KF, I investigated child neglect and abuse for over a decade. This child should never again be subjected to the anxiety of being around this man, but I can assure you, he will be. I , also, doubt, this sorry SOB will serve much , if any time and great taxpayer expense will go into " reestablishing a positive parent child relationship".
We still regard children as their parents' " property" and don't want to accept that those of us who just pop a fanny in ANGER could end up with a kid falling down and hitting his head . Then there's the arms jerked out of sockets and damage from shaking.
Besides, why take the time to actually teach and discipline when fear works so quickly?
If I had a nickel for every parent who claimed to just be " spanking" their child who was in the hospital ( and who had the community defending them), I'd be rich.
Doctors and other professionals don't want to testify ( yes, I know the law says they MUST but they know it's not enforced) so protecting a child from brutally at ALL only happens in these obviously egregious cases.
If YOU hadn't SEEN the photos ( and most times you don't get to), would YOU have believed it wasn't just corporal punishment,KF...even seeing the guy had a temper?

Read the comments on the mother's website. Unfortunately, too many people have taken advantage of Mississippi's lax laws regarding filing charges that too often the child abuse laws are well, abused so that people can retaliate against someone else for real or imagined offenses or just out of plain spite.

This is a terrible thing, and I feel awful for this child and his mom. This guy is a DBag. I want to set you straight on one thing, though. Miles Swain was definitely not a friend of Bell’s. He was an employee for a brief time – not a partner. They didn’t even hang out. I knew when Miles worked at Herrin Gear in the finance dept. He left to work for George for a year or so, but George never liked him. When George and his partner split, he sent Miles up the road with the other guy. Then the other guy ended up firing him. And that was a long time before George’s troubles. When I read your post, I called one of George’s actual friends to make sure I had it right. Somebody gave you bad info. These dots don’t connect, man.

I can testify to people using the "filing charges" absent police investigation via the "sworn affidavit" and attorneys are the WORST abusers of this tactic. Charges filed in my case did not rise to this level, but can understand KF's comment.

To answer your question - Bell hasn’t talked to Swain in several years. For sure not since the Heather tragedy. No, I didn’t call his mom. Was just jokin'. But did call one of the roid buds.

My guy also said when George hired Miles, he was real impressed because Swain is pretty good at auto financing, and he brought in some bucks for Bell’s dealership. They might have gone to pump a few times after work in the beginning, but I promise you that wore thin real fast. They did not become good friends, and just because Miles said that to you one time in a gym doesn’t make it so. It didn’t come from George, and it didn’t come from anyone else close to him.

Question, Swain's new wife was also arraigned? was it also for alleged abuse or for "subjecting" to abuse because she was present? What part did the step mom play in this to be a defendant? Step parents may -NOT- participate in corporal punishment in my book..so was just curious where she comes in.

I bought a truck from Swain--seemed like an alright guy to me even though and had this weird nightmare about the guy the night before I was supposed to pick up the vehicle.

Miles Swain is a POS. He’s been in several auto dealerships around town, plying his sly trade. I worked auctions with George Bell on a fairly regular basis, and knew him pretty well. I worked out at the same gym as both of them ( and I’m no roid), and they never came in together.

George Bell and Miles Swain are not birds of a feather if you are talkin’ friends, KF. GB couldn’t stand him and plenty of people know that.

And I am sickened by reading about Swain’s kid and even worse with the stepmother not stopping him, but participating? I want to know more about her part. That just blows my mind. Good job reporting this, but you’re hanging on to some bad intel and need to cut it loose. It weakens the good job you have going on a very worthy story.

They were never "best friends", and could barely stand each other, except for the time they worked together, when they were only civil. George did not like this guy and vice versa.

A casual "this is my friend" sometimes is just a way to introduce someone without going into details.

I am the Mother and ex-wife. First of all, I can recall riding 4-wheelers with GB on several occasions while married to MS. Whether GB liked MS, who knows? Regardless, they did indeed hang out. As for the bracelets--my son loves that people wear these bracelets and support him, including local Pearl Police Officer Ernie Scarber whom Gabe is particularly fond of! Also, in case you haven't figured it out, attorneys are indeed, not cheap. I do, however, feel my son deserves to be well-represented in hopes that I can do what I was unable to do those nights in August 2009...PROTECT HIM. In addition, per DHS recommendations, Gabe receives counseling from a wonderful Christian counseling center. Unfortunately, that also costs money and because it is the first of the year, his deductible must be met, which means $250 on top of the usual copay. So I am raising awareness and money both to benefit my child, who deserves the BEST care. My son is only SIX years old and he thinks of his counselor as a grandmother-type. He is comfortable with her and enjoys going to see her every week. If that somehow makes me a bad mother, then so be it. I am the one who looks at my child EVERY day and wishes I could take that memory away from him...with therapy, and God's grace, he will be able to enjoy being a child and not be afraid of being hurt ever again.

I knew the reasons for the fight at the gym but didn't want to get into it here but yeah, that is correct.

Yeah, well lot's of people ride 4 wheelers with acquaintances, especially if they work together. That doesn't make them friends. Really not best friends. KF, you are one hard-headed son. How many people does it take to tell you MS and GB weren't good friends? George started out an ok guy, and drugs ruined him. Miles has always been a sleaze.

I hope Miles gets the max for this, and I think whoever dissed Amy for selling the bracelets ought to apologize.

I don't really see if it matters whether or not MS and GB were friends, acquaintances, or just both ass holes. It doesn't change the fact that MS beat his son, and still feels that he did nothing wrong, and should be punished to the FULL extent of the law. Maybe while he is sitting in prison he may begin to realize that he is not a god. Then again, some people never change.

Was the stepmother charged because she didn't do anything to protect the child? Her charges are different-contributing to the delinquency of a minor and neglect. I don't know how she could just stand back and do nothing unless she's scared of him herself. I wonder who is representing her?

For what's it worth, I heard GB was bad news since he was a little boy. Wasn't he kicked out of JA permanently because of his bad behavior?

I applaud your efforts to protect your son and do what is necessary to be able to do that.
I want to assure you that he will survive this as you are doing all the right things.
The most important thing, as I'm sure you know, is for him to be certain that he didn't " deserve" what happened to him.
Even without intervention,most abused children live successful, productive lives.
Take heart and for sure, pay ZERO attention to critics who don't have a clue what your challenges are. Such jerks don't deserve an explanation.

To KF and others who seem to know MS. These posts only serve to show that these are just bias opinions to a story which neither of you know the other side. Whatever happened to the old adage to believe none of what you hear and half of what you see. Yes, did an incident happen? That is not disputable, but the facts surrounding the incident are disputable and are not subject to biased opinions posted on this blog. If each of you only knew the other side of the story you would each be regretful to say the very least. I am in INSIDER to this story, and I personally know LS and MS as I am in their lives and the lives of their children on a daily basis. These two people are some of the most loving and tender-hearted individuals that I have ever known. They both have other children from prior marriages that they love tenderly and as affectionately as they do the child mentioned in the story. This incident does not set the precedent as to lives of these two people and are not indicative of a habitual lifestyle of abuse. You will never find that these two people's character reflects any past behavior. People sometimes make mistakes. I would challenge each and everyone of you to take the HUGE LOG out of your own eyes so you can see the speck in someone else's eye. If any of you have never done anything you have regretted and wish that you could take it all back then you be the first to throw the stone. I dare say that not one of you doesn't have a regret in your closest you wish you had not done. If you could hear LS's story you would be speechless and walk away with your head bowed in disgrace for wishing illwill on these people. They have a tremendous testimony for deriving their stength from God through horrific times. God is the only one who has the right to judge and this story will be judged in its due time. There is NOTHING that justifies the belt marks on that back. That was more than child abuse, that was an attack.

Let me say that first of all that scripture refers to "not provoking a child to anger". You have no idea what that child could have done to warrant getting a spanking in the first place. Do you have children? Do you not understand how children are able to undermine even their own parents, manipulate them into the parent being submissive to the child? Have you ever read Proverbs 13:24 he who spares his rod hates his son but he who loves him disciplines him diligently. Or, Proverbs 22:15 whereby it states foolishness is bound up in the heart of a child; the rod of discipline will remove it far from him as well as Proverbs 23:13 do no hold back discipline from the child, although you beat him with the rod, he will not die. You shall beat him with the rod and deliver his soul from sheol (which is hell as I understand it). Like I said, none of you know the entire circumstance of this situation, and how would you like it if a situation arose in each of your life where you didn't mean to do harm to someone either by words or deeds but you paid a price that was way beyond what you really deserved. Like Jesus, do you really think he deserved the price he paid for your sins? Why did he go through all that torture when he was innocent. The answer to that is because of his great love for us! I bet you believe you deserve God's mercy and forgiveness. Besides, the word of God says that if you do not forgive your heavenly father will not forgive you. None of you are any better or any worse and each of you would want to be pardoned at least once in your life especially when what you did was not habitual in nature. I believe in spankings as I was spanked as a child. My father left belt bruises on my legs at age 17 for arguing with my mother to a fault. I had bruises for 2 weeks across my legs. It was the one and only time I had a bruise on me in my entire life from my father or mother. I never felt nor did I ever accuse him of child abuse. I cried over how I treated my mother. I was defiant and disrespectful to say the least. That spanking was the best thing that ever happened to me. I had sorrowful repentence for disrespecting my loving mother. My father spanked me because he loved me and it was for my good that I learned never to talk to my mother in that way again. Anyone who thinks they need a whip a six year old child with a belt has obviously got serious mental issues. Especially hard enough to leave those kinds of bruises. That's really all that anyone needs to know. I have a six year old boy, soon to be seven and I know full well how frustrating they can be. I also know how unconditional their love is for their parents, this MS person doesn't deserve that love. He should be the one protecting his boy from the pieces of human trash that would do or allow that sort of thing to happen to a child. I can understand what the blogger was saying about not having the entire picture. When my son was 3 he was playing on the bed with his dad. His dad was underneath the covers and was holding on to my son's arm when my son suddenly decided he wanted down off the bed. What happened then was my son's elbow had been pulled from the socket. He cried so hard that I had to take him to the emergency room where they placed a cast on his arm. Everyone wanted to know what happened to his little arm and my son responded "I don't know but my daddy did it." Looking at the situation, the cast and the fact that my son said his daddy did it folks could have come to the conclusion that this was some form of child abuse but it was NOT. It was completely an accident. My husband felt so tremendously terrible for what happened to our son. I sure am glad that my neighbors, friends and the doctor didn't report him to the police and to DHS. Accidents happen.

WMartin, are you saying the God has mental issues? He says in his word to spare the "rod" or spoil the child. Please refer to the scriptures noted above. I believe that God knows what form of discipline is best for a child than you do. Now the issue is not the belt, but the bruises. I do not agree that children need to be harshly mistreated. I can see how a loving father or mother can accidently leave markings on a child if they so choose to use a belt or a switch or whatever. There is a chance that could happen but most do not PLAN for that to happen. Hey, are you the perfect father? Do you raise your voice to your child? In what manner of discipline do you use? Does your child flinch when you raise your voice? Do you lose it at times and scream at him or her on occasion? Just curious. Hey if you are perfect with your child in every way then you have every right to voice your opinion. If not, then don't talk about someone and wish illwill on them when next time it could be YOU that is on the hook for something. What goes around comes around. I am trying to imagine the infraction that would be needed to cause a full grown man to believe he needed a belt to impress his point on a 50-60 pound child and I simply can't. Oh, he wanted his mommy. I can't imagine why. It's like using a shotgun to swat flies. Can you not see that? Do you even realize the danger of using an object like a heavy leather strap around the lower back of a small child or are you completely clueless?

Yes, I can certainly see a leather belt being used on a child's backside because I used them on all 3 of my children and they were all various weights and sizes. None of them were ever hurt or seriously deranged from spanking with a belt. I was spanked with a belt and a fly swatter and a switch all of my young childhood and I came out just fine and my children are just fine. We are in the Bible belt and we can use corporal punishment if we so desire. Look a man's hands can be just as much an enemy to a child as another other instrument used in punishment. What are you trying to say? You must not believe in punishing a child. In the study of criminology if you do not take hold of a child during his young formative years what you will end up on your hands is a delinquent child who steals, kills, gets into drugs and all kinds of haneous offenses. I would rather see a child spanked at a young age and learn from his mistakes than the other end of the specktrum where he spends life in prison. I bet people would wounder why his father didn't discipline him at a young age then wouldn't they? It would all be the parents fault for his tormented condition in the end now wouldn't it. let me point out something for the people that are new to this site. I DID post the entire file above for everyone to see. Now, when more stuff appears in the file, I will put it up and that includes any defense documents as well. If I'm able to, I will probably attend the hearing. Mr. Swain deserves his day in court and a chance to prove his case and defend himself. Anyone who reads this blog for awhile knows that anything filed in defense of Mr. Swain will be posted on this site.

By the way, those pictures are not of the child's back but of his flank. The rest of his gluteus maximus looks just as black and blue as his flank does. I originally posted back because frankly, that is what it looked like at first then realize it was the flank and changed the word a couple of days ago.

All this talk of spanking got me thinking...someone ought to know how to do it correctly. I was a bit shocked by the entire video, but it appears to actually been published on TV.

I don't think that anyone should ever hurt a child, but this guy hasn't had a chance to defend himself in a court of law by a jury of his peers. He is being convicted by publicity. I have seen the pictures too. I feel for the child, but I thought our legal system work differently than this. Why doesn't Amy Swain McIntosh not have to idenify herself when on her blog she cleary identifies her minor child.

Yes, I saw the comment that got deleted regarding why in the world is it okay for everything that MS has ever done to be posted all over this blog but nothing about the ex.

I have to wonder about the attention seeking. Who truly loves a child and exposes him this way? Seems very self-serving to me.

I have to agree. My children would NEVER be subject to public scrutiny. NEVER, never, never, never. I would seek, as friends have done themselves, an environment that promotes privacy and healing. I certainly would not be posting it on the Internet.

Swain sure has some numbskulls in his corner. Bottom line, no charges have been filed against Gabe's mother for child abuse. Sorry Charlies.

Suffice it to say a trial will ensue and the "truth" will come out. Given the fact that all parties now have made this public, the State will pursue all avenues. I pray for the child and hope they all have extended family than can help here, this child is being exploited, in public, on one hand and been physically abused by another. I have yet to see a publicized trial go the way it appears it is supposed to go.

All right, here is the deal.

1. The focus of this post is Mr. Swain was indicted for felonious child abuse. I included the entire file so no one can say I was being selective in what was included.

2. I am NOT going to allow the trashing of the mother of the abused child. I don't care what she did in the past or what her character is or might be, she is not the issue here, the issue is was the child abused and how will the system handle it.

3. Having said that, I'm not going to allow the dating histories of either one to be brought up. Has nothing to do with anything.

4. The things I said in the post about past behavior were things of which I had personal knowledge. The point is this apparently was a crime (if he is guilty) of anger or an outburst of violence, something I have seen in the past.

5. As Mr. Swain and his wife make their case, it will be reported here. Won't act like you know who and selectively leave out info from the file or testimony just because it might help his case.

6. As far as I'm concerned, discussion of whether the mother should have created the website is fair game. I understand why she did it, agree with it somewhat, but when you take it public like that, you have to be prepared to answer questions and possible criticisms.

7. Guess what? I believe in corporal punishment. Could the child have been misbehaving? Absolutely. Could he have been defiant? Sure. Does that mean a six year old should get a beating that leaves bruises all over? Obviously not.

Noticed the exploitation has subsided a bit. Was the pic on your site? NO. It was on her site. She yanked it. This just smacks of bad blood. I have no stake in this game and frankly this just looks like a divorce gone bad. Who knows when those photos were taken. KF, I'd yank this one. It's a divorce action playing out on the internet. The girl appears very self serving and frankly nuts.

I agree. Mrs. McIntosh isn't on trial, and Mr. Swain is. No child should ever be hurt especially by a trusted parent, but neither should the other parent use that abuse as a way to earn money. Not that anyone needs my vote of support, but selling braclets???? I know that awareness is important, but what charity is the money going to?

Can we corroborate where it happened? When? How? I applaud the attempt to keep Heather in the media. It is important that the pressure continue to achieve justice in her death. This one just doesn't look right, it really does appear two-sided and you are taking a side that frankly hasn't exhibited any real smarts. I mean, if you were trying to make sure that your child was never going to be harmed again by an individual, would you actually go about it this way? I am sure the DA's are fuming at this point over her actions. She has published a lot of reasonable doubt. Why? It just looks like she is over-proving her point. This child should be in the care of others until this is settled. None of them...given all that has been presented here, on her blog, from the state; are thinking about the child. Where is his voice?

Truth of the matter is that the mother was exploiting the child's abuse. Period. No matter how noble she wanted it to sound, she was exploiting the issue and attempting to profit from it. Forget what the profit was being spent on since that's a moot point.

It appeared almost akin to excusing it by saying, "well as long as the town whore pays tithes to the church it will be okay." IMO.

I think the smart people in all of this are the ones we haven't heard from yet. They've got a better game face on. The ex wife is letting the left hand know what the right hand is doing. It is easy to see through all the grandiose and defiant exploitive devices used in this cat and mouse game of hers.

So I am calling on legislators to require a prescription for belts and paddles over a certain weight for children over a certain age. Alternatives like suspenders and wooden spoons are readily available and just as effective except in the most serious cases.

Depending on what is stated, I may give them my vote as well. I'm all for everyone being in at least some form of agreement on what is acceptable to use then there won't be any questions about it. The law will uphold the law. If we all go back to the Bible it definitely says a rod. So what is a rod? Probably a stick of somesort with a certian diameter and length. You can't go wrong when you do it God's way. However, wooden spoons and fly swatters are easy to get as well as just going to a tree and pulling off a switch as the ole timers did back in the day. Also, we probably need to come to an agreement on the number of lashes one can use and the number of spankings a child can get in a 24 hour period. We probably just really need to spell it all out so there will be no questions about how to do it. Then, if someone spanks one lash too many, then you know you have crossed the line and deserve the ultimate punishment under the law. I'd say that would be fair wouldn't you? Yes, why don't we let the govenment tell us exactly how to discipline our children just like they do in every aspect of our lives. We are headed for socialism anyway so why not start now. The schools are already getting into our children's personal lives, having them keep journals and such on a daily basis. The school has a good ideal of what's going on in the families these days all eyes are on our every move within our on homes. We will soon no longer have any form of privacy in our homes because of government involvement. But, hey, everyone seems to want it, so get ready...it's coming.

As I was reading the article posted here and also the blog of Gabe's Mom it suddenly occurred to me that if you noticed the finest detail to the indictment order that the court used initials of the boy "G.S." instead of his entire name. I have seen photos on Mrs. McIntosh's blog as well as the child's entire name mentioned "Gabe Swain". If the court's felt it was important enough to only use his initials in the indictment papers then why is this women feeling it necessary to go above and beyond what the law would do and exploit her son all over the world wide web. There are laws also for the exploitation of children on the internet. I don't care if she is saying it is for a worthy cause. Nevertheless, the damage has been done to the child. This seems to me to be a separate crime in and of itself. I hope the DA socks it to her and files reverse charges on her. That in no way resembles love for that little boy.

Try reading "No, Daddy, Don't. John Battaglia is on death row in Texas. He had abused his wives but never his children. Until one day when facing jailtime for assault on his ex, he shot and killed his 2little girls to punish is ex for filing charges against him. I bought a 1999 Lexus ES from Swain Auto Sales in Florence, MS about 5 months ago. The cd player was missing in the car, although the advertisement clearly stated that the car had one. About 2 weeks after I bought it, I had a leak in a tire, only to discover that ALL four tires needed to be replaced immediately. I started having battery problems and took it to Advanced Auto Parts, where they discovered the dealer had put in a battery too small for the car. The very next week I had to replace the spark plugs and ignition coils ($650). Yesterday I had to replace the alternator at Firestone, and they discovered that the dealer had tampered with the fuse that would alert me to engine problems. Apparently the "professionals" at Swain auto sales disabled the warning sensor so potential buyers of the car wouldn't realize something was wrong with the car. My advice, go somewhere else to get a car.

I saw these pics of what he calls a small bruise and they are far from that. I would never buy another car from such a liar as David Miles Swain and especially from a child abuser. I just re-read the with his ex-wife comment. So are you claiming that ex-wife was physically abused? Why were no charges ever filed. This is a game changer. Do tell.

A. Did the guy "alledgely" abuse his child? yes
I as a child (along with a lot of people that everyone knows) was whipped. Sometimes leaving whelps and bruises on my rear. Do I think my father abused me...def not. Whether or not the defendant went to far....maybe/ probably...but who knows. I bruised a lot easier as a kid myself than I do now.

B. Was it an accident that it went to far (ie. spanked the kid harder than he shoulda/thought he was doing) or was it intentional? who knows...NONE OF US..

c. Is KF bias...? WELL OFCOURSE ...why? who knows..Evidence= deleting most neg comments of the mom, but letting himself and others post things to demener the guy's character and EVEN business! true read above. the "deleted" comments are retaining to the mom cheating on MS in wedlock. or other guys she was fooling around with(longggg laundry list)..but he let the comments fly to what MS did to the guy who was the "other guy" (the dumbell thing).

e. And people went as to much as bash the wife w/o knowing anything....sad. From what I understand the wife was asleep, BUT being that she was there, the police which the mom stated she was friends with above pursued charges (spiteful sounding much?)(was she there "rooting" the beating on..comon MS hit him harder ? ...who knows)
comon people..IF you know ANYTHING about the law you can get arrested for ANYTHING!!!!!!! in this state. If you say that another person has done ANYTHING that person will go to jail! PERIOD. You really don't have to have any proof to get an arrest. Whether or no they get convicted is a dif story. I've zapped a few things. Here's the deal.

Mr. Swain was charged. He pleaded guilty. If it pertained to the charges against him, I left it up. Somethings like the dumbbell incident, I have personal knowledge of so I left them up to as I knew they weren't slander.

As for comments about the kid's mom, you want it to stay up, send me some proof. I left up criticism about the website because she is the one who put it up there and that comes with the territory when you do such things. If I've mentioned some other incidents Miles has been involved in its been to show what I think is a pattern of anger management problems which ties in directly to this incident.

You don't beat a kid's ass till its black and blue all over. I'm all for spankings, don't get me wrong, but there is a limit on how far you should go with one just like on other forms of punishment.

Of course u zapped a few things.....You deleted the previous reason as to why he hit the guy with the dumbell and thats in the divorce papers..HOW would you react if your wife/husband repeatedly cheated on you? which isn't your personal knowledge but any persons knowledge that wants to look. And what does the value of his house he is selling or how someone says he screwed them over (ie people degrading him as a business owner) tie in with the incident... not deleted?

And you really have to weigh the pros vs the cons when u are accused of a felony of any kind. which are:

A. Does a person repeatedly fork out money when they think their not guilty? (look at the bond alone, much less the att. fees) or do they go ahead and Plead guilty to a WEAK MISDEMEANOR, pay a small fine and move on?
B. Do they plea out and get to continue to work and make money for their family or do they drag it out for months, years and maybe/ probably get off after all the facts, or plead a WEAK MISDEMEANOR, and move on.

Also comparing MS (who plead a misdemeanor) to a capital murder offender, that repeatedly used drugs since he was 16 and beat his GF over and over...is just sad, much less let the other post fly.

And if you read the info on felony child abuse (which I did) it says serious bodily harm, broken bones or threatening the life of the child.....as badly as an ass can be bruised it didn't look like his life was in danger to me.
