Local attorney arrested for domestic violence

Prominent Jackson attorney Pat Frascogna was arrested by the Madison Police on July 25, 2010 for domestic violence simple assault against his wife. JJ obtained a copy of the police report through a public records request after receiving numerous tips about the incident.

The police report states the department "received a call from St. Dominic's Hospital in reference to a subject in their emergency room who had been involved in a domestic assault with her husband..." Officers were sent to the hospital to investigate and interviewed the victim. Mrs. Frascogna told police she was driving the couple home in her car when an argument escalated to a physical confrontation as Mr. Frascogna bit and beat her. The officers observed bite marks on her hands, blood on her shirt, red marks on her right arm, and bruises on her face. She managed to pull the car over and get out. A passing motorist saw her on the side of the road, asked if she needed help, and took her home. Her sister took her to the hospital. The officers documented the injuries and later arrested Mr. Frascogna that evening. A protective restraining order has been issued against Mr. Frascogna. Copy of report

Mr. Frascogna was a former candidate for Mayor of Jackson in 1997 and worked as an attorney in the Hinds County Public Defender's office for three years. He is currently a partner in the law firm of Frascogna & Frascogna. Mr. Frascogna will have his day in court and anything released in his defense will be posted here. Although pretty damning, the charges still represent one side. However, if found guilty, one hopes the judge will throw the "anger-management" option out the window.

KF wouldn't post this if this guy was an architect. Bottom line, KF has a vendetta against lawyers. This is no more news than if than if John Doe committed the offense. I don't know Pat Frascogna. Don't care to. This blog is hitting new lows.

Anony 10:22: New low huh? What ambulance chasing firm are you with?

Wake up all you hipocrites, this is about domestic violence. Domestic violence is believed to be in poor and low class citizens and that is not true. Articles like this may save some one else's life (lives) and make these abusees come out and talk about being abused. Will this stop the abusers, well if there is a site that publishes all on these arrests maybe they will think twice.
This lawyer and his wife is no different than the dentist and his wife in Brandon.
Get the chip off your shoulders, might be hard for you when you are adovcating for the wrong sides.

Shades of Irby! What in the world was he thinking to attack her while she was operating a motor vehicle. Damn, there needs to be additional charges for such recklessness.

Anonymous said...

She managed to stop the car before killing 2 innocent people. By some moron's accounts in other threads on here, that was an impossible task.

Kudos to her, and here's hoping they not only throw the book at him, but give him a good beating with it.

Timely coincidence for Frascogna that MPD was unable to fingerprint and mugshot him due to malfunctioning equipment. I'd be curious to know how soon after he was released that the scanner and camera returned to operability. Was the breathalyzer temporarily non-functional also?

Anonymous said...

Weird. I've been inked at mpd for an application. I know they have the capability to do manual ink prints. That's strange.

Anonymous said...

Can anyone get a statement from MPD?

On July 9th, there was a foreclosure notice for a Joseph Patrick Frascogna for a house on East Cheryl which I believe is in Eastover or thereabouts.

I don't know Pat Frascogna or his wife, but I'm glad that Mrs. Frascogna was able to pull their car over safely without anyone else being hurt.

This, of course, can't help but remind one of the Irby situation. I'm inclined to believe that Stuart Irby did attack Karen in the car, but I'm also inclined to believe that Karen was already speeding by the time Stuart (allegedly) attacked her. I think Karen is where she needs to be now, but I think Stuart also needs to be in jail too, that is if he did in fact attack Karen in the car while she was driving. Of course, Stuart is the one who let Karen drive the car when he knew quite well that she had been drinking. And Stuart and Karen both knew about the other events that had transpired in the days leading up to that night. Of course, if Karen was attacked, it seems she should have been able to hit the brakes. Also, if it's true that the moment when Stuart (allegedly) attacked Karen was right after she had told him she wanted a divorce, well, in light of his reported past history of an explosive temper, that was a pretty stupid time for her to announce to him that she wanted a divorce.

But whatever happened in the Irby car that night, the fault for the accident was totally with the Irbys. Individually and together, the Irbys had made a mess of their lives, and that led to the deaths of Mark Pogue and Lisa Dedousis. It's just really scary to think that Stuart is still out there, behind the wheel of a car at times, with bipolar disorder, and possibly even a hair-trigger temper.

Were any pictures of Mr. Frascogna at the time of his arrest?
As part of the investigation?
Perhaps documented but not supplied as part of the FOIA?

Mugshots and fingerprints can be obtained at a later date- but the evidence that should be collected at the time of the investigation--lets just say there is no going back.

Hopefully there is no problem downloading the 5 pictures of Mrs. Frascogna at the appropriate time.

Maybe time to check some repair invoices, or whatever reports document the failure of vital equipment that must be returned to working order ASAP?

Perhaps the apparent lack of any backup system to get prints and mugshots is another issue to raise.

Anonymous said...

You can ALWAYS take manual prints with the old ink. Smells nasty to me.

And why would you think Kingfish is after lawyers when he went to law school himself? DUH.

Anonymous said...

The East Cheryl house is in Sherwood Forest though creative real estate types have dramatically exaggerated the boundaries of Eastover as time has passed.

The Frascogna's paid the $7k East Cheryl prop tax bill w/o homestead exemption on time.

Curt Crowley said...

"You can ALWAYS take manual prints with the old ink."

True, but why would they go to that amount of trouble when the prints could simply be taken later?

With identification not being an issue, taking ink and paper prints seems like a waste of time, especially in light of the fact that this is a misdemeanor.

The failure to take prints is just not a big deal.

Perfect. From what I've heard, this guy is a sleaze-ball lawyer. Loves to sue and it's typically for non-meritorius reasons, so he can "extort" a settlement.

Anonymous said...

As has been mentioned, fortunate that no innocent motorists were injured as a result. Wonder if alcohol was also involved? The number of drunks cruising the streets of Madison at all hours of the day is frightening. Excuse me, the number of heavy social drinkers cruising the streets after socializing is frightening. We all know there aren't any drunks in Madison.

@10:22am - "vendetta against lawyers" - i suppose you are advocating that we do not hold officers of the court to a higher standard...i think that demonstrates some of the problems we have with the Mississippi Bar

Anonymous said...

Actually - officers of the court have a duty of candor to the court. The oath a lawyer takes, and I have taken it, doesn't make you some super citizen. It says you uphold the law. It is the same obligation that any citizen has. So yes, lawyers have a higher standard in court, but to think all lawyers should be perfect is naive.

All I am saying is that if KF really was attacking this issue because of domestic violence (which, to his credit, he did a great job publicizing the Heather Spencer murder), he would do a FOIA for all domestic violence reports, and list them all. Instead, he gets tips because this guy is a lawyer.

Just so we are clear:

"The Attorney's Oath: I do solemnly swear (or affirm) that I will demean myself, as an
attorney and counselor of this court, according to the best of my learning and ability, and
with all good fidelity as well to the court as to the client; that I will use no falsehood nor
delay any persons cause for lucre or malice, and that I will support the constitution of the
State of Mississippi so long as I continue a citizen thereof. So help me God. MISS. CODE
ANN. SEC. 73-3-35 (1973)"

Duty as officer of court:
"The advocate's task is to present the client's case with persuasive force. Performance of
that duty while maintaining confidences of the client is qualified by the advocate's duty of
candor to the tribunal. However, an advocate does not vouch for evidence submitted in a
cause; the tribunal is responsible for assessing its probative value." Comment, MRPC 3.3.

Anonymous said...

That's cute 4:47 PM.

Allude, anonymously, that KF's journo credentials are somehow lacking. What you fail to acknowledge is that the rich and privileged -- primarily (six sigma) abusive males -- will game the system to obscure their domestic abuse from the public eye.

Ain't nobody hanging all their bonafides in this community out on the public line for all to see like Mr. Kingfish. His indentity isn't a mystery.

If all you a-holes (esp. attorney a-holes) got something to hang on him then please sue his ass or start your own blog and tell the world where he has led his readers, and the public, astray.

Oh ... that is right. Your just another anonymous nobody.

Otherwise, STFU.

Anonymous said...

If the argument holds that KF published the info "just because" the perpetrator is a lawyer then would not the contra argument be true had he not published the info (e.g. because he is a lawyer)?

i know Pat and have always regarded him as a nice person with a great sense of humor. i'm surprised to see this but we've only heard one side of the story. every person has a dark side whether you admit it or not. some people can bring out the worst in others.

"there is no deed so foul that something couldn't be said for the guy."

Shoe Girl said...

There are always 2 sides, you are correct....but no one deserves this. Biting someone??!! Come on! 2 year olds do that. I don't know what it is going to take for women to get the hell out of these situations. I am sure this isn't the first time. It won't be the last either. I don't care if he is an attorney, a politician, a teacher, a preacher, or a ditch digger- domestic violence HAS to end.

MAK said...

What a shame. What arrogance. What ego! I'm disappointed in Pat and hope that he gets every bit of bad press he deserves. No one has a right to hurt another human being. It's a crime and is punishable by law. In light of the Irby case...the court of public opinion might not work at all Frascogna's favor. Bite marks? Really? That's what angry dogs do. Gross!

Anonymous said...

@4:47 everyone should follow the law, but not everyone takes an oath to do so as part of their occupation, which in my mind caused me to have more respect for lawyers, but i will concede your point and instead have less respect lawyers, so you win

Anonymous said...

I am sure this isn't the first time. It won't be the last either.

If she doesn't leave him and/or if he doesn't actively seek and participate in serious counseling then, sadly, I agree with your prediction.

Zero tolerance.

Shoe Girl said...

Sadly, it's a neverending battle. And, there are cases (very few) where the woman IS the aggressor. If that's the case here then they both need therapy. Either way, domestic abuse is sick...and lonely. Who wants to live in that environment? I surely do not. Life is already short enough without fearing the one who "loves" you. Sadly enough, the crimes that do get brought out in public are the ones who end in murder (Heather Spencer) or the ones committed by attorneys, doctors, etc. There are so many people in abusive situations and no one is aware it's occuring. Half the time the victim honestly thinks she's at fault and that the assaulter loves her. It's sad

Thank God she was able to get the car off the road and get OUT.

Best wishes to her, and her future well-being. Can't say I have many positive thoughts for Mr. F at this time. Shame if this is all true.

I took that one down because there were several factual errors.

Where does one get the idea I hate attorneys? Because I think the Bar should put all violations and sanctions online? Because I've written about how stupid or crooked some have been over the last few years? Don't hate them at all, I just don't worship them as they worship themselves.

Queenfish said...

Can't wait for Mr. Frascogna's side of the story-has anybody seen him or gotten his side yet? Maybe he was defending himself? Just saying....and no I don't condone any type of domestic violence.

Anonymous said...

I'd be more impressed if you called up the Lauderdale Circuit Court and asked who was sanctioned for failing to appear for jury selection several weeks ago.

Anonymous said...

There were no factual errors in the comment you took down. I know it's your blog, but if you're going to practice censorship, you should disclose that on the face of your page.

Shoe Girl said...

That's just it-it is HIS blog. He doesn't have to disclose anything. Just like you don't have to read anything. Isn't America great?

Kingfish said...

Actually you did. Where does he live?

Anonymous said...

Last I heard, he lived on one of the Cheryl's at the eastern end of Northside Drive in Sherwood Forest. That's the one that's had foreclosure proceedings started and stopped a number of times over the past few years. I did err in referring to Hinds County Court. Noted that this went down in Madison.

Kaptain Kangaroo said...

And yet ANOTHER attorney does the profession well. You can't make this stuff up. Reeks of the Evan's brothers....

If the Bar won't take matters seriously, this site will. Attorneys are held to a higher standard when they hold a license to practice in a profession that is essentially a "Protected Market."

GREENVILLE, MISS. — Booneville attorney Thomas D. Keenum Sr. has pleaded guilty to bank fraud charges in U.S. District Court in Greenville.

The Northeast Mississippi Daily Journal reports Keenum entered the plea Tuesday to one count.

Court records show Keenum faces up to 30 years in prison, no more than $1 million in fines and possible restitution.

Prosecutors say Keenum had local attorneys file title opinions that Keenum owed no money on 10.5 acres in Alcorn County. Prosecutors say Keenum used the fraudulent opinions to get new bank loans totaling more than $376,000 as he sought to get himself out of financial difficulties from 2005 until 2007.

The government says he borrowed from two banks in Mississippi and one in Alabama.

No sentencing date has been set.

Who is the Hottest Reporter in Jackson?

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.

In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. Just bring the hate. Bring the family, Trollfest '09 is for EVERYONE!!!

This is definitely a Beaver production.
