Clawback!

 Let the clawbacks begin. Now that the audit is complete, DHS is going after the money former director John Davis doled out to the favored. A list of the targets is posted below.

DHS is going to file a civil complaint against these parties to recover misspent TANF funds by the end of the month.

So what makes some of these folks criminally liable and not the others? The way I see it, for example, Brett DiBiase was charged criminally for part performance and little money, but Brett Favre gets a walk on part performance and a larger amount of money. At the end of the day they will both have to pay the money back, one just has to deal with felony charges and the other does not.

Yes, yes, I've heard the typical "Favre is connected more than DiBiase" and "Favre is the best ever." But Favre has been on the outskirts of a couple shady deals. When does LEO/Feds/DA/AG say enough is enough?

Some of these are really ridiculous, I'm sure, but a very serious question... If a state agency or subcontractor had the legal right to let a contract and did so with a contractor that did what the contract said, is there anything to be clawed back? (Even if the money was excessive and even if the duties called for in the contract were trivial?)

I'm thinking that these contracts were all made with a wink and a nod and maybe even a "We like you guys and I know there isn't much to do here, but we want to support you." type of comments, but if they did what the contract said and the contract was legally allowed by law, will that money ever come back?

@10:15a- I think it has more to do with knowledge of the scheme.

More than likely, Favre accepted the appearance/speaking money in good faith under what looked like legitimate pretenses. It doesn't appear he had any working knowledge of the fraud. However, he should have returned every single penny the minute the news broke.

Those who were criminally implicated must have participated in fraudulently processing/receiving the funds and/or were aware that the funds were not being used for their intended purposes but went along anyway.

So is DHS recovering the funds or is Shad recovering the funds? Will credit be given to those individuals if DHS recovers the funds?

I absolutely agree with the recovery of funds, but not double recovery of funds.

2) Will the USM girls' volleyball stadium be sold to the private sector now that Bryant and Favre got it built with stolen money? We all know damned well who pulled THOSE strings!

3) Will USM stop playing the Yankee Battle Hymn (pre football games) and leave the Dixie Darlings alone?

Farve and their favorite son governor got USM into this mess to begin with. The governor should donate some of his unused campaign funds to cover that for them. I am sure Farve had a lot to do with too..wishing for a volleyball facility for his daughter .

If a subgrantee to DHS has a written agreement with DHS & the deliverables/ terms were met then DHS is probably out of luck.

3:12 - Please try to keep up. In most of these situations, if not all, the 'deliverables' and 'terms' were either NOT met, were partially met or there were none. In the case of USM (Bryant wants buildings with his name on them), there were no terms other than that the school exists and there was no volley-ball arena for girls. Nothing to do with TANF. That was fraud from the get-go. The Bryant's knew that and Favre knew that. For Bryant to pretend he thought there was a TANF connection with a girls' gym is asinine.

In Favres' case, we learned early on (a year ago) that he did meet part of the obligation to do certain 'commercials' but there's no record of making them all, so he agreed to a partial pay-back.

In the most blatant and famous cases, there were terms that were fraudulently proposed from the get-go: For example teaching drug rehab while enrolled in drug rehab.

@3:12PM That's what I was thinking. The ones that met their contractual obligations should be free and clear even if the contracts were ill-conceived and maybe even didn't follow procurement laws, etc. The contractors that actually did what they said they were going to do can't be blamed because someone was an idiot in giving them the contract or using funds for the contract that shouldn't be used for that purpose.

Of course that's not the situation with many of the noteworthy ones, but I'm thinking a lot of these folks will just pull out the paperwork showing they met their obligations and tell the state to stick it. (& win in court if pressed.)

If contracts are violative of governing law which precede sub contracts then all these cases are viable.

If I could rob a bank and then contract with subs to build me a movie theatre in Jackson with 8 screens and a Pilates studio and a KFC……I still used stolen funds and the later built items are subject to seizure.

@3:12 is correct. TANF expenditures are broad, very broad. If a contractor performed a service for which it was paid, DHS will have a hard time clawing anything back. If any DHS execs signed off on these expenditures or programs, DHS will also have a very hard time pointing the finger now.

Ultimately the State of Mississippi will have to cough up the unspent funds. As to the individuals who received the funds through contractual obligations, it is going to be rather difficult (and wrong) for a court to allow a recovery, without upsetting the law of contracts in Mississippi.

I hope those commenting on contract law don't actually practice law. Just because there may be some document with the word "Contract" on it doesn't mean there is actually a contract. There are numerous things that could make the contact non-existent, void, voidable, etc. Without knowing a lot more facts and seeing the alleged contract document(s), no one would be able to offer a (reasonable) opinion on whether there is or is not a "contract."

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required.
