Update: 16 years.

2:55 PM Update: Judge Kitchens sentences Clark to serve 16 years in prison and suspends six years. That means under #585, Clark will serve five years.

Not much else will be posted today. I'm at the sentencing hearing for Bryan Clark. Judge Kitchens heard and denied a motion to recuse this morning. He recessed to read the letters sent to his court for sentencing recommendation. Court is about to start.

1:35 - Ill make a deal with you. If you promise to quit s***ing on KF every time he posts something, I'll quit pointing out that plenty of other people have been reporting on many of these things. You might not live in the Columbus area where this trial was going on, but the local paper has been reporting on it along with KF.

KF has done a great job of posting on it so that all those here in the metro area, around the capitol, can be aware of it. He did this once the family brought the information to him and tied the pieces together. Nothing wrong with that, its how things like this get the light of day shown upon them oftentimes. But there is no way this was going to be bought and paid for no-justice sans KF's posts; there are plenty of family members in the Lowndes County area that have been working the local media about this as well.

So -- deal. You quit chiming in every time KF posts something blowing smoke up his skirt and I'll quit pointing out your shameless asskissing that probably earns you a free drink and a quarter pounder every time you switch on your keyboard.

585 is a good bill, but even under 585, average sentence length served for nonviolent offenders is around 40% and around 60% for violent. Before, it could be shorter for folks like this who are well connected.

House Bill 585 only makes you eligible for a parole date and you aren't guaranteed to make parole. Doesn't mean you will be granted parole. Trust me, I know from numerous personal experiences. It's up to the parole board.
But with the money he has and resources, I wouldn't be surprised if he gets out faster that we think.

Not enough IMO, but at least he didn't walk. Feel sorry for the girl, he'll probably kill her one day.

What was Clark's demeanor in court, Kingfish? Cocky? Subdued? I assume he was taken into custody immediately, yes?

I guess all the doubts about the ability of Jim Kitchens to sentence Mr. Well-Connected were unfounded.

Thanks for the coverage of this case, KF. Followed you on twitter today too. Nice updates as the sentencing unfolded.

The good news about the outcome is that his freedom is about to be severely curtailed....even if it's only five years. The state prison guards will bleed him dry before he finds his "permanent" home w/in MDOC. They have it down to a science. His family will be well acquainted w/WalMart money very soon. He'll have access to plenty of drugs no matter where he ends up. They're everywhere. The gangs run CMCF, not MDOC. CMCF = Hell. Pure hell. Filthy. Nasty. Subhuman conditions. Spending any length of time there for "processing" is a punishment all in itself. Not sure how reformed he will be when he comes out on the other side of this. That's up to him. At least he will be locked away for a time and won't be a menace to society while he is in.

Clark sat right behind me the whole time. He didn't seem cocky nor did he turn into a crybaby. Seemed nervous and resigned to what was coming. The victim was in the courthouse but never appeared in the courtroom.

He wasn't at table during first part when motion was discussed and decided. He was at table when sentencing arguments were presented

Kingfish, thanks for the answer. I agree with others that Clark will not serve enough time for what he did. I can't help but believe that his family's money and connections played a part in the light sentence. If it were the average guy Kitchens would have been given a more harsh sentence. Kitchens only did a small fraction of the job he was elected to do.

Lowndes county can only hope that Kitchens and their DA are not re-elected.

I've practiced all over the state--even in front of Kitchens. If this guy has no felonies on his record before today, this sentence is probably a bit higher than normal for this crime (I'm not saying it's undeserved--I'm merely saying it's in the 70th percentile). So, he's certainly being punished. That said, I expected 20 with 5 suspended from Kitchens based on his sentencing history. So, while he didn't get a slap on the wrist, Clark actually did a little better than I expected.

A week in MDOC is like a decade in the free world. You can never relax, never let your attention flag. It is like living in the wild, except you have guards and prisoners alike preying upon you for money, in addition to the sex and other reasons. It's not gonna be a fun few years for Mr. Clark, no matter what that number is. Hopefully he learns some lessons and won't go back.

He/his emissaries better not go back after this woman to maime or kill her...isn't she kin to the Younger brothers who rode with Jessie &Frank James? She better make like her relatives and exercise her 2nd amendment rt to legally defend herself if,God forbid,that time comes again. What's that old saying? Better to have a badger on your "frontside" instead of a Younger on your back!!!!

KaptKangaroo - you evidently miss the point, which is generally beyond you. Unless, of course, you are KF's butt boy that chimes in at least once on every post.

My comments had nothing to do with KF - as I have said before, I enjoy his reporting. I respect his circle of sources, which is an important part of this kind of reporting. Hell, I might have even participated in that process over the years.

My deal was with his buttboy that has to chime at least once each and every post about how amazing KF is, and how NOBODY would know ANYTHING if it weren't for JJ. While that may be true for someone of his obvious lack of intelligence, there are plenty of other sources of news about the state - in and out of the metro area - that cover some of these things as well.

It just seems silly to hear him blow his smoke up KF's dress. Maybe its something else he is blowing, I don't know. But the comment wasn't a comdemnation of JJ, it was of his silly antics.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. Just bring the hate. Bring the family, Trollfest '09 is for EVERYONE!!!
