Rudy declares war on Madison County

Rudy Warnock & Associates sued Madison County in U.S. District Court yesterday.  The case was assigned to Judge Carlton Reeves.  The plaintiff claims Madison County owes the firm $625,714.  Warnock also asked for interest and attorney's fees.  Dorsey Carson and Julie Skipper represent Warnock.  The complaint is posted below.

Guess after last Saturday's hearing on the motions in Karl Banks' so-called election contest, that Dorsey screwed up in his filings, Rudy figures he doesn't have a chance on getting Banks back on the BOS - so he'd better try to get what he can while he can.

Too bad he didn't try to collect the 10 year old invoices when he claimed he did the work.

its been over 37 years since I took federal jurisdiction in law school, so can some civil litigator explain how the federal court has any jurisdiction? not diversity and I can't see a federal question unless Madison County was supposed to use some federal funds on this projects and that suffices...

Surely the supes dotted their i's and crossed their t's before they voted to terminate Warnock and cease payments? Oh wait this is the same board who hired three engineers at their first meeting and then fired one the second meeting. And this is the group who had to amend the new attorney's contract within two weeks of hiring her. If Warnock milks the county for more money through this lawsuit, some of the blame should be laid at the feet of the new board members making halfwitted decisions without fully realizing that scope of their votes.

And if Warnock doesn't milk any more money from Madison County to be able to pay continued gratuities to those that were in power before, the new board members should be congratulated and thanked for putting a stop to the crap that has been going on up there for years.

There were no federal funds to be used for the engineering portion of the projects. I have no idea how this goes to a federal court. Maybe an attorney on here can say.

I'll only charge him $500k to do a feasibility study on his ability to recoup his $600k.

Apparently raiding the coffers through his normal "business" isn't working so he found another way to make money off of the county...

2:52. When I read the complaint and saw the copyright bullshiz, I thought the same thing. I'm sure that claim will get dismissed, then it will get sent down to the circuit court where it belongs. they're also trying to claim it's an open account to avoid a statute of limitations problem on the breach of contract claim. I don't think this will be too heavy a lift for a decent firm.

Looks to me like Rudy needs to tell his top-notch lawyer where W&A is located.

According to website: "Warnock & Associates was founded to provide a valuable service to those who are seeking fast, efficient, accurate and affordable engineering services. We currently have staffed offices in Canton, MS and Carthage, MS."

According to lawsuit W&A is headquartered in Hinds County, MS.

Maybe while they were busy redating these old invoices the company address got changed at the same time.

I hear that the new board attorney (katie) is not even doing the legal work. She recommends in executive session Monday that the board hire an outside firm to protect them from Warnck. Looks like MC is paying Katie to pick outside lawyers to do all the real legal work. She will make $200k per year to help deft the minutes. I bet MC will pay OVER $1M this year in legal fees. You folks in MC can thank Mary Hawkins Butler. LOL

Fair question about Federal jurisdiction.

Regardless who defends the case, we'll soon know whether it was wise for Rudy to hand someone discovery and subpoena power.

Another random thought: I bet Tim Johnson is worried right now about going under oath.

Meanwhile, millions will go to outside counsel.

Oh, and there are other suits pending out there which she cannot even comprehend....so more money to more lawyers....but they did get rid of Espy....but he did manage to actually do some good for the county...like adding millions of dollars to the tax rolls in Lost Rabbit.....but who is looking at performance....

I remain puzzled about why perhaps 1/2 of the readers on JJ think that this engineer should not be paid? Did the County hire him to do some work and agree to pay him a certain amount if he did it? Did he do the work? If he did not, or did not do it properly, where is the County's letter outlining his failures and stating how much they would pay? I understand there is some law that would allow the County not to pay if a certain amount of time had passed. Common sense tells me that the purpose of such a law is to keep the county from being blindsided by a billing from years ago that they were not expecting. In this case the billing was submitted in a timely manner. The County is not surprised to owe this money.
There is also a smaller group on JJ that presumes to know what a reasonable fee for various engineering services is, but they never say how they think they know this or what a reasonable fee would have been. I understand that when the power on the board of supervisors changes the county engineer was let go. The same thing could happen with an attorney who does work for the county, an architect, accountant, or other professional service that cannot be bid out for the lowest price. Does anyone on here know a reason why this man should not be paid? I mean a real, concrete, factual, reason, not some political squabble. I would like to know what it is. Thanks.

The ego of the PE is unrivaled. You'd think they all stayed in a Holiday Inn last night.

The problem is, there are going to be enough former and disgruntled employees that Rudy should worry. They will be the ones going to the county to detail accounts of billing fraud, if it exists. Here's hoping his nose is clean and he is entitled to 100% of his bills. Timely billing? It doesn't take a rocket scientist to know you are grasping at straws when you do this. Hate it for his employees. If I worked there, I'd be updating my resume.

Now the Supervisors are considering a countywide tax increase for both garbage pickup and fire protection. Is Tim Johnson still on the Board? I wonder if Mary will fight this one like she did the last one since her cronies now run the Board. They gave the new prosecuting attorney a $27,ooo raise. Philette is calling the AG and Auditors office for everything since she obviously cannot read and understand the law. Seems they should manage better rather than increase taxes.

The people of Madison County should revolt if they increase taxes. Better management is the key. A $75 million budget should be enough. It did not take long for the newly elected Supervisors feel the power and screw the people.

Fire Districts. My understanding is they want to abolish all of fire districts and create one that is countywide. No more little districts or fiefdoms. In other words, centralize and make more efficient. Not up to speed on this issue, just what I was told is the game plan.

Read the facts of the case. Some of these 'invoices' are from ten years ago - but have now been redated to make them within three years. And others were for work that exceeded the maximum legally allowable.

From my understanding there are questions about some of the remaining invoices that need to be resolved, but Rudy wasn't willing to discuss or substantiate them without dealing with all - including those from 2006 and 2007 that were not submitted back then but were held until those that he had been paying on the BOS were on their way out.

Lot more here than your simplistic set of questions. The new board evidently is not going to continue business as usual, which evidently was whenever Rudy needed some money - either to run his office or to 'help' those that had their hands out.

The 'garbage fees' are not a tax increase. And I don't believe they are county wide. If I read the news correctly it is the cost of operating the recycling program and only for the area where recycling is operating. It reflects the cost of the program being charged by the contractor.

Fees for service are not the same as taxes. You want recycling, you pay for it. Frankly, I don't understand or agree with having a recycling program that costs money - thought the purpose was to save money while saving Al Gore's planet. But thats for another day.

If running the recycling program costs $xxx per household, I would expect the county to charge $xxx dollars to those households. I don't want them to charge more - but I also don't want them to charge less because then you are subsidizing the program with MY tax dollars.

In hind site all the newspapers should have been 100% subscription from the minute they went online. Then they would challenge their employees to provide content that was so much better than free content that people would pay for it. We really need impartial newspapers who will fully investigate things that are in the public interest. Looks like that is gone forever.

Besides if you get offended by someone demanding that you do something, you simply don't do it. You don't sue them for demanding.

Try to keep up. Rudy wants them to recognize bogus invoices that either represent (1) double billing, (2) work never performed, (3) work claimed that is outside the parameters of the statute of limitations or (4) Work never done but paid for already in the past by the prior board.

Fees are the way to go for recycling and garbage pickup. No tax increase on those that do not use county garbage system. Landowners, businesses who pay for their own pickup etc. should not have a tax increase.

8:48; whether you haul your own garbage off or not, your taxes (and mine) pay to ensure that the county is cleaned up so that garbage doesn't accumulate. Same with schools. Whether you have a kid in school, your taxes (and mine) pay for the education of children.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear.
