an even worse situation.

There is very little trust amongst any outside observer that the Mayor putting his thumb more heavily on the scale to select a vendor will lead to a better outcome than experts from the Department of Health and Environmental Protection Agency having a seat at the table and ensuring that there are no games. He has proven time and time again that the benefit of the doubt cannot be given on contracts and water issues. I hope that he will reconsider this dangerous maneuver. The people of Jackson cannot afford another critical water failure due to a contract dispute akin to his garbage debacle.

Although politics is clearly his priority, we are simply trying to ensure that Jackson water does not fail again. Ultimately, it may fall to the city council to rein in this radical gambit.


Update (1:40 PM): Jackson Mayor Chokwe Antar Lumumba issued the following statement

"The City of Jackson has made no mention of ending the City’s cooperation with the Unified Command Structure. In fact, we continue to work closely with the Department of Justice, the Environmental Protection Agency and the Mississippi State Department of Health. 

What the city will not do, is agree to a Request for Qualifications, without the entire Unified Command Structure, which includes the City, having had an opportunity to first contribute, revise or approve the language. The funds that will be used to hire any firm working at the water treatment facilities will come from the City and its citizens. 

Therefore, the City, with support from those who truly are invested in the repair and maintenance of the water treatment facilities, will have the final say. The third-party management company will be working for the City. It is only reasonable to expect the City to play a role in hiring that company. 

Instead of issuing erroneous new releases, we invite the Governor to have an actual conversation with City leaders and our federal partners about the City’s water treatment plants. We have been ‘going it alone’ after years of asking for state support. We appreciate state leadership finally stepping to the table and supporting the residents of Jackson. We look forward to productive conversations that lead to an actual agreement…. instead of a headline."


Kingfish note: Several readers accused the Poor People's Campaign of marching in downtown Jackson without a permit.  The organization is marching clean as they obtained the necessary permits as required by city ordinance.  Just though I would spike that rumor.

This was always going to happen. If Chokwe allows the state to continue involvement, and the water system continues to operate as it should, even the dumbest people in Jackson will figure out that the mayor was the problem. Maybe he thinks they already have and this is his desperate attempt to save face. Either way, Jackson is screwed. The water system will fail before year-end. The trash fiasco isn't going away. More restaurants will close. Businesses will keep hauling ass to Rankin or Madison County, and the city will become more uninhabitable than it already is.

All about the Mayor trying to save face - the City of Jackson ultimately has no choice in the matter. The DOJ/EPA will enforce a consent decree subjecting COJ to federal procurement and operating standards. The City is out and the State is out - the Biden Administration is in charge. Federal dollars will run through EPA and the Corps to government contractors. It's not technically "receivership" but it removes the the Mayor's option to farm out management contracts as favors.

The Democratic Mayor, on the other hand, seems like he'd just have the whole thing collapse and take a billion or two to redo all the water..and hand that money to his personally selected contractors...

That's not going to fly...if I were an official within the Reeves or Biden administration, I'd have a federal auditor here to look at the books of the city of Jackson and find out where the money goes...

The City and Mayor failed miserably to properly operate the Jackson water system, and it crashed, leaving all its residents without any running or drinkable water. The State and EPA experts come in and spend millions of dollars to save the day, fix the problem, and give residents running water again. Now the Mayor says he can handle it and doesn't need the State's or EPA's intervention or help any more ? How, all of a sudden, did the City become competent to run the system properly when it failed to do so before ? Oh wait, that's right, now it's time to receive and spend $70-100 million in ARPA funds, and the Mayor wants his hands on it.

Because the Mayor has repeatedly shown them no respect and, to the contrary, has repeatedly called them racists, lied about the State not paying for the water it uses, and tried to blame the State for JACKSON's water problems when any fool can see that it was caused by the City's own incompetence. How quickly you forget that the City has failed to collect over $100,000,000 in water billings the past few years that could have solved and prevented what has happened. If you want someone's help, it's highly suggested that you ask them nicely for it. If you "demand" someone's help and then accuse them of awful things when they don't do what you want, you're probably not going to get the answer or result you wanted.

Okay, first the March last Monday with grease spilling into sewage & COJ streets. Letter from Jackson shows Poor People’s Organization had to provide their Insurance Company information; therefore that should take care of billing for clean up. Now the remaining request to March should be Denied as a Violation of Federal law & regulations. We cannot as taxpayers continue to help anyone who chooses to not help themselves! Right?

The State has a Dept of Health Order mandating cooperation from the brat mayor with the State Repair Team for a total of 120 days from the Order's inception, thence extended in 30 day increments as needed.

An EPA consent decree is recently in place, as well. Bennie T might need to take the failed mayor to the woodshed.

Meanwhile, what authority is required to put the City's water system in receivership?

The above statement shows that the city still doesn't understand how to run a water system. The funds should come from the City and its ratepayers, not the City and its citizens. You can be a citizen and not be a ratepayer (such as living in an apartment where the landlord pays the water bill). You can also be a ratepayer and not a citizen (such as Whole Foods, Kroger, Mac Haik, Target, Home Depot, Hilton on County Line, etc.).

Water/sewer should be funded from the ratebase. Always. Not from tax money. Set up an enterprise fund and operate the system from the ratebase like you are supposed to.

I was able to eat lunch with the current mayor's father. Due to the people at lunch crowd he asked if we just called him Edwin. He explained during lunch his ideas for change in the city and that some of the rhetoric was just to provide his base the ability to unify behind something. He was a smart man and political operator I believe the fallacy between rhetoric and reality was lost in translation between junior and senior.

Move the state capital to another city. Let them have the entire city of Jackson. It is a shit hole anyway. Put armed guards on all roads leaving Jackson. Stop any car having Hinds county plates and return them to Jackson.

Please remember that "water" every where else makes money. It almost impossible for water system to loose money. Also every City is a creature of the State and is formed under state law. The Feds have no choice but to support the State because of Federal water quality and pollution laws. The race card does not work anymore.

Not all citizens of the City of Jackson voted for this clown. I did not vote for the POS. I can't just move. My house is worth NOTHING, and I am retired, living on a fixed income. I've lost my ass. Some of us are just trying to survive.

In my opinion, the City Council has been neutered. Apparently we are under a dictatorship. I'd like to know if there are any options. We don't really need to pay for a city government. The criminals govern Jackson. Since we have no recall option, can anything be done on the legal side. The Richards thing, the water issues and many other things stink to high heaven. All city services are a disaster. I'd welcome an audit, a state takeover or a secession from Jackson. I wonder how many people have died due to contaminated water. We know some have died due to the poor condition of the roads. I want the tax money I've been forced to pay all these years returned to me. It apparently hasn't been used to run the city. Where did it go???

Bennie T, lame duck chairman, has resorted to type, demanding the Governor give fed funds over to Jackson and provide plans for how he will do so, implying he has been a racist in previously denying sufficient funds to Jackson for water system repairs because it is majority Black.

JJ has recently presented facts and timelines

The Mayor has proven without question that he and his staff did not have the ability to solve the water problem in Jackson. Part of the problem was a lack of sufficient funding which the city’s inability to solve the water billing system was a major reason. Their inability to correctly apply for available federal funds another. I agree the city needs to be involved in the process but not be the sole entity making decisions on who, when and how the ultimate entity is chosen to reform the water treatment program.

Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. Jackson Jambalaya is the home of Trollfest '07. Catch this great event which promises to leave NE Jackson & Fondren in flames. Sonjay Poontang and his band headline the night with a special steel cage, no time limit "loser must leave town" bout between Alan Lange and "Big Cat"Donna Ladd following afterwards. Kamikaze will perform his new song F*** Bush, he's still a _____. Did I mention there was no referee? Dr. Heddy Matthias and Lori Gregory will face off in the undercard dueling with dangling participles and other um, devices. Robbie Bell will perform Her two latest songs: My Best Friends are in the Media and Mama's, Don't Let Your Babies Grow up to be George Bell. Sid Salter of The Clarion-Ledger will host "Pin the Tail on the Trial Lawyer", sponsored by State Farm.

There will be a hugging booth where in exchange for your young son, Frank Melton will give you a loooong hug. Trollfest will have a dunking booth where Muhammed the terrorist will curse you to Allah as you try to hit a target that will drop him into a vat of pig grease. However, in the true spirit of Separate But Equal, Don Imus and someone from NE Jackson will also sit in the dunking booth for an equal amount of time. Tom Head will give a reading for two hours on why he can't figure out who the hell he is. Cliff Cargill will give lessons with his .80 caliber desert eagle, using Frank Melton photos as targets. Tackleberry will be on hand for an autograph session. KIM Waaaaaade will be passing out free titles and deeds to crackhouses formerly owned by The Wood Street Players.
