I would love to have a policy that is less than my monthly house note. Anyone that will write individual policies want to know if you have ever been sick or plan on being sick and if the answer is yes to either of those questions then you will be denied so I would love the pre-existing portion of the law. Now is Obama Care the answer...I don't know because I can't find anyone who knows the entirity of the law including the people who voted for it! I also worked in Canada for a number of years and quickly realized that anyone in Canada that could afford to do so commuted to the United States for anything more serious than a sore throat, so I don't think their public health model is the answer either. There were not five votes to uphold it on the ground that Congress could use its power to regulate commerce between the states to require everyone to buy health insurance. However, five Justices agreed that the penalty that someone must pay if he refuses to buy insurance is a kind of tax that Congress can impose using its taxing power. That is all that matters. Because the mandate survives, the Court did not need to decide what other parts of the statute were constitutional, except for a provision that required states to comply with new eligibility requirements for Medicaid or risk losing their funding.
