Rudy wants to slug it out in federal court.

Rudy Warnock removed a Madison County lawsuit to federal court last week.  The Madison County Board of Supervisors sued him in Madison County Circuit Court on March 31.  Madison County asked the court to order Mr. Warnock to turn over the plans and other documents for 35 projects as well as the Sulphur Springs project.  However, Mr. Warnock had sued the county on February 1 in U.S. District Court for $1.4 million in damages.  Earlier post on the two lawsuits. 

Madison County also asked the court to rule that Mr. Warnock breached several contracts and intentionally interfered with other contracts.   Madison County charged that the refusal to provide his engineering designs was "conversion" and asked for actual and punitive damages against the engineer.   The complaint asks for an accounting of payments made to Warnock LLC for a list of contracts provided in the lawsuit.   However, Mr. Warnock claimed in his federal lawsuit that he had copyrighted the designs for several projects and was going to apply for the copyright on several other designs as well.   The case (Warnock v. Madison County et al) was assigned to U.S. District Judge Carlton Reeves.   The removed case (Madison County v. Warnock) has been assigned to Judge Daniel Jordan, III.   Judge Jordan scheduled a motion hearing for May 18.

Mr. Warnock filed a motion to consolidate the cases on April 8 in U.S. District Court in the case that was assigned to Judge Reeves.  Madison County filed a motion for a preliminary injunction on April 6 in Rudy's original federal case.  The county simply restated what it filed in circuit court and asked the court to order Mr. Warnock to produce all plans and specifications for a list of projects.  The motion also asks for the completion documents for Sulphur Springs that are required by MDEQ.

It is a shame that beer and popcorn is not allowed in federal court.

Warnock is about to get bazillions. Defamation has ruined his business if the county pulls all business from him. This is going to turn ugly if they start getting records requests for texts on govt. funded cellphones and emails.

Rudy has pretty much burned bridges with all governments in Madison County by not turning over plans he was paid to create. His charges are astronomical. One can wonder if these plans in progress that he sent astronomical bills in January for actually exist. He knew he was going to be terminated and perhaps he just wanted to soak the taxpayers and enrich himself.

Attorneys, will this lawsuit open the door to any of Rudy's personal financial documents? Some believe that will shine a much brighter light on what has happened to all the money that he has been paid over the years.

Rudy has a business build on " buying the business and subbing out any real work".When all facts come out through discovery, he will be in bad trouble. One must wonder if the man has lost his mind. Never go into court unless you have clean hands.

I don't support Rudy or have a dog in this hunt..... But why is Rudy slammed for subbing work ... Mr Mattice nor Mr Bailey build develops.... They sub them out .... Home Builders rely on subs ..... They all get paid to manage the work ,,,,, slam Rudy for whatever ..... But not for subbing ........ I just had to say that after reading the comments for the last two years

12:35, under law professional services are not subject to being bid out. So a government hires the best firm for the job and then sets a price later. Since price is not an factor, Rudy charges double , a big cut for him and a cut for the firm doing the work.Also since Mattice and Bailey are spending their own money the money for a job is watched closely. For the Rudy system to work the local officials are in on the ripoff. Lots of professionals pay kickback and do the work but Rudy can not even do the work and must greatly overcharge.The subbing just show how really sorry he is.

I hope he and the past/present supervisors that were/are involved with him are held responsible both civilly and criminally when it is all said and done.

Jordan will send both back to state court where they belong. The copyright allegation won't keep his lawsuit in federal court, and it certainly won't allow him to consolidate both cases into a federal case.

What have the tax payers of Madison received from hiring Katie? Is she even providing legal services?? Every time I review the claims docket I see thousands of dollars going to law firms. What's up with that??

1:21pm. I think if you will look at the contracts this board has signed for engineering services you will see that the new firms are charging more than Warnock. Warnock charged $175/hr for surveying. New firms charging $220/hr!! Plus we are now paying mileage for the trucks plus an hourly rate for the trucks!! Devil is in the details people...... This is just the tip of the shitty ice berg.

All this is an issue, but the real issue is that we have terrible coffee at Jackson Medgar Evers Airport. I don't know why everyone is up in arms about this when what really affects us is the bad coffee at JAN. I flew out this morning. Had to wait until I got to Houston get a decent cup of coffee. Quite unnerving. All I wanted was a decent cup of coffee. How about a Cups in there, with triple filtered no lead water?

Actually, this thread is not about the County Attorney. It's about the crooked operation of Warnock supported by prior supervisors and two sitting supervisors.

Nice attempt to pooch-punt over to the sidelines in a move to distract. The County is at liberty to hire attorneys as it sees fit. Warnock was not at liberty to invoice for work not done, to invoice twice for work after the billing deadline or to claim he had not been paid for bogus invoices.

Don't forget the insurance girl from Oktibbeha County who is closely aligned with a prior supervisor who wears a cape. Oops!

It'll all roll out. Just give it time. Even Howland, with his Doe-In-The-Headlight reaction will be 'brown bagged' in this one.

If Rudolph had shit for sense, he'd tell his bone-headed lawyer to take a hike and would just go home and count the millions he's ripped off.

Newsflash - The County pulled away from Warnock when they fired him the first week of January. What defamation are you claiming? Termination of a relationship doesn't equal defamation in our legal system.

Even if that were true, which it's not, here's the difference - A contract at $220 an hour that is actually performed is worth more than a contract at $175 an hour that is billed but not performed. Can you grip that?

Cost = rate x number of hours.

Rudy might have the lowest rate but what about the number of hours?

No idea what they are, asking an honest question. Just don't get too hung up on rate.

Agreed kingfish! But if Warnock had some dumb ass ole miss engineers working for him that took them six months to engineer something that an MSU engineer could do in 2 days then that is fair. Not Warnocks fault that ole miss engineers are slow. Can you imagine how long it would take a JSU engineer? This is what happens when you hire people by the hour!!

Rudy arrives on game day via a private plane, with champagne and plenty of tickets for his friends. Is this a crime? Hell half of the tickets he hands out are to senators, representatives, oh and a few judges. You all are right the system is broken, but Warnock did not break the system he just learned what he was taught from his mentors who are and were city and county engineers. The politicians at the state capital need to change the laws but if they do well who will they get their tickets from? And that's the bottom line.

The private engineering profession is predominately involved with and paid by the public. No wonder there is so much graft. Until brides, gifts, and perks are eliminated, there will always be scum like Rudy. The taxpayers should be the ones demanding this, but alas, who will pay for the Tico's steak and the 900,000$ studies that don't amount to anything other than mental masturbation.

Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online).
